There is no single application that waives every income-tax penalty in India. The right route depends on the penalty provision, the law applicable to the order, your payment and appeal status, and whether you qualify for a specific scheme. Section 270AA is tied to penalties under section 270A; Form 34BC is for eligible applicants seeking relief through the Dispute Resolution Committee (DRC). Section 273A requires separate verification of the current rules and procedure.
Before applying, identify the order you want relief from, the date you received it, the demand deadline, and any appeal already filed. These details can affect eligibility and timing. A waiver or immunity is not automatic simply because an application has been submitted, and a route that applies to one penalty may not apply to another.

First identify the penalty and the law that applies
Read the penalty order and the related assessment or reassessment order before filing anything. Note the provision under which the penalty was imposed, the tax or assessment period, the date you received each order, the demand amount and payment deadline, and whether you or the department have initiated an appeal or other proceeding. These details determine whether a route is available and which deadline or form could apply.

A request for penalty immunity does not, by itself, cancel the tax or interest assessed, change the demand-notice payment date, extend an appeal period, or suspend collection. The particular law and any order or direction in your case control those consequences. Do not assume that a waiver application is a substitute for challenging the assessment or penalty on its merits.

The Income Tax Department says forms under the Income Tax Act, 2025 are available from 1 April 2026, while forms under the Income-tax Act, 1961 remain available for applicable assessment-year matters. Do not choose a form solely because it is newer: match the order and relevant tax period to the governing framework, then check the portal’s current instructions. The order date alone may not answer which Act applies; consider the assessment year and any transition provisions stated for the matter. Income Tax Department e-filing portal
Make a short case file
Keep copies of the penalty order, the underlying assessment or reassessment order, the demand notice, proof of when the orders were received, payment receipts and any appeal filing or withdrawal records. These documents help establish the applicable provision, payment status and time limit. They are practical records to assemble, not a substitute for the specific form or supporting material required under the route you use.
A useful first-page summary for your own file can list: the section cited in the penalty order; the assessment or tax period; each order’s date and receipt date; the demand notice’s payment deadline; the amount paid and payment date; whether an appeal has been filed; and any communication about prosecution proceedings. Keep the original notices and acknowledgements, not only handwritten summaries. If you cannot establish when an order was received, do not guess at a deadline—check the portal record and available service documentation, and obtain advice promptly if the date affects eligibility.
Before sending documents, check the form or official instructions for what must actually be attached or declared. Do not submit unsupported explanations, omit a filed appeal, or describe unpaid amounts as paid. The Form 34BC process is described by the department as a judicial proceeding for certain legal purposes, reinforcing the need for complete and accurate information.
Which penalty-relief route might fit?
| Route | What it concerns | Key qualification | What to verify |
|---|---|---|---|
| Section 270AA | Immunity from or waiver of a penalty under section 270A, and immunity from specified prosecution proceedings, under the amendment text described in the Finance Bill 2026. | Payment, no-appeal and timing conditions apply; the route is not a general waiver for other penalty provisions. | Whether the Finance Bill text was enacted in the relevant form, the applicable transition rules, prescribed form and the taxpayer’s order and receipt dates. |
| DRC, using Form 34BC | Relief under the notified DRC scheme, which the department describes as including penalty waiver or reduction and prosecution immunity. | The applicant must meet the scheme’s definition of a “Specified Person” and its other conditions. | Applicable Act, scheme rules, qualifying order, exclusions, current form instructions and eligibility. |
| Section 273A | A separate statutory provision sometimes associated with discretionary penalty relief. | Current eligibility and procedure are not established by the official material cited here. | The current provision, rules, competent authority, limitation period and filing route before relying on it. |
Compare the routes on five questions: which penalty provision and Act govern; whether you fall within the eligible taxpayer category; what tax, interest or additional amount must be paid; whether an appeal has been filed and what deadline applies; and which authority and form handle the request. Section 270AA is a tightly conditioned route linked to section 270A. Form 34BC is connected to the DRC’s specified-person scheme. Section 273A needs its own current statutory and procedural check. None should be treated as a fallback that automatically becomes available if another route fails.

The routes are not interchangeable. A request under one provision does not automatically extend a deadline, suspend a demand, replace an appeal, or qualify you for relief under another provision. If more than one route seems potentially relevant, verify their compatibility and consequences before filing rather than submitting overlapping applications on assumptions.
Section 270AA: check the conditions before relying on the Finance Bill text
The Income Tax Department’s Finance Bill 2026 text describes substituting subsections (1) to (3) of section 270AA, with the amendment stated to be effective from 1 March 2026. It sets out an application to the Assessing Officer for immunity from imposition or waiver of a section 270A penalty and immunity from proceedings under sections 276C or 276CC. Because the cited document is Finance Bill text, not proof in itself of the final enacted wording, confirm the enacted Act, rules and prescribed form before acting on it. The bill is a primary government document, but the version ultimately enacted and applicable to a particular order must be checked. Finance Bill 2026, section 270AA amendment text
Conditions described in the Bill
- Pay the tax and interest payable under the assessment or reassessment order within the time specified in the demand notice.
- If the specified circumstances under section 270A(9) apply, pay additional income tax equal to 100% of the tax payable on the under-reported income within the demand-notice period, in lieu of the penalty.
- Do not have filed an appeal against the relevant order.
- Apply in the prescribed form and manner within one month from the end of the month in which the relevant order is received.
- The quoted text excludes relief where proceedings under Chapter XXII have been initiated.
The additional tax condition is not stated as applying to every applicant; the Bill text ties it to the specified circumstances under section 270A(9). Do not decide that it applies—or does not apply—without checking the facts and the operative statutory wording. Likewise, the no-appeal condition refers to the relevant order; establish exactly which order the provision covers before drawing a conclusion from an appeal concerning another proceeding.
For example, if the relevant order were received on 12 July, the period described in the Bill would run from the end of July, not from 12 July. That illustration explains how the wording counts the month; it does not establish that the Bill’s terms are enacted or determine any particular taxpayer’s deadline. The quoted Bill language says “within one month from the end of the month” in which the order was received. Do not substitute a different date-counting method or rely on the example without checking the current law and rules for your case.
How to proceed if the section appears relevant
- Confirm the governing law and order. Check that the penalty is under section 270A and identify the assessment or reassessment order connected with it. A penalty under another provision is not brought within section 270AA merely because it is an income-tax penalty.
- Check payment and appeal status. Compare payments with the demand notice and establish whether an appeal has been filed. Do not assume that paying a demand preserves an appeal right or satisfies every condition for immunity. Keep receipts that show amounts and dates.
- Verify the operative provision and time limit. Check the final enacted Act, relevant rules, transition provisions and the order’s receipt date. The Finance Bill states the application period as one month from the end of the month of receipt; verify that this governs your case.
- Check for the stated exclusion. The quoted text says immunity or waiver is not granted where proceedings under Chapter XXII have been initiated. Confirm whether that exclusion applies to your circumstances; do not assume that an application will stop or undo such proceedings.
- Locate the current prescribed form and instructions. Sign in to the Income Tax Department e-filing account and check the applicable statutory forms or proceeding instructions. The cited official material does not establish a specific current menu path for a section 270AA application, so do not rely on a guessed portal route.
- Submit through the confirmed channel and keep proof. Follow the current form’s verification and submission directions, retain the acknowledgement and copies of the documents submitted, and monitor the account for communications or orders.
The Bill text says the Assessing Officer is to grant relief after the conditions are fulfilled and the applicable appeal-filing period expires. That description should not be treated as a guarantee of relief in an individual case: the operative law, facts, procedure and any disqualifying proceedings must be checked. A filing acknowledgement establishes that a submission was received; it does not itself establish that immunity has been granted.

Form 34BC and the Dispute Resolution Committee
Form 34BC is associated with the DRC, a separate route for a taxpayer who qualifies as a “Specified Person” under the applicable scheme. The Income Tax Department says an eligible person may approach the DRC to seek prosecution immunity and penalty waiver or reduction after payment of taxes, subject to the notified scheme’s conditions. The department also describes the DRC process as a judicial proceeding for certain legal purposes, so the application and supporting information should be accurate. Eligibility turns on the specified-person definition, the qualifying order and the terms of the scheme. In addition, the department’s summary of the purpose—penalty waiver or reduction and prosecution immunity after tax payment—does not mean every applicant receives the same relief or that tax payment alone guarantees acceptance.
The department’s appeals and revisions help page says section 379 of the 2025 Act substantially reenacts section 245MA of the 1961 Act, with eligibility criteria and powers materially similar but renumbering and drafting changes. The help page discusses monetary thresholds, but those figures should not be used as a personal eligibility test without checking the operative Act, scheme rules, exclusions and current form instructions. A threshold summary on a help page is not a substitute for reading the rule that applies to the particular order and framework. Income Tax Department appeals and revisions help
Steps for a potential DRC applicant
- Establish eligibility first. Check the “Specified Person” definition and the qualifying order and scheme conditions under the Act that applies to your case.
- Read the current Form 34BC instructions. Confirm that the form is available for the relevant framework and that the DRC route applies to the penalty and order in question.
- Prepare a complete, truthful application. Use the form’s instructions for declarations and documents. Keep the order, demand and payment records available to support the details provided.
- Follow the specified submission and response process. Retain the filing acknowledgement and respond to requests through the channel and within the time stated in the current instructions or communication.
The cited department pages establish the route’s general purpose, but they do not establish every applicant’s eligibility or the complete current filing procedure. Confirm those details before submitting. If your eligibility appears to depend on a threshold, verify the relevant amounts, measurement date, exclusions and scheme definition in the applicable official text rather than relying on a shorthand summary.
What about section 273A?
Do not assume that section 273A follows the section 270AA deadline or Form 34BC procedure. The official material cited here does not establish section 273A’s current full eligibility test, application form, competent authority, limitation period or portal route. Before making a request under that provision, check the current statutory text and rules and any applicable jurisdictional directions, or ask a qualified Indian tax professional to review the order and available route.

This distinction matters because a familiar section number is not enough to establish the practical steps. Until the applicable primary material has been checked, do not rely on a guessed form number, online workflow, deadline or decision-maker, and do not combine section 273A with the conditions described for section 270AA.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Will paying the demand stop you from appealing?
Payment and appeal status are separate issues, and the effect depends on the provision and facts. In the section 270AA amendment text described above, having filed an appeal against the relevant order is a disqualifying condition for the application. That is not a universal rule for every penalty or every remedy. Before paying, appealing, or applying for immunity, check the deadlines and consequences for the particular order; do not let a waiver inquiry cause you to miss an appeal deadline.
In particular, do not infer from the section 270AA condition that paying automatically waives every right to appeal, or that an appeal can be filed without affecting an application under that route. The text described here makes appeal status relevant to section 270AA eligibility, so get the sequence and consequences checked before taking either step. The DRC has a distinct scheme and the material here does not establish that its rules mirror section 270AA’s no-appeal condition. Verify the rules for the route you actually plan to use.
Common mistakes to avoid
- Choosing a route by the word “waiver.” First identify the exact penalty section. A section 270AA application is not a universal waiver, while Form 34BC is limited to the DRC scheme’s eligible applicants.
- Using the wrong Act or form. The department identifies 2025 Act forms available from 1 April 2026 and continued availability of 1961 Act forms for applicable assessment-year matters. Check the governing framework rather than selecting the newest visible form.
- Counting from the wrong date. The Finance Bill text describes a period measured from the end of the month in which the relevant order is received. Keep evidence of receipt and verify the applicable enacted provision before calculating a deadline.
- Assuming an application pauses other deadlines. The materials described here do not say that filing a waiver request automatically extends an appeal period or suspends payment obligations.
- Assuming payment alone settles eligibility. Section 270AA lists multiple conditions, including appeal status and timing; the DRC route has its own specified-person and scheme requirements.
- Relying on an unverified portal path or form number. Use current official instructions for the applicable proceeding. A plausible menu label is not evidence that it is the right filing route.
When a professional review is useful
A qualified Indian chartered accountant or tax adviser can help where the penalty provision is unclear, the order may fall under a different Act or transition rule, the deadline is close or missed, an appeal has already been filed, or the DRC’s eligibility rules are difficult to apply. Bring the orders, demand notice, receipt dates, payment proof and appeal records so the adviser can assess the actual documents. Professional help is optional; the filing channel and instructions should come from the Income Tax Department for the applicable route.

It is especially sensible to seek a prompt review where the penalty order, assessment order and demand notice have different dates, the payment condition is uncertain, you have received a prosecution-related communication, or the applicable Act is unclear. Ask the adviser to identify the precise section, governing framework, relevant deadline, payment condition and appeal consequence—not merely to recommend a generic “waiver application.”

Frequently Asked Questions
Can I apply for an income-tax penalty waiver for any penalty under section 270AA?
No. Section 270AA is tied to a penalty under section 270A and the conditions in the applicable version of the law. It is not a general waiver route for penalties imposed under other provisions.
What is the section 270AA application deadline?
The Finance Bill 2026 amendment text describes an application within one month from the end of the month in which the relevant order is received. Confirm the enacted wording, applicable rules and receipt date before calculating or relying on a deadline.
Do I need to pay the tax before applying under section 270AA?
The cited Bill text requires payment of tax and interest under the assessment or reassessment order within the demand-notice period. It also describes an additional payment equal to 100% of tax payable on under-reported income in specified section 270A(9) circumstances. Check the operative provision and your facts.

The DRC route associated with Form 34BC is for a taxpayer who meets the applicable scheme’s “Specified Person” definition and other requirements. It is not a general penalty appeal form.
Does filing a waiver request automatically stop an appeal or payment deadline?
No such automatic extension or suspension is established here. The relevant order, statute, scheme and current instructions control. Track appeal and demand deadlines separately while checking the waiver route.
Is section 273A the same as section 270AA?
No. They are separate provisions, and the cited official material does not establish section 273A’s current form, eligibility test, authority, limitation period or portal process. Verify those details independently before filing.
Which Income Tax Act form should I choose after 1 April 2026?
The Income Tax Department says forms under the 2025 Act are available from 1 April 2026, while 1961 Act forms remain available for applicable assessment-year matters. Identify the framework governing your order and tax period, then follow the corresponding current instructions.

The Bottom Line
Start with the penalty order, identify its section and governing Act, and record receipt, payment and appeal dates. Section 270AA, DRC Form 34BC and section 273A are distinct routes with different eligibility and procedural requirements. Verify the operative law and current official form instructions before filing; an application alone does not guarantee relief or protect other deadlines.
