Before entering work data, check the specific product, plan, account settings, integrations, and contract for how prompts and files are used, retained, deleted, and accessed. Use the minimum data necessary, and get organizational approval before using personal, confidential, or regulated information.
Start with the task and the data it requires
Write down what the tool is expected to do—such as draft a routine email, summarize a document, or analyze records—and what information it would need. Then classify that information under your employer’s policy and the rules that apply in your jurisdiction. A tool that is acceptable for drafting from public material may not be approved for customer records or confidential business information.
The Australian Office of the Information Commissioner (OAIC) advises regulated entities to avoid entering personal information, particularly sensitive information, into publicly available generative AI tools. Its workplace guidance also warns: “Once personal information has been input into GenAI systems, it is difficult to track or control how it is used, and potentially impossible to remove.” Read the OAIC workplace guidance.
If the task can be completed without personal or confidential details, leave them out. The UK Information Commissioner’s Office (ICO) describes data minimisation as not using more personal data than necessary. Remove identifiers where practical, provide only the relevant excerpt, and avoid uploading unrelated records. See the ICO’s guidance on security and data minimisation in AI.

Compare tools on the questions that affect your use
Do not rely on a general claim such as “private,” “secure,” or “enterprise.” Compare the actual service and configuration you would use, and evaluate whether its output is accurate enough for the task and can be checked by a person.

| Access and security | Which users, administrators, vendors, or subprocessors may access the information? What safeguards and audit records are available? |
| Integrations | What data is shared with plugins, connectors, or other connected services, and under what terms? |
| Deployment | Would hosted, private-cloud, or on-premises deployment change disclosure or operational risks for this workflow? |
| Governance and compliance | Do the terms, approvals, workplace policies, and applicable legal requirements fit this use? |
Ask the vendor or internal administrator for clear answers tied to the exact plan and account settings. If a material point—such as training use, retention, or access—is unclear, do not assume the most privacy-protective interpretation.

Check the full data path, including third parties
A workplace AI service may involve more than the model provider. A connector, plugin, cloud host, or other subprocessor can introduce separate access, retention, and transfer arrangements. Ask what information leaves the organization at each step, which parties receive it, and which terms govern that processing. NIST’s Generative AI Profile identifies procurement due diligence, service agreements, and transparency measures as potential controls for third-party risks. See NIST AI 600-1.
Hosted, private-cloud, and on-premises deployments involve different trade-offs rather than a simple safe-to-unsafe ranking. The OAIC notes that on-premises or private-cloud systems may avoid secondary disclosure to another entity. They do not remove the organization’s responsibility to manage access, security, retention, privacy, and accuracy risks.

Use a staged selection process
- Define the workflow. Specify the task, the intended users, the information needed, and how a person will review the result.
- Classify the information. Check whether it includes personal, sensitive, client, or confidential data. Identify the relevant workplace policy and jurisdiction; obtain approval before using restricted information.
- Shortlist for capability and fit. Evaluate whether each candidate can perform the task within the workflow. Treat privacy claims as prompts for verification, not as a substitute for reviewing terms.
- Review current terms and settings. Record the answers for the particular plan and account configuration on training or secondary use, retention, deletion, access, and integrations.
- Involve the right reviewers. Ask security, privacy, legal, procurement, or IT owners to assess uses involving regulated data, consequential decisions, or significant third-party processing. NIST’s AI Risk Management Framework is a voluntary risk-management aid, not a replacement for legal or organizational requirements. Check NIST’s AI Risk Management Framework page.
- Pilot within approved limits. Where appropriate, test with low-risk or de-identified information. Check output quality and document what uses are permitted and what human review is required.
- Reassess when circumstances change. Revisit the decision if the vendor’s terms, account settings, integrations, data types, or task changes.
Set workplace rules before broad use
A tool decision is only one part of privacy protection. Organizations should set an acceptable-use policy, train staff, assign owners to review AI-generated work, and conduct a privacy impact assessment where appropriate. The OAIC also recommends actively managing available settings. These controls help employees understand which information may be entered and what checking is required.
De-identification, local hosting, or a privacy feature can reduce some risks, but none is a blanket guarantee. The ICO notes that privacy risks remain even for models that are not overfit to training data. Differential privacy is also challenging to implement meaningfully; NIST SP 800-226 discusses implementation hazards. Read NIST SP 800-226.

Apply the guidance to your jurisdiction
The cited guidance comes from U.S. NIST, the UK ICO, and Australia’s OAIC. It offers a practical cross-jurisdictional decision framework, not a substitute for checking local law, your organization’s policy, or the vendor contract. The ICO says its AI and data protection guidance is advice and best practice rather than a statutory code, and that it is under review following UK legislative changes. Read the ICO’s note about its guidance. NIST says AI RMF 1.0 is being revised, so check its current materials when applying the framework.
