How to Check Whether a GST Late-Fee Waiver Applies to Your Return

GST waiver eligibility depends on the return or demand, period, charge, jurisdiction and notification. Learn how to review GSTR-3B records, compare official conditions and distinguish late-fee relief from demand-related relief.

To check whether a GST late-fee waiver applies, first identify the exact return or demand, the tax period, and the charge shown on your account. Then match those facts to an official Central or State/UT notification and its conditions. A portal balance is useful evidence of a posted liability, but it does not by itself prove whether a separate waiver covers you.

There is no single waiver test for every GST return. Routine late fees, the historical GSTR-9C relief for certain older years, and the separate section 128A relief for interest or penalties on specified tax demands are different measures. The right answer depends on the form, period, taxpayer category, jurisdiction, dates and action required by the applicable notification.

Start with the return, period and charge

Before looking for a waiver, write down exactly what the amount relates to. GST returns and demand proceedings are not interchangeable. A measure that applies to one form or liability does not automatically apply to another simply because the amounts appear in the same GST account.

  • Return or proceeding: Identify whether the issue concerns GSTR-1, GSTR-3B, annual GSTR-9 or GSTR-9C, or a notice or order. For a demand, note the section cited in the notice or order.
  • Period: Record the tax period or financial year. A notification may cover only named financial years or return periods.
  • Dates: Note the applicable due date, actual filing date if filed, payment date, and any notice, order or waiver deadline.
  • Type of amount: Distinguish late fee from interest, penalty and tax. Relief from one does not necessarily remove the others.
  • Jurisdiction and taxpayer category: Check whether the measure is Central or State/UT-specific and whether it limits eligibility by taxpayer class, turnover or another condition.

These details determine which rule to check. A delayed-return late fee is not the same as interest or penalty attached to a tax demand, even if all of the amounts appear in GST records.

Understand the main categories before you search

Most confusion starts when taxpayers use “waiver” as a general label. In practice, at least three different situations must be separated.

  1. Routine late fee for a delayed return. Section 47 of the CGST Act establishes late-fee liability for specified failures to furnish returns. The applicable amount and cap depend on the return and on amendments or notifications. GSTR-1 and GSTR-3B late fees therefore arise under the general delayed-filing framework unless a specific exception applies.
  2. Relief for a tax demand. Section 128A is a demand-related provision. It concerns conditional waiver of interest or penalty, or both, connected with specified section 73 demands. It is not a general cancellation of the late fee for filing a periodic return after its due date.
  3. A special historical annual-return measure. Notification 08/2025-Central Tax addressed a defined set of delayed GSTR-9C circumstances for financial years 2017-18 through 2022-23. Its filing cutoff was 31 March 2025, so it is not an open-ended relief route in October 2026.

Use the category that matches the legal character of the charge, not the label used in an online post or accounting discussion.

Find the official measure that matches your facts

Section 47 supplies the ordinary statutory basis for late fees, while section 128 gives the government authority to waive late fees in specified circumstances. That authority does not create a standing waiver for every overdue return. The operative notification and its conditions control.

Check the relevant CBIC or GST Council notification and, where applicable, the relevant State/UT notification or direction. Read the operative clauses rather than relying only on a headline, recommendation or news summary. Confirm all of the following:

  • the return form or demand provision covered;
  • the tax period or financial years covered;
  • any turnover, taxpayer-class or registration conditions;
  • whether the relief concerns late fee, interest, penalty, tax or an assessment amount;
  • the filing, payment, application or other action required;
  • the exact deadline and whether it has already elapsed;
  • whether the benefit is automatic or requires an application, response or order; and
  • whether the measure is Central-only or depends on a State/UT direction.

A recommendation, portal message or professional comment can point you toward an issue, but it is not itself a waiver. Likewise, an expired notification does not create current eligibility.

Compare two possible measures systematically

If two announcements appear relevant, compare them on the same seven axes:

  1. Object: Is it a return, annual statement or demand proceeding?
  2. Period: Which month, quarter or financial year is named?
  3. Taxpayer scope: Does it specify turnover, registration status or another category?
  4. Relief type: Is it late fee, interest, penalty or tax?
  5. Required action: Must you file, pay, submit a form or respond to a notice?
  6. Deadline: Is there a fixed cutoff, and is the cutoff a filing date or a payment date?
  7. Mechanics: Is the relief automatic on the portal or does an officer, application or other process determine it?

This comparison prevents a measure for an annual statement from being incorrectly applied to a monthly return, or demand relief from being mistaken for a filing-fee concession.

Check GSTR-3B late-fee and interest details in the GST Portal

For GSTR-3B, GSTN’s 6 March 2026 advisory gives a practical path to the system-generated return detail. Portal labels can change slightly, so use the equivalent Return Dashboard entry if the wording differs.

  1. Log in to the GST Portal using the registered credentials.
  2. Open Services → Returns → Returns Dashboard, or the portal’s Return Dashboard entry point.
  3. Select the relevant financial year and return period.
  4. Open GSTR-3B for that period and select Prepare Online.
  5. Open or download the System Generated GSTR-3B PDF.
  6. Review the fee and interest details, including amounts relating to earlier periods collected through the form.
  7. Save the PDF with the filed return acknowledgment, challans, payment references and any correspondence.

GSTN explains that late fees for prior periods are collected through the form. The system-generated PDF helps establish what the portal has recorded for that return period, which can be important when reconciling books and deciding whether a displayed amount is a late fee or interest.

That record is evidence of a posted liability, not a universal legal eligibility result. If a notification appears to cover your facts but the portal still displays an amount, retain the PDF and compare the notification’s conditions before paying or disputing the amount. Conversely, a missing amount on the screen does not prove that every condition for relief has been met.

The March 2026 advisory also concerns a specific interest-recalculation issue for February 2026. It should not be generalized into a waiver for other periods or into a broad promise that all GSTR-3B late fees will be removed.

GSTR-1, GSTR-3B and QRMP returns

GSTR-1 and GSTR-3B have different reporting functions, but both can attract late fees when filed after the applicable due date under the general framework. GSTN’s QRMP advisory states that late fee is applicable to delayed filing of such returns for the quarter. A quarterly filer should therefore identify whether the charge relates to the quarterly GSTR-1, quarterly GSTR-3B or another period before applying any relief.

Do not transfer an exception from one return to another. A notification may identify only GSTR-9C, a particular annual-return combination or a specific demand section. If no notification names your form and period, the ordinary late-fee rules continue to be the starting point.

Understand which dated relief may be relevant

Measure or situation What it concerns Key limit or date What to check
Ordinary delayed-return late fee Late fee for specified failures to furnish returns under the general framework, including GSTR-1 and GSTR-3B. Amount and limits depend on the form and applicable amendments or notifications; no universal waiver date is established. Return form, period, applicable due date, actual filing date and any notification that specifically grants relief.
Section 128A demand relief Conditional waiver of interest or penalty, or both, relating to specified demands under section 73. It is not a routine late-fee waiver. Applies to demands concerning FY 2017-18, FY 2018-19 and FY 2019-20. The full-tax-payment deadline described in CBIC Circular 238/32/2024-GST was 31 March 2025. Whether the notice or order is a covered section 73 demand, the relevant financial year, the tax paid and all conditions and deadlines.
Specified GSTR-9C late-fee relief Relief for specified delayed GSTR-9C filings connected with annual returns for FY 2017-18 through FY 2022-23 where a required GSTR-9C had not been filed with GSTR-9. Notification 08/2025-Central Tax, dated 23 January 2025, required the later GSTR-9C filing by 31 March 2025. That deadline has passed. Whether the financial year and filing circumstances match the notification and whether the required filing was completed by the cutoff. No refund of late fee already paid was provided.

The table describes the identified measures; it is not a substitute for checking later amendments or a State/UT measure relevant to your registration.

Section 128A: a demand-related measure

CBIC Circular 238/32/2024-GST states that section 128A was inserted with effect from 1 November 2024 to provide conditional waiver of interest or penalty, or both, relating to demands under section 73 of the CGST Act for FY 2017-18, FY 2018-19 and FY 2019-20. The circular describes 31 March 2025 as the deadline for full payment of tax under Notification 21/2024-Central Tax.

The provision is tied to the demand, the financial year and the statutory conditions. Start with the notice or order: record the section, period, tax amount and dates. Then determine whether the required tax payment and any other steps were completed within the specified window. Even if interest or penalty is relieved, tax remains a separate component unless the applicable rule says otherwise.

If your issue is simply that a monthly GSTR-3B was filed late, section 128A is generally the wrong pathway. Calling a routine late fee “section 128A relief” can lead to an incorrect filing or payment decision.

GSTR-9C: the stated deadline has passed

Notification 08/2025-Central Tax, dated 23 January 2025, addressed annual-return circumstances for FY 2017-18 through FY 2022-23 where a required GSTR-9C had not been filed with GSTR-9. It required the later GSTR-9C filing by 31 March 2025 and waived the excess amount described in its terms. It did not provide a refund of late fee already paid.

As of 13 October 2026, the 31 March 2025 cutoff has elapsed. For a historical filing, check the acknowledgment date and whether the exact financial year and filing circumstances match the notification. If the GSTR-9C was filed after the stated date, do not assume the old measure still protects it. A current annual-return issue must be checked against any later notification in force for that year, not against an expired announcement.

Check whether a nil GSTR-3B can be filed

A nil return is a filing status, not a late-fee waiver. GSTN’s nil-return guidance lists the absence of outstanding interest or late-fee liability as a condition for filing a nil GSTR-3B, along with the other nil-return requirements.

If the portal shows outstanding interest or late fee, that can prevent nil filing. Selecting a nil option does not erase the balance or establish that a notification applies. First determine whether the amount is correctly posted, then apply the relevant notification to the exact period and facts. If a correction is needed, keep evidence of the attempted filing and seek portal or jurisdictional assistance rather than repeatedly submitting an inaccurate nil return.

Use a practical eligibility checklist

  1. Label the liability. Decide whether it is routine return late fee, interest or penalty on a demand, tax, or another amount.
  2. Identify the form and period. Write down GSTR-1, GSTR-3B, GSTR-9, GSTR-9C or the demand form; add the tax period or financial year.
  3. Assemble the dates. Record the statutory due date, actual filing date, payment date and notice/order date.
  4. Confirm jurisdiction. Determine whether the relevant direction is Central or State/UT-specific and which authority issued it.
  5. Locate the notification. Use an official CBIC, GST Council or State/UT source. Save the version and date you relied on.
  6. Read every condition. Check taxpayer category, turnover, covered return, period, payment requirement and whether an application or response is necessary.
  7. Test each condition against records. Use return acknowledgments, payment records, notices/orders, the system-generated GSTR-3B PDF and correspondence.
  8. Check the cutoff. A missed filing or payment deadline, or an expired measure, may make the relief unavailable.
  9. Reconcile the portal. Compare the notification-based result with the amount displayed in the liability ledger and return PDF.
  10. Resolve mismatches before relying on the figure. If the rule appears to cover you but the portal still shows liability, or the scope is unclear, seek clarification from the appropriate authority or a qualified GST professional.

Documents to keep

Eligibility is easier to demonstrate when the dates and amounts are documented. Keep the filed return and acknowledgment, the original and revised challans, payment references, notice or order, annual-return records, the system-generated GSTR-3B PDF, screenshots or downloaded liability statements, and a copy of the notification. Record when each document was downloaded. If a portal display later changes, the dated copy helps explain what was visible when you acted.

For a demand-related measure, preserve the complete notice or order rather than only the page showing a total. The cited section, financial year, tax amount and service date can determine whether section 128A is relevant. For GSTR-9C, retain the GSTR-9 and GSTR-9C acknowledgment dates together because the relief described in Notification 08/2025-Central Tax depended on the annual-return circumstances.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What a portal balance can and cannot tell you

A portal amount can help verify the liability recorded against a return period, especially when paired with the GSTR-3B system-generated PDF and filing acknowledgment. It can show what the system calculated or posted, but it is not a universal account-specific waiver determination.

A balance alone does not establish that relief is available, and it does not prove that no waiver applies. In the same way, an amount that disappears from a screen is not a substitute for confirming that all legal conditions were met. Apply the notification to the facts and retain evidence of both the legal analysis and the portal record.

Frequent eligibility mistakes

  • Calling every form of relief a late-fee waiver: Interest or penalty relief for a tax demand is legally and practically different from late fee on a delayed return.
  • Applying a waiver across return types: A measure for GSTR-9C does not automatically extend to GSTR-3B, GSTR-1 or a demand.
  • Ignoring the financial year or filing cutoff: Historical measures often cover a defined period and require an action by a fixed date.
  • Confusing filing and payment deadlines: A rule may require the return, tax or both to be completed by different dates.
  • Treating a portal amount as the legal answer: A posted liability is important evidence, but the notification determines whether the specific relief applies.
  • Assuming prior payment will be refunded: The stated GSTR-9C measure did not provide for refund of late fee already paid.
  • Assuming an automatic credit: Some measures may require a particular filing, application or response; do not presume the portal will apply every benefit without action.
  • Relying on an old announcement: Confirm that the operative notification covers your period and that its deadline has not passed.
  • Using nil filing to avoid a balance: GSTN identifies absence of outstanding interest or late fee as a nil GSTR-3B condition.

Worked fact patterns

Monthly GSTR-3B filed late

Suppose a taxpayer filed a monthly GSTR-3B after its due date and sees late fee in the system-generated PDF. The taxpayer should identify the month, due date and filing date, then search for a notification naming that form and period. Section 128A should not be used merely because the taxpayer also received a tax-related communication; the notice must actually be a covered section 73 demand.

Old annual return with missing GSTR-9C

Suppose GSTR-9 was filed but a required GSTR-9C was not filed with it for one of the financial years listed in Notification 08/2025-Central Tax. The key question is whether the GSTR-9C was furnished by 31 March 2025 and whether all other notification conditions matched. A filing after that date cannot be treated as protected by the historical cutoff.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Section 73 notice for a covered year

Suppose a notice identifies a section 73 demand for FY 2018-19. The taxpayer should compare the notice, tax payment date and other conditions with section 128A and the directions described in CBIC Circular 238/32/2024-GST. This is a demand-relief analysis involving interest or penalty, not an ordinary return late-fee calculation.

When to obtain clarification

Ask the appropriate GST authority or a qualified professional when the notification uses an unclear taxpayer category, the registration spans jurisdictions, the notice has been amended, the portal amount conflicts with the return PDF, or the relevant deadline depends on a disputed service or payment date. Provide the exact form, period, dates, notice section and downloaded records. A general question such as “Is GST late fee waived?” does not provide enough facts for a reliable answer.

Sources and scope

The relevant official materials include sections 47 and 128 of the CGST Act; CBIC Circular 238/32/2024-GST; Notifications 21/2024-Central Tax and 08/2025-Central Tax; GSTN’s 6 March 2026 advisory on re-computation of interest under Table 5.1 of GSTR-3B; GSTN’s nil GSTR-3B guidance; and GSTN’s QRMP advisory on late filing. The result in an individual case can depend on the exact return, jurisdiction, taxpayer category, dates, amendments and wording of a notice or order.

Frequently Asked Questions

Does a GST late-fee waiver apply automatically when the portal shows a lower amount?

No. A portal figure is evidence of what has been posted or calculated. Match your form, period, taxpayer category and dates to the operative notification before concluding that a waiver applies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is section 128A a waiver of GSTR-3B late fees?

Generally no. Section 128A is conditional relief from interest or penalty, or both, connected with specified section 73 demands for FY 2017-18, FY 2018-19 and FY 2019-20. It is not a universal waiver of routine delayed-return late fees.

What was the GSTR-9C late-fee waiver deadline?

Notification 08/2025-Central Tax required the specified later GSTR-9C filing by 31 March 2025. That deadline had passed by 13 October 2026, and the measure did not provide a refund of late fee already paid.

How do I view GSTR-3B late-fee details?

Log in, open Services or the Return Dashboard, select the financial year and period, choose GSTR-3B and Prepare Online, then open the System Generated GSTR-3B PDF. Review and save the fee and interest details.

Can I file a nil GSTR-3B while late fee or interest is outstanding?

GSTN’s nil-return guidance lists no outstanding interest or late-fee liability as a condition for filing a nil GSTR-3B, along with other requirements. A nil selection does not itself waive the amount.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a GSTR-9C measure also cover GSTR-1 or GSTR-3B?

Not automatically. Relief is limited to the form, periods and conditions named in the notification. Check the operative wording instead of transferring an exception across return types.

What records should I retain when claiming or checking relief?

Keep the notification, return acknowledgment, due and filing dates, payment records, notice or order, system-generated GSTR-3B PDF and relevant portal statements. These records support both the legal conditions and the amount displayed.

What if the notification appears to cover me but the portal still shows liability?

Do not assume either result is conclusive. Preserve the portal record, compare every notification condition with your documents and request clarification from the relevant authority or a qualified GST professional.

The Bottom Line

There is no single GST late-fee waiver test. Identify the exact form or demand, period, charge, jurisdiction and dates; read the official notification that matches those facts; and verify the portal record, especially the GSTR-3B system-generated PDF. Section 128A demand relief and the 2025 GSTR-9C measure have distinct conditions and deadlines, and the GSTR-9C cutoff of 31 March 2025 has passed. Treat the portal balance as evidence to reconcile, not as a universal legal answer.
