How to Ask Your Mortgage Servicer for a Loss Mitigation Review

A clear, documented loss mitigation request can trigger important servicing duties. Use a written all-options request, the servicer’s current checklist and a traceable submission method, then track completeness, deadlines, foreclosure dates and any appeal rights.

Ask in writing for a review of all loss mitigation options, request the servicer’s current application checklist and secure submission method, and require written confirmation of whether your application is complete. Keep every document, transmission receipt and date. A review request is not an automatic foreclosure stop or a promise of a loan modification, but a complete application can trigger important evaluation, notice and foreclosure-protection rules under federal Regulation X.

This guide covers U.S. federal servicing rules based on CFPB guidance and 12 CFR § 1024.41 current through October 9, 2026. State foreclosure procedure, loan type, investor requirements, bankruptcy and the servicer’s own submission instructions can change what applies in an individual case.

What a loss mitigation review actually does

Loss mitigation is the process a mortgage servicer uses to determine whether you qualify for an alternative to immediate foreclosure. Depending on the loan owner’s rules and your circumstances, the available choices could include a modification, repayment arrangement, forbearance, short sale or deed-in-lieu. Federal servicing rules govern how the servicer receives and evaluates an application; they do not require the servicer to offer one particular solution.

Your goal is therefore procedural and specific: create a dated record that you asked to be evaluated for every available option, submit the information the servicer requires, establish when the application became complete, and track the written decision. Do not treat the request itself as a settlement, a change to your payment schedule or a guaranteed delay of foreclosure.

Prepare before contacting the servicer

Use the official phone number, mailing address or online portal shown on your mortgage statement or the servicer’s verified website. Do not send financial records to an address supplied by an unsolicited caller or text message. Before you contact the servicer, assemble a working file—digital, paper or both—with the following:

  • Your loan number, property address and the names of all borrowers.
  • The date and amount of your current payment, the date you first missed or expect to miss a payment, and any notices you have received.
  • Recent income information for each borrower, such as pay records, benefit statements or business-income records that the servicer’s checklist requests.
  • A list of recurring expenses, other debts and assets if the application asks for them.
  • Every foreclosure document, including any notice of default, complaint, sale notice or court filing. Record the scheduled sale date exactly as it appears.
  • Copies of prior applications, decisions and correspondence with the servicer.

Do not guess which documents are required. Ask for the current checklist because requirements can differ by loan owner, borrower type and the option being evaluated.

Make the request explicit and traceable

A phone call can be useful for finding the correct department, but send the actual request through a channel that gives you a receipt or other proof of delivery. A secure upload, certified mail with tracking, fax confirmation or the servicer’s designated loss-mitigation portal may work. Follow the servicer’s instructions and save the confirmation page, transmission report or postal record.

I am requesting a loss mitigation review of my mortgage loan for all options available to me. Please send me the current application checklist and tell me how to submit documents securely. Please confirm in writing when you receive my application, whether it is complete, and—if it is incomplete—identify every item still needed and the deadline to provide it. Please also confirm the date of any scheduled foreclosure sale and the contact information for the person handling my review.

This is practical drafting, not a quotation from the CFPB and not a guarantee of a legal result. Attach only what the servicer requests at that stage unless its instructions say otherwise. Keep the exact version you sent.

Follow a step-by-step submission process

  1. Identify the correct channel. Ask the servicer which address, portal, fax number or department accepts loss mitigation applications. Ordinary payment-mail addresses may not route documents to the review team.
  2. Request the checklist and deadline. Ask for the current list of information and documents, the preferred file formats, any signature or notarization requirements, and the date by which the package should be returned.
  3. Send the initial package promptly. Include the request for all options, the information already available and a cover sheet listing every attachment. Use the loan number and property address on each page if the servicer permits it.
  4. Ask for a written completeness determination. Request confirmation of the date received and whether the application is complete. If something is missing or incorrect, require an itemized list and a reasonable due date for correction.
  5. Respond to follow-up requests quickly. During evaluation, the servicer may determine that an additional document or corrected page is needed. Send it through the same traceable channel and label it as a response to the specific request.
  6. Confirm the foreclosure status. Ask for the date of any scheduled sale, whether a foreclosure notice or filing has occurred, and the name and contact information of the person or team handling the review. Verify the information against court or trustee records where applicable.
  7. Calendar every date. Record the submission date, the date the servicer says the application became complete, each document deadline, the expected decision date and the sale date. Set reminders several days before each deadline.
  8. Keep communicating in writing. After a phone call, send a short message confirming what was said, the representative’s name or reference number and any promised action. Ask the servicer to correct the record if your summary is wrong.

What counts as a complete application

Under Regulation X, an application is complete when the servicer has received all information it requires from the borrower to evaluate the available loss mitigation options. “Complete” does not mean that you qualify or that an option has been approved; it means the servicer has the information needed to make the decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The checklist controls the practical standard

The required package can include income, expenses, assets, occupancy, hardship facts, tax information, authorizations and other records. The exact list depends on the loan and the options being considered. A document that was acceptable for an earlier application may be outdated or incomplete for a new review, so use the current checklist.

The servicer must exercise reasonable diligence

When information is missing, the servicer must use reasonable diligence to obtain what is needed to complete the application. It must promptly request additional information or a corrected document that it determines is necessary during evaluation. That obligation does not eliminate your responsibility to provide accurate records by the stated deadline.

Ask for an itemized deficiency notice

If the servicer says the package is incomplete, ask it to identify every missing or defective item at once and give a reasonable date for delivery. A vague statement such as “more documents are needed” is difficult to track. Compare the notice with your submission log and ask the servicer to explain any inconsistency.

Federal timing rules to put on your calendar

The dates below describe the general Regulation X framework. They apply only when the rule’s conditions are met, and exceptions or loan-specific requirements can change the result.

Situation General rule or practical effect
Complete application received more than 37 days before a scheduled foreclosure sale The servicer generally must evaluate the application and provide a written decision within 30 days, subject to the rule’s conditions and exceptions.
Complete application received 37 days or fewer before the scheduled sale The servicer may not be required to review it under the specific § 1024.41 process. Other loan-owner, contractual or applicable legal requirements may still matter, so submit promptly and ask what review will occur.
Complete application received 90 or more days before the scheduled sale For certain loan-modification denials, this timing can support an appeal right if the rule’s other conditions are satisfied.
Application received before the first foreclosure notice or filing In specified circumstances, a complete application can restrict starting foreclosure while the applicable process is pending.
Application received after foreclosure has begun In specified circumstances, a complete application can restrict entry of judgment, an order of sale or the sale itself. The protection is not automatic and depends on timing and other rule conditions.

The 37-day threshold is not a safe deadline for waiting. A sale can be moved, a notice can be issued earlier than expected, and the servicer may need time to identify missing information. Send the request as soon as you recognize a hardship or receive a foreclosure notice.

How the review and written decision work

Once the servicer has a complete application, it evaluates you under the requirements applicable to the loan owner or assignee and the available options. The review obligation is procedural. Regulation X does not require the servicer to approve a modification, offer a particular alternative or accept terms you propose.

Read the decision carefully

When a decision arrives, check the date, the option offered or denied, the payment and other terms, the deadline to accept, and any instructions for appeal or further information. If the decision is conditional, identify every condition and the date it must be satisfied. Do not assume that an approval is effective until you complete the stated acceptance steps.

If a modification is denied

Ask for the denial reason and the process and deadline for any appeal described in the notice. A complete application received 90 or more days before a scheduled sale may provide an appeal right for certain loan-modification denials, but the timing and other conditions must be checked against your case. An appeal is not guaranteed to produce an offer or stop a sale.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If no option is offered

Request a written explanation of what was reviewed, what information was considered missing or ineligible, and whether another application is permitted if your circumstances change. If the servicer identifies a correction that could change the result, send it promptly and keep proof of delivery.

What to do when the servicer says it has no record

Disputed receipt dates can affect the 37-day and 90-day calculations. Respond with your transmission evidence: portal confirmation, fax report, postal tracking, email header if the servicer authorized email, and a copy of the exact package. Ask the servicer to research its imaging or intake system and confirm the date received in writing.

If the servicer repeatedly gives conflicting completeness information, send a concise chronology listing each submission, the contents, the response and the outstanding issue. Keep making required payments if you can, but do not assume that a review changes the amount due; ask the servicer in writing what payment is required while the review is pending.

Recordkeeping that protects your timeline

  • Maintain a submission index with the date, channel, file names, page count and tracking or confirmation number.
  • Save the original files and the final signed versions. Do not overwrite a document after sending it.
  • Keep envelopes, delivery scans, fax reports, portal screenshots and call-reference numbers.
  • Record the name or identification number of each representative and the department reached.
  • Store foreclosure notices in date order and highlight every sale date and response deadline.
  • Back up the file somewhere separate from the computer or phone used to submit it.

Common mistakes that delay a review

  • Asking only for “help.” Use the terms “loss mitigation review” and “all available options” so the request is routed and understood correctly.
  • Sending documents without a checklist. An incomplete package can delay the point at which the servicer treats the application as complete.
  • Using an unverified address. A payment address, a general customer-service email or a third-party contact may not count as the designated intake channel.
  • Relying on a phone promise. Obtain written confirmation of receipt, completeness, missing items and deadlines.
  • Waiting for a perfect package. Send the request and available information promptly, then respond to the servicer’s itemized requests.
  • Assuming the 37-day rule guarantees review. The rule has conditions, and a submission close to sale may fall outside the specific review requirement.
  • Stopping payments or ignoring notices. A pending review does not itself change payment obligations or guarantee that foreclosure activity will stop.
  • Accepting a verbal denial. Ask for the written decision, the basis stated by the servicer and any appeal instructions.

When to obtain legal or housing-counseling help

Get individualized assistance promptly if a sale is scheduled, a foreclosure lawsuit has been filed, the servicer disputes your submission date, you are considering bankruptcy, ownership or successor-in-interest status is complicated, or the loan has unusual investor requirements. A HUD-approved housing counselor may help you organize the application and understand available paths; a foreclosure attorney can explain state procedure, court deadlines and defenses. Neither type of assistance guarantees approval or postponement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bring your complete record: the note and mortgage if available, monthly statements, notices, the application package, delivery proof, completeness letters, decision letters and your payment history. Tell the counselor or attorney the exact sale date rather than only saying that foreclosure is “pending.”

A ready-to-send request

Use the following as a starting point, then insert your own facts and follow the servicer’s required format:

Subject: Request for complete loss mitigation review — Loan [number], [property address]

I am requesting a loss mitigation review of my mortgage loan for all options available to me. Please send me the current application checklist and tell me how to submit documents securely.

Please confirm in writing:
1. The date you receive this request and any attached application materials;
2. Whether my application is complete;
3. If incomplete, every item still needed and the deadline to provide it;
4. The date of any scheduled foreclosure sale; and
5. The contact information for the person or team handling my review.

I will retain copies of this request and all supporting records. Please use the following contact information for written responses:
[borrower name]
[mailing address]
[telephone]
[email, only if the servicer authorizes email]

Sincerely,
[borrower name]
[date]

Know the limits of the request

A loss mitigation request starts a process; it does not decide the result. Eligibility is determined under the requirements set by the loan owner or assignee and the facts in your application. The servicer’s duties are generally to receive, assess completeness, seek needed information with reasonable diligence, evaluate a complete application when the rule requires it, and send the required written communication.

Because foreclosure protections depend on receipt dates, completeness, the first notice or filing, the scheduled sale and other conditions, verify those facts rather than relying on a general statement that a review is “in progress.” Continue to meet every stated deadline, preserve proof of every delivery and seek case-specific help when a legal deadline is close.
