Then verify how it separates and accounts for customer assets, what it may do with them, who controls the keys, and how you could regain access after an outage or insolvency. A license or regulatory status alone does not establish that your assets are insured or will be returned.
1. Establish what you would own if the custodian failed
Identify the exact legal entity that would hold your assets and read the agreement for the nature of your claim. The critical distinction is whether the arrangement is custody or safekeeping of customer property, or instead creates a debtor-creditor relationship in which you have a claim against the firm.

Ask which jurisdiction and rules govern the account, how the agreement describes your property interest, and how customer assets would be treated if the contracting entity entered insolvency proceedings. Do not assume the answer is the same across assets, account types, or entities in the same corporate group.
Do not assume SIPC or another insolvency protection applies
SEC staff guidance says SIPC generally does not protect claims for crypto assets that are not securities when held for customers by a SIPC-member broker-dealer. The FAQ notes that such assets may lack another specific insolvency regime, leaving customers exposed to loss if the broker-dealer becomes insolvent. Its discussion of Article 8 treatment describes a possible arrangement, not a blanket guarantee. Ask whether the agreement and account structure provide for that treatment, and have a qualified professional review the answer if the amount is material.

2. Verify that customer assets and records are separated
Find out whether customer assets are kept apart from the custodian’s own assets both on-chain and in its internal books. Ask how the firm identifies each customer’s beneficial interest and records deposits, withdrawals, transfers, and corrections.
An omnibus wallet is not, by itself, proof that customer property is mixed with corporate property. New York State Department of Financial Services (NYDFS) guidance for entities within its scope permits an omnibus wallet if it holds only customer assets and the custodian’s records preserve each customer’s beneficial interest and transactions. Request an explanation of how the firm reconciles those records to wallet activity and how often it does so.

3. Read the contract for rights to use or encumber your assets
Check the agreement for language that lets the custodian lend, pledge, stake, rehypothecate, transfer, or otherwise use assets you deposit. Look separately for liens, collateral rights, and rights of set-off against amounts you owe. These terms can affect both control of the assets and what you could recover after a failure.

NYDFS’s September 30, 2025 guidance expects covered custodians to preserve customers’ equitable and beneficial interests, limit possession to safekeeping, and disclose the custody relationship, permitted use, and limitations. That guidance applies to the entities it identifies as New York-licensed virtual-currency entities or limited-purpose trust companies; it is not a universal rule for all providers. Compare what the agreement promises with what the firm says it does in practice.

4. Trace who controls the keys and the failure path
Map the full custody chain: the contracting entity, any sub-custodian, and material technology providers involved in holding assets, controlling keys, or maintaining records. For each, establish its role, where it operates, what it can access or authorize, and what contractual obligations apply. Ask what happens if a sub-custodian fails, is replaced, or cannot provide access.
For key management, ask how keys are generated, who can authorize transactions, how approvals are separated, and how backups are protected. Find out what procedures apply if a key is lost or compromised and how the custodian would restore service. A verbal assurance is not a substitute for a written control description and evidence that covers the service you would use.

5. Assess records, independent evidence, and continuity
Ask what independent audit or examination covers custody controls, key management, transfers, recordkeeping, and third-party risk. Check the evidence’s period, scope, and exclusions; a report that does not cover the relevant entity, assets, or service may not answer your question. Ask how often the firm reconciles customer balances with on-chain activity and whether it can demonstrate the process.
Also establish how withdrawals work during ordinary service and disruption. Request the supported assets and networks, any withdrawal controls or limits, how customers are notified of incidents, and the recovery procedures for an extended outage. A custody arrangement can preserve a property interest on paper while operational problems still delay access.

6. Compare providers using the same evidence request
Use the same questions and documents for each provider; otherwise, differences in disclosure can look like differences in safety. The framework below helps separate evidence from marketing claims.

7. Treat regulatory status as one input, not a safety guarantee
Regulatory oversight can matter, but it does not settle the account-specific questions above or establish that every asset is insured. Check that the entity and authorization you are verifying relate to the particular service in your agreement, rather than relying on a group name or a general claim of being regulated.
Federal banking-agency guidance addresses banking organizations and applicable law. In its May 7, 2025 release, the Office of the Comptroller of the Currency (OCC) said banks may outsource bank-permissible crypto-asset custody subject to appropriate third-party risk management, while remaining responsible for conducting the activity safely and lawfully. A July 14, 2025 joint statement by the OCC, Federal Reserve Board, and Federal Deposit Insurance Corporation discusses risk-management considerations for banking organizations; the agencies said it creates no new supervisory expectations. These statements concern banks and do not establish that a nonbank custodian, a particular account, or a particular asset has a specific insolvency outcome.

Scope of this assessment
The legal and regulatory examples here are U.S.-focused. SEC FAQ responses are staff guidance, not a universal legal conclusion for every token or account structure. NYDFS guidance applies to the entities within its stated scope, and federal banking-agency material addresses banking organizations.
