There is no dependable nationwide yes-or-no answer: legality depends on where you will possess, use, buy, sell, or transport the product—and on its exact cannabinoid profile, form, and intended use. Check the current law and official regulator guidance for each relevant state or tribal jurisdiction, then assess federal product rules separately. A “hemp” label or a seller’s shipping policy does not settle the question.
What to check before deciding whether a hemp THC product is legal
Start with the place the product will be possessed or consumed. If it will cross state lines, check the rules for the route and destination too; the rules for every product and route are not established by a single general rule. If you are buying or selling, check the relevant origin and destination requirements.
Then identify the product as precisely as possible. The word “hemp” alone is not enough: different laws may treat cannabinoids, formulations, and product formats differently.
- Form: edible, beverage, vape, flower, tincture, or another form.
- Cannabinoids: for example, delta-8 THC, delta-9 THC, or THCA; note whether the product is described as converted, synthesized, or intoxicating.
- Amounts and measurements: labeled milligrams per serving and per container, and the stated delta-9 THC percentage. Check whether a law refers to delta-9 THC, total THC, or another definition.
- Use and claims: whether it is marketed for food, a dietary supplement, inhalation, or a therapeutic purpose. Intended use, labeling, and marketing can affect federal requirements.
Keep the current label and any certificate of analysis (COA) to identify the product you are checking. A COA may report contents, but it does not by itself prove the product is legal in your state, complies with federal product rules, or is safe.

How to check the law in your state or tribal jurisdiction
- Find the current primary law. Search the relevant state legislature’s current code for hemp, cannabis, THC, and the named cannabinoid or product form. Check whether the law is in force, has a future effective date, or has been amended.
- Check the official regulator’s guidance. Look to the relevant agriculture, health, cannabis-control, or consumer-protection agency. USDA says states and tribes may add requirements for manufacturing and retail of hemp-based products and advises readers to contact the relevant government for details.
- Match the rule to the exact product. Confirm whether the official material addresses the cannabinoid, amount or concentration, form, intended use, and sales channel in question. A rule about hemp cultivation or raw material may not answer whether a finished edible or vape can be sold or possessed.
- Note dates and scope. Record the page’s effective date and the date you checked it. A page may describe a proposed change, a particular product category, or a rule that applies only to licensed sellers.
- Check federal rules separately. State authorization does not replace federal requirements. FDA says that meeting the federal hemp definition does not remove other applicable obligations under the Federal Food, Drug, and Cosmetic Act (FD&C Act).
- Do not turn a gap into a yes. If the official sources conflict or do not address the product, ask the regulator for clarification or consult an attorney qualified in that jurisdiction.
A national retailer’s list of states it ships to is not a substitute for this check: it reflects the seller’s own practices, not a complete legal determination for your product or circumstances.
What the federal hemp threshold does—and does not—tell you
FDA and CDC describe the 2018 Farm Bill’s hemp definition as cannabis and derivatives containing no more than 0.3% delta-9 THC on a dry-weight basis. Qualifying hemp was removed from the Controlled Substances Act, but that threshold is not a complete test of whether a finished THC product may be made, marketed, sold, or used. FDA says other applicable laws still apply, including the FD&C Act, and that product status can depend on intended use, labeling, and marketing. FDA also says THC and CBD products are excluded from the FD&C Act’s dietary-supplement definition.
The distinction between delta-9 THC and other measures matters. CDC notes that delta-9 THCA is not included in the 2018 Farm Bill definition it summarizes, and that THCA can convert to impairing THC when heated. State statutes may define THC differently or impose additional requirements. The Congressional Research Service’s August 20, 2025 report describes differing federal interpretations, appellate decisions, state restrictions, and legal challenges, including disputes involving products with delta-9 THC below 0.3% but total THC above that level. That history is one reason not to treat a label or one legal interpretation as a universal answer.

A federal definition change is scheduled for November 12, 2026
As of October 4, 2026, the 2018 Farm Bill threshold above remains the current federal baseline described by FDA and CDC. A change enacted in P.L. 119-37 is scheduled to take effect on November 12, 2026. The Congressional Research Service says the revised definition excludes specified synthesized cannabinoids and final-form cannabinoid products above 0.4 milligrams per container. It also says the enforcement implications remain unclear.

Do not apply the future threshold as though it were already in effect, or assume it answers every question about products already on the market. Recheck the law near the date you plan to buy, sell, transport, or possess a product; states may also change their own rules independently.

State and tribal requirements can add to the federal baseline, and they may distinguish products by cannabinoid, THC calculation, form, intended use, or whether they are sold through a regulated market. The Congressional Research Service reports both state restrictions and legal challenges; CDC says many states ban or restrict delta-8 sales. Those summaries are reasons to check the law where you are, not a substitute for current, product-specific local guidance.

California illustrates why product and date matter
California’s Department of Cannabis Control says Governor Gavin Newsom signed AB 8 on October 2, 2025. The agency lists prohibited hemp products that include hemp flower, inhalable hemp products, products with synthetic cannabinoids, alcoholic beverages containing hemp cannabinoids, and products made outside the regulated market. It says new enforcement powers for state and local agencies took effect January 1, 2026. The department also says California plans to integrate intoxicating hemp into licensed medicinal and adult-use cannabis markets beginning January 1, 2028, subject to rulemaking. These are California-specific statements; check the department’s current guidance and the law’s status before relying on them.
Legality is not the same as safety
FDA says delta-8 products “have not been evaluated or approved by the FDA for safe use in any context.” The agency describes concerns about variable formulations and labeling, psychoactive effects, and possible chemical or contaminant risks associated with some production methods. A product’s legal status, a seller’s claims, or a COA should not be treated as a safety approval.
