To choose a Bitcoin product in a U.S. brokerage account, first decide whether you want exposure to Bitcoin’s spot price or to Bitcoin futures. Then compare the product’s current prospectus, sponsor fee and any waiver, benchmark, custody disclosures, trading spread, premium or discount to net asset value (NAV), and your broker’s terms. The spot products commonly called “Bitcoin ETFs” are more precisely spot Bitcoin exchange-traded products (ETPs): they are structured as commodity trusts, not funds registered under the Investment Company Act of 1940.
What does a Bitcoin ETP hold?
U.S.-listed spot Bitcoin ETPs hold Bitcoin and seek to track its price. Despite the common “ETF” label, the SEC says these products are structured as exchange-traded commodity trusts and are not ETFs registered under the Investment Company Act of 1940. That distinction matters because registered funds have legal requirements, including rules concerning custody and valuation, that do not apply to spot Bitcoin ETPs in the same way. Read the [SEC’s September 2024 investor bulletin](https://www.investor.gov/introduction-investing/general-resources/news-alerts/alerts-bulletins/investor-bulletins-24).
A Bitcoin futures fund instead gets exposure through futures contracts. Futures prices can differ from Bitcoin’s spot price, and a fund that replaces expiring contracts—known as rolling—may have results that diverge from spot Bitcoin. The SEC and CFTC explain these risks in their [joint investor bulletin](https://www.cftc.gov/LearnAndProtect/AdvisoriesAndArticles/bitcoin_futures.html).
How to compare Bitcoin products
Use current filings and your brokerage’s trading screen, not a launch-era fee list or a product’s brand name, to compare funds. Fees, waiver terms, trading conditions, and product arrangements can change.

Where to verify a product’s terms
Read the latest prospectus and reports before trading. They describe the product objective, benchmark, valuation process, risks, custody arrangements, fees, and creation and redemption mechanics. SEC-filed documents are searchable through [EDGAR](https://www.sec.gov/edgar/search/).
For example, an SEC-filed iShares Bitcoin Trust ETF prospectus describes Bitcoin holdings, the CF Benchmarks Index, cold storage for the custodian’s Vault Balance, and a 0.25% annualized sponsor fee in that filing. That is a filing-specific example, not a current fee ranking; review the latest prospectus and amendments for current terms.

A 2025 Invesco Galaxy Bitcoin ETF prospectus identifies the Lukka Prime Bitcoin Reference Rate as its benchmark, Coinbase Custody as Bitcoin custodian, and BNY Mellon as cash custodian. It also warns that shares can trade at a premium or discount to NAV. Check later filings for changes to those details.
Understand costs beyond the sponsor fee
The sponsor fee is not the only cost to check. Review any waiver and its end date or conditions, and look for commissions or other trading charges in your brokerage account. For a spot trust, the sponsor fee reduces the amount of Bitcoin represented by each share over time. A temporary waiver can make an old fee comparison misleading once its terms change.

Trading costs also depend on the difference between the buying and selling prices (the bid-ask spread) and on the relationship between the share price and NAV. A product can trade above or below NAV; a narrow sponsor fee alone does not establish that a trade will be inexpensive.
Check tracking, trading, and custody risks
Tracking and reference pricing
A spot ETP seeks to track Bitcoin, but its share price is not guaranteed to match Bitcoin’s price at every moment. The SEC identifies share demand, issuer problems, and broader crypto-market events as possible reasons for deviations. Each trust discloses its own benchmark and valuation procedures, so compare those details and historical tracking rather than assuming all products use the same reference price.

Trading conditions
Check current volume and bid-ask spreads in your brokerage interface, and compare the market price with NAV. Consider a limit order if you want to specify the highest price you will pay or the lowest price you will accept. No single liquidity ranking should substitute for checking the trading conditions when you place an order.
Custody and structure
Identify the Bitcoin custodian and review the prospectus’s account of custody, private keys, service providers, and asset arrangements. Spot Bitcoin ETPs do not receive the full set of Investment Company Act protections that applies to registered ETFs and mutual funds. SEC approval of exchange listings is not an endorsement of Bitcoin, a particular product, or a custodian; the Commission described its position as merit neutral in its [January 10, 2024 statement](https://www.sec.gov/newsroom/speeches-statements/gensler-statement-spot-bitcoin-011023).
