An HOA may be able to raise assessments without a community-wide vote, but there is no nationwide rule that answers the question. The result depends on your state, whether the community is an HOA or condominium association, and the declaration, bylaws, budget provisions, notice rules, and assessment limits that govern the property. Start by identifying the authority for the increase, obtain the financial and meeting records behind it, and test both the numbers and the required procedure. Do not assume that sending a dispute suspends your payment or collection obligations; get local legal advice promptly if a lien, collection action, or lawsuit is threatened.
What determines whether an HOA fee increase is valid?
Assessment authority usually comes from a recorded declaration or CC&Rs, supplemented by the bylaws and applicable state law. Those documents may authorize an annual assessment, permit a board to adopt a budget, require member approval above a stated threshold, impose a percentage limit, or set special notice and meeting procedures. A cap or voting requirement may appear in the governing documents even when state law does not impose one.

State statutes also differ by association type. A homeowners’ association statute may not govern a condominium association, and a condominium statute may impose reserve or budget duties that do not apply to every HOA. Confirm the property’s state and legal structure before relying on a rule found online.
There is no safe percentage rule
A particular increase is not automatically lawful or unlawful because it is 5%, 15%, or 30%. Texas State Law Library guidance, for example, explains that Texas has no general cap on how much or how often assessments may rise; restrictions are often found in the association’s documents. That Texas example cannot be exported to another state. The relevant question is whether this association had authority, followed the required process, and used a supportable budget and allocation method.

Separate the legal and financial questions
Two separate objections can exist:
- Substantive objection: an expense, reserve contribution, project, forecast, or allocation appears inaccurate, unsupported, or inconsistent with the governing documents.
- Process objection: the board may have lacked authority, failed to give notice, skipped a required vote or open meeting, adopted the budget improperly, or denied records required by law.
Write each issue separately and identify the exact document clause or statute that supports it. A financially sensible increase can still have a procedural defect, and a perfectly documented meeting cannot fix an assessment that exceeds a binding cap.
Step 1: Identify the association and the governing documents
Before challenging the amount, establish which legal rules apply. Record:
- The state and county where the property is located.
- Whether the property is in a homeowners’ association, condominium association, planned community, cooperative, or another common-interest association.
- The name of the recorded declaration or CC&Cs, bylaws, amendments, and current rules.
- The budget period and effective date of the new assessment.
- Whether the charge is a regular assessment, a special assessment, an emergency assessment, or a combination.
Read the declaration, bylaws, articles when relevant, amendments, and any assessment or budget policy. Search for the terms assessment, annual assessment, budget, special assessment, increase, member approval, notice, meeting, reserve, and allocation.

Make an authority map
Create a short record showing the clause that grants assessment power, the person or body allowed to set the amount, any cap or exception, the vote threshold, the notice period, and the formula used to divide costs among units. Note whether an amendment changed any of those provisions. If the board cites a statute or regulation, obtain the current text from the state’s official source and check that it covers your association type.
Step 2: Request the records behind the increase
Send a dated, specific written request to the address or electronic method required by your documents or state law. Ask for inspection and copies, and ask the association to explain any copying charge or required form. Request records for both the old and new budget periods:

Utah Department of Commerce, Office of the Homeowners’ Association Ombudsman guidance lists budget documents, financial statements, and reserve analysis among records an owner may inspect or copy. Its published written-request process asks for the association name, owner name, property address, email address, requested records, and whether the owner wants inspection or copies; the page states a 10-business-day response period. Florida’s homeowners’ association statute also provides a records-access process with a 10-business-day timeframe after a written request for covered associations. These are jurisdiction-specific examples, not a national deadline.
A practical records-request template
To: {{Association name and records contact}}
From: {{Owner name and property address}}
Date: {{Date}}
I request inspection and electronic copies of the following records for the {{budget period}} assessment decision: the current and prior adopted budgets; year-to-date financial statements; reserve study or reserve analysis; minutes, agendas, notices, and materials concerning the increase; the assessment calculation and allocation schedule; the notice and vote tally; and the governing-document and statutory provisions relied upon. Please confirm the inspection date, delivery method, and any lawful copying charge.
Keep the sent message, delivery confirmation, response, and every document received. A precise request is easier to enforce than a general demand for “all financial records.”
Step 3: Reconcile the old and new budgets
Put the budgets into one worksheet. Use the same account names where possible, then calculate the dollar and percentage change for every material line. The basic formulas are:
Dollar change = new amount − prior amountPercentage change = dollar change ÷ prior amount × 100
If the prior amount is zero, describe the new line as a new expense rather than calculating a percentage. For example, an annual assessment rising from $1,200 to $1,380 is a $180 increase and a 15% increase. Label any calculation as your analysis of the association’s figures, not as a benchmark for other communities.
| Budget area | Prior budget | New budget | Actual or forecast | Change to investigate |
|---|---|---|---|---|
| Insurance | Record the adopted amount | Record the adopted amount | Record premiums, renewal quote, or forecast | Coverage, deductible, claims history, or renewal assumptions |
| Utilities | Record the adopted amount | Record the adopted amount | Compare bills and usage | Rate changes, consumption, or one-time service |
| Maintenance and repairs | Record the adopted amount | Record the adopted amount | Compare invoices and contracts | Recurring service versus deferred or emergency work |
| Management and administration | Record the adopted amount | Record the adopted amount | Compare contract and staffing costs | New contract, renewal increase, or added service |
| Reserves | Record contribution | Record contribution | Compare reserve balance and study | Funding target, project timing, or unexplained reduction |
| Capital projects and debt | Record planned amount | Record planned amount | Compare bids, invoices, and loan schedule | One-time project, financing cost, or change in scope |
| Surplus or deficit | Record estimate | Record estimate | Compare prior actual result | Whether the increase covers a recurring shortfall |
Check that the budget balances
Confirm that projected revenues, expenses, and the stated surplus or deficit reconcile. Florida’s annual-budget statute calls for estimated revenues, estimated expenses, and an estimated year-end surplus or deficit. If the totals do not add up, ask for a corrected schedule before debating the percentage increase.

Separate operating costs, reserves, and one-time work
Operating expenses pay for recurring services such as insurance, utilities, management, landscaping, routine repairs, and administration. Reserve contributions are set aside for major repairs and replacements. Capital projects, debt service, and emergency work may be nonrecurring or have a different funding schedule. An increase that funds a recurring insurance renewal should be analyzed differently from one that fills a reserve shortfall or pays for a single roof project.

Test the owner allocation
Use the declaration’s allocation formula, not an assumption that every unit pays the same amount. Common formulas use equal shares, percentage interests, unit factors, or a mix of common and limited-common expenses. Recalculate a sample of unit statements and ask the board to explain any difference between the approved budget and the amount billed to you.
Compare assumptions with supporting records
For each material variance, ask what changed and request the document supporting it. An insurance increase should be traceable to a renewal, quote, coverage change, claim experience, or deductible decision. A utility increase should be compared with bills, rates, and usage. A management increase should match the contract or renewal. A project line should have a scope, estimate, bid, or board explanation. The goal is not to reject every increase; it is to identify unsupported assumptions and errors.
Step 4: Review reserves and major repairs
Ask whether the association has a current reserve study or analysis, what components it covers, the remaining useful life of major assets, the projected replacement cost, and the funding plan. Compare the board’s reserve contribution with the study’s recommendations and explain any deliberate deviation.
Ohio Revised Code section 5311.081, which governs condominium unit owners’ associations, addresses an annual estimated budget and ordinarily requires reserves adequate for normal major repairs and replacements. The statute identifies exceptions connected to governing-document restrictions or an annual written owner waiver. That Ohio condominium rule is not a universal reserve standard for every HOA; use it only when it actually governs the property.

Do not rely on an internet percentage as proof that reserves are adequate. The right amount depends on the association’s components, condition, timing, inflation, interest, insurance, and governing law.
Step 5: Check notice, meetings, votes, and adoption procedure
Read the declaration, bylaws, budget policy, and state statute together. Make a timeline showing when the board prepared the budget, gave notice, met, voted, sent the assessment notice, and made the charge effective. Compare each date with the required notice period and voting rule.
Texas State Law Library guidance states that board meetings to discuss or vote on an assessment increase must be open to members. Texas also illustrates why the documents matter: the state does not impose a general assessment cap, but the declaration or bylaws may impose one or require owner approval. Neither point should be generalized to another state.
Look for these possible defects:
- The board relied on a power that the declaration does not grant.
- A required member vote was omitted or the vote tally does not meet the threshold.
- Notice was late, sent to the wrong address, or omitted the assessment amount or meeting purpose.
- The meeting was closed when the governing rule or statute required it to be open.
- The budget was adopted by an unauthorized committee or officer.
- The effective date or billing schedule does not match the notice.
- The assessment allocation conflicts with the declaration’s percentage or unit-factor formula.
- A special-assessment procedure was used for what is actually a regular budget increase, or vice versa.
Step 6: Write a focused challenge to the board
After reviewing the records, send one letter that distinguishes factual questions from legal objections. Identify the assessment period, amount, effective date, and the specific documents reviewed. Attach a table of discrepancies and ask for a written response by a reasonable date.
A useful letter requests:
- The clause and statute the board believes authorize the increase.
- The calculation showing how the total budget becomes your unit’s charge.
- Corrections to identified arithmetic, allocation, or notice errors.
- Supporting records for material budget variances.
- A description of any required vote, meeting, or ratification and the vote result.
- Confirmation that collection activity will follow applicable law while the records issue is addressed, without assuming that a dispute automatically pauses payment.
Keep the tone factual. “The reserve contribution rises from the prior budget by this amount, but the minutes identify no project and the reserve analysis shows a different schedule” is more actionable than “the increase is unreasonable.” Ask the board to preserve records and place the issue on the next properly noticed meeting agenda if the documents permit an owner presentation.

Step 7: Escalate through the available local process
Check the governing documents for an internal hearing, dispute-resolution procedure, member meeting, petition, or budget-ratification process. Follow those steps and deadlines exactly. Some documents require mediation or arbitration before a lawsuit; others provide no internal appeal.
Then identify the state agency, ombudsman, or regulator with authority over the association type. Utah’s HOA Ombudsman’s Office says it can issue an advisory opinion on whether a state statute was violated. An advisory opinion is not the same as a court order, and availability depends on Utah law and the association’s coverage.
No universal appeal forum or challenge deadline applies nationwide. If the association threatens a lien, acceleration, collection lawsuit, foreclosure-related action, or a deadline to contest the charge, consult a qualified attorney in the property’s state immediately. Bring the declaration, bylaws, notices, payment history, records request, responses, minutes, budgets, and your calculation.

Do not assume that a records request or objection suspends the assessment. The reviewed authorities do not establish a universal stay or challenge deadline. Before withholding, underpaying, or placing money in escrow, obtain jurisdiction-specific advice about late fees, interest, voting rights, lien rights, collection costs, and the effect of a partial payment. If counsel recommends payment under protest or another protective step, follow that advice in writing and keep proof of every payment.
How the cited state examples differ
| Jurisdiction and source | What it illustrates | Limit on applying it elsewhere |
|---|---|---|
| Utah Department of Commerce, Office of the Homeowners’ Association Ombudsman; guidance reviewed against Utah Code as of August 10, 2026 | Written records requests can cover budgets, financial statements, and reserve analysis; the published process states a 10-business-day response period and describes an Ombudsman advisory opinion. | Applies only as Utah law allows and only to covered associations; it is not a national records deadline. |
| Texas State Law Library, Assessments — Property Owners’ Associations | Assessment authority and limits commonly depend on governing documents; Texas has no general cap; board meetings to discuss or vote on an increase must be open to members under the described Texas rules. | Texas guidance does not establish the rule for another state or association type. |
| Florida Statutes, Chapter 720, 2025 text | The homeowners’ association budget statute addresses estimated revenues, expenses, and surplus or deficit; the records process includes a 10-business-day timeframe after a written request for covered associations. | It is specific to Florida homeowners’ associations and the statute in effect for the relevant period. |
| Ohio Revised Code section 5311.081, last updated June 29, 2022 | For condominium unit owners’ associations, the board’s annual estimated budget ordinarily includes reserves adequate for normal major repairs and replacements, subject to stated exceptions. | It is an Ohio condominium provision, not a general HOA reserve benchmark. |
Owner’s review checklist
- Confirm the state, county, association type, budget period, and effective date.
- Obtain the declaration, CC&Rs, bylaws, amendments, rules, and assessment policies.
- Mark every authority, cap, exception, notice, vote, meeting, reserve, and allocation provision.
- Send a dated written records request using the required delivery method.
- Save proof of delivery and all responses.
- Build a prior-versus-new budget table and calculate dollar and percentage changes.
- Separate operating expenses, reserves, capital projects, debt, and one-time costs.
- Reconcile revenues, expenses, surplus, or deficit.
- Check insurance, utilities, maintenance, management, reserves, projects, and debt against supporting records.
- Recalculate your unit’s share under the governing allocation formula.
- Build a notice-and-vote timeline and compare it with the documents and statute.
- Send a focused written challenge that identifies each discrepancy and requested remedy.
- Use any internal hearing, mediation, petition, or member-meeting process.
- Seek local legal advice before withholding payment or if collection or lien action is threatened.
What a defensible challenge looks like
The strongest challenge is narrow and documented. It does not argue that every increase is unfair or rely on an unsupported “normal” percentage. It shows the authority clause, the budget line that changed, the record that supports or contradicts the change, the required procedure, and the remedy requested. If the numbers are sound and the process was followed, the records may still reveal why the increase was necessary and allow owners to plan. If the authority, calculation, notice, or records do not hold up, the same paper trail gives the board, an ombudsman, regulator, mediator, or court a concrete issue to resolve.
