What CFTC regulation means for a prediction market
The CFTC describes event contracts as derivatives whose payouts depend on a specified event, occurrence, or value. They are often structured as yes-or-no scenarios; examples include outcomes tied to economic indicators, company earnings, snowfall, or hurricane damages. A Designated Contract Market is an exchange under CFTC oversight pursuant to the Commodity Exchange Act. Certain markets that provide trading facilities to people who are not eligible contract participants must apply for DCM designation, unless an exemption or exclusion applies. The CFTC explains the framework on its DCM overview page.
In practical terms, a DCM listing tells you that the named entity has a recorded designation status. It does not establish that every event contract on the venue has been separately approved, that every contract is permitted, or that every person can access the platform. Check the exchange status and the specific product as separate questions.

How to check the CFTC’s official records

Identify the legal operator
Look in the platform’s terms, disclosures, or website footer for the company that operates the trading venue. Note whether the documents name a separate exchange or trading venue as well as a consumer-facing brand. Search using the legal entity, not just the product name; CFTC filings may include assumed names or name-change remarks.

Search the DCM records
Start with the CFTC’s Designated Contract Markets page and its Industry Filings: Designated Contract Markets database. Search for the operator’s legal name and inspect its status. “Designated” and “Pending” are different: a pending application is not a designation.

Read the record, not just the search result
Check the entry’s date and remarks, then open linked documents where available. If the record names a company different from the platform’s brand, use official disclosures and filings to establish the connection rather than assuming the names refer to the same entity. The CFTC also provides a filtered list of designated DCMs.

Check the particular contract separately
For a claim about a specific event contract, look for its product filing and current CFTC material. The agency says DCMs may submit a new contract through self-certification that it complies with the Commodity Exchange Act and regulations, or request Commission approval; these are distinct routes. The CFTC’s Contracts & Products page discusses product submissions and event-contract restrictions under Regulation 40.11. That regulation addresses specified categories, including terrorism, assassination, war, gaming, and unlawful activity; its application depends on the regulation’s terms and current agency action, so a category label alone is not enough to determine a contract’s status.

Record when you checked
Include the date you consulted the CFTC record when sharing or relying on the result. The filings database is live, and designations, pending applications, and legal-name remarks can change.

Verify the app and know where complaints can go
The CFTC advises consumers to reach an app through links from the trading website to verify that it is the official app. Its consumer information identifies complaint options involving a broker, DCM, the National Futures Association, and the CFTC. Use the agency’s prediction-markets consumer guidance for those checks.

Keep the result current
The CFTC’s public materials have included recent developments that illustrate why a check should be dated. On March 12, 2026, the agency announced a Division of Market Oversight advisory about event-contract listing. It highlights DCM responsibilities under the Commodity Exchange Act and regulations, including surveillance and compliance with core principles; it is staff guidance directed to DCMs. On March 16, 2026, the CFTC issued an advance notice of proposed rulemaking seeking comments on prediction-market event contracts. An advance notice and request for comments is not a final rule. Check the agency’s March 12 advisory announcement and March 16 notice for their status and any later updates.

The CFTC’s educational timeline dates the Iowa Presidential Stock Market to 1988 and its first designation of a prediction-market DCM to 2004. Those dates describe the agency’s historical account; they do not mean that every platform operating now is regulated.
