If a GST demand order does not address objections you raised during an audit, first assemble the complete record and establish what was filed, with whom, and when. Then compare each material objection with the show-cause notice, hearing record and final order. A failure to engage with a relevant objection or provide a required hearing may support a procedural challenge, but it does not automatically make the demand invalid. Under section 107(1) of the CGST Act, the ordinary statutory appeal period is three months from communication of the decision or order, so verify the communication date and current filing requirements promptly.
Identify which GST document and stage you are challenging
“Audit objections were not considered” can describe several different problems. It may mean the audit report did not address a response to draft findings, the show-cause notice did not take account of audit-stage material, or the final adjudication order failed to consider a reply filed in the demand proceedings. Those are different documents and procedural stages. Your first task is to identify the precise omission and the authority responsible for the document in which it occurred.

A GST audit finding is not itself the final adjudication order. Section 65 of the Central Goods and Services Tax Act (CGST Act) provides for communication of audit findings and allows further proceedings when an audit detects specified tax or credit issues. The later demand is dealt with through the applicable demand provision and adjudication process. Thus, a disagreement with an audit observation is not necessarily the same as a challenge to the final demand order.

- Show-cause-stage objection: You raised the point in a reply to the show-cause notice, but the adjudication order does not engage with it or inaccurately states that no reply was filed.
- Hearing-related objection: You requested a hearing, or an adverse decision was contemplated, but no meaningful opportunity to be heard followed.
- Evidence-related objection: Relevant documents were submitted, were not considered, or could not be produced or admitted during adjudication.
Check the demand section cited in the notice and order, the tax period, the adjudicating authority, and the dates and methods by which the documents were served or communicated. Build a record showing what was filed and what the order did with it
The strength of a non-consideration argument depends heavily on the paper trail. A copy of an objection without proof that it reached the relevant authority may leave a key factual dispute unresolved. Likewise, an order that does not repeat every sentence in a reply is not, by itself, proof that the authority ignored the reply. Assemble the full sequence and identify the specific material point that was left unanswered.
Collect the documents in chronological order
- The audit notice, its stated scope and period, any draft audit report or proposed findings, and the final audit communication or report.
- Each audit-stage objection, its supporting documents, and evidence of filing or service, such as a portal acknowledgment or email receipt.
- The show-cause notice, the statement of demand, the material relied on by the department, and proof of when and how the notice was served.
- Your reply to the show-cause notice, all annexures, and filing acknowledgments.
- Any written hearing request, hearing notices, attendance or adjournment requests, and available records or minutes of the hearing.
- The final reasoned order, any demand summary or related form, and proof of the date it was communicated or made available.
Keep the original electronic files and acknowledgments where available. If you rely on a portal filing, retain the filing record and a readable copy of the exact submission and attachments, rather than relying only on a later summary or screenshot. For correspondence outside a portal, preserve the message, attachments, delivery details and any response. These records help establish both the content of the objection and whether it was before the authority in time.
Prepare an objection-to-order schedule
A short comparison table makes the alleged omission easier to evaluate than a general statement that “the reply was ignored.” Use one row for each material objection:

| What to record | What it establishes |
|---|---|
| The specific objection and the relief or finding sought | Precisely what the authority was asked to decide. |
| Supporting evidence and where it appears in the record | Whether the point was factual, documentary, legal or a combination. |
| The document and date on which it was filed, plus proof of filing | Whether it was presented to the proper authority before the relevant decision. |
| The order paragraph that addresses the issue, if any | Whether the order records and evaluates the substance of the objection. |
| Why any omission matters to the demand | How deciding the objection could affect the finding, tax, credit, penalty or other relief sought. |
| The specific relief requested | What you want the appellate authority or other forum to do about the alleged defect. |
Be exact when describing the order. If it mentions your reply but rejects it, explain why the reasoning is inadequate or why a material document was not addressed; do not describe that as an order that says no reply was filed. If the order expressly says no reply was received, place that statement beside the dated acknowledgment for the reply. The distinction can matter to the factual issue before the appellate authority.
Check whether a hearing opportunity was required and actually provided
Section 75(4) of the CGST Act states: “An opportunity of hearing shall be granted where a request is received in writing from the person chargeable with tax or penalty, or where any adverse decision is contemplated against such person.” The provision makes two circumstances important: a written request for a hearing, and a contemplated adverse decision. Record whether either applied and what opportunity was actually given.
A notice or order referring generally to a hearing is not a substitute for checking the record. Look for the hearing notice, its date, proof of service, any opportunity to attend, attendance or adjournment records, and whether you could address the points that formed the basis of the decision. A written hearing request and proof of filing are particularly useful when the order proceeds without a hearing.

In Bharat Mint, the Allahabad High Court considered a notice that did not specify a hearing date; the department admitted that no personal hearing had been afforded, and the court treated the omission as a breach of natural justice. That is a fact-specific example, not a guarantee that every hearing defect will result in the same relief or that every dispute requires the same procedure.
Assess the hearing issue alongside the written submissions. A procedural challenge should identify the particular opportunity that was missing and how the record shows it was missing. If a hearing took place, preserve the record of what was considered and identify any material issue that remained unanswered rather than treating the mere fact of a hearing as proof that every objection was addressed.
Use the ordinary statutory appeal route and protect the deadline
Section 107(1) provides that a person aggrieved by a decision or order of an adjudicating authority may appeal to the prescribed Appellate Authority within three months from the date the decision or order is communicated. The period runs from communication, so determine and document the actual date instead of assuming it is the date printed on the order, the date of an audit, or the date you first learned informally about the demand.

- Identify the appealable order. Confirm that the document you are challenging is the adjudicating authority’s decision or order, and record the authority, demand provision, tax period and date shown on it.
- Establish communication. Find the portal record, service information or other evidence showing when the order was communicated. Preserve that evidence because it is relevant to calculating the statutory period.
- Check current filing requirements immediately. Confirm the current rules, forms, filing method and applicable state or Union Territory requirements for the particular appeal. The statutory period stated here does not resolve the deadline in an individual case.
- State focused grounds. Identify the objection, where and when it was filed, the evidence supporting it, the way the order treats it, and why the omission could affect the demand. Address any hearing or evidence issue separately and connect each to the record.
- Keep the appeal record complete. Organize the challenged order, notices, replies, acknowledgments, hearing documents and supporting evidence so that each ground can be checked against the underlying file.
The three-month period is the ordinary section 107(1) appeal period. Do not assume that pursuing correspondence with the department, seeking an explanation, or considering another route changes that period. The deadline for a particular order depends on its communication date and applicable procedure, and other proceedings may be suitable in some circumstances. If the date or applicable procedure is uncertain, get case-specific advice without delaying verification of the appeal requirements.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Explain new evidence rather than assuming it will be accepted
Evidence that was not produced or admitted during adjudication may be relevant to an appeal, but additional evidence is not automatically accepted. The appeal rules allow it in specified circumstances, including where the adjudicating authority made the order without giving sufficient opportunity to adduce evidence relevant to a ground of appeal. The appellate authority must record written reasons for admitting additional evidence, and the adjudicating authority must have a reasonable chance to examine or rebut it.

For each new document, explain what it proves, why it is relevant to a particular ground, and why it was not produced or admitted earlier. If the reason is that there was not a sufficient opportunity, identify the event or procedural gap and support it with the notice, request, filing record or hearing documents. Preserve the evidence in its original form. Do not assume that attaching it to an appeal alone satisfies the conditions for admission.

Grounds to investigate before alleging that the order is defective
A procedural ground is most useful when it is tied to a material issue and supported by records. Review each of these questions before deciding how to frame a challenge:
- Was the objection actually filed with the proper authority? Match the exact submission to the authority and stage, and locate proof of filing or service before the decision.
- Was the point material to the demand? Explain how accepting the objection or considering its evidence could affect the demand, rather than relying on a minor omission with no identified consequence.
- Does the order address the substance? Read the full reasoning. An order may reject a point without using the taxpayer’s wording; distinguish a reasoned rejection from silence, a material misstatement, or an unsupported assertion that no reply was submitted.
- Was a hearing requested or an adverse decision contemplated? Apply the two conditions in section 75(4) to the documented history and identify whether an opportunity followed.
- Was relevant evidence missing or excluded? If you seek to introduce it on appeal, explain the circumstances and address the additional-evidence rules.
- Was the correct demand provision used, and does timing matter? Check the provision cited and the relevant dates against the tax period. The tax period, demand section and dates are not specified here, so no limitation calculation can be made.
- Which forum is appropriate? Section 107 establishes an ordinary statutory appeal route. Whether a writ petition or another procedural route is appropriate depends on the case and jurisdiction; the applicable law and facts must be assessed for that choice.
How the court examples should—and should not—inform your case
The available examples illustrate why the actual submissions, hearing history and order wording matter; they do not create an automatic remedy for any taxpayer who says an audit objection was overlooked.
Bharat Mint: the hearing record mattered
In the Allahabad High Court matter, the notice did not specify a hearing date and the department admitted that no personal hearing had been afforded. The court treated the omission as a natural-justice breach in that case. A taxpayer relying on a similar concern should compare the notice and hearing record with the actual circumstances rather than assume the outcome follows from the case name alone.
Adama India Private Limited: compare the reply with the order
In Adama India Private Limited, the Karnataka High Court record included audit-stage and show-cause-stage replies and objections, a demand order, and a contention that the order incorrectly recorded that no reply had been filed. The court set aside the order and restored the matter to the show-cause stage after finding that a hearing opportunity had not been provided. The decision illustrates the importance of preserving submissions and acknowledgments and checking what the order says about them. It does not establish that every failure to discuss an objection produces the same result.
Limits of this overview
This guide addresses a national CGST-focused procedural question. It cannot determine the applicable SGST or UTGST counterpart, the limitation period for an individual demand, the merits of a tax or input-tax-credit issue, or the proper forum for a particular case without the relevant documents, dates and jurisdiction. The CGST audit provision text identifies section 74A as inserted by the Finance (No. 2) Act, 2024, dated 16 August 2024; the relevant demand provision must therefore be checked against the tax period and governing law rather than assumed from a general description of audit proceedings.
A taxpayer challenging a demand should have the order and record reviewed with the appeal deadline in view. The central practical point is to turn a broad claim of non-consideration into a verifiable account: what material objection was filed, when it reached the authority, what evidence supported it, how the hearing process unfolded, and what the final order did—or did not—decide.
