You can challenge many IRS decisions through the IRS Independent Office of Appeals, but the letter you received controls the route, filing address and deadline. Start with its appeal-rights section: send your request to the address specified there, not directly to Appeals. If you need help, a Low Income Taxpayer Clinic (LITC) may provide free or low-cost representation; the Taxpayer Advocate Service (TAS) may help with qualifying hardship or unresolved IRS problems.
How does an IRS administrative appeal work?
The IRS says taxpayers are entitled to a fair and impartial administrative appeal of most IRS decisions, including many penalties. The Independent Office of Appeals is separate from the IRS unit that first reviewed the matter. It considers the taxpayer’s position alongside the IRS’s position and the applicable facts and law; an appeal is a review, not a guarantee that the decision will change. IRS taxpayer-rights guidance also says taxpayers have the right to receive a written response regarding Appeals’ decision.
For many examination matters, you request review in writing. The office that issued the letter considers the disputed issues first. If it cannot resolve them, it may forward the case to Appeals.
What should you do first?
- Read the entire notice and preserve it. Keep the notice and its envelope. Find the appeal-rights paragraph and note the stated due date, mailing address, required form or protest, and any case-specific instructions.
- Identify what you disagree with. List each proposed adjustment, penalty or other issue and the tax period it affects. Gather records that support your position, such as receipts, statements or correspondence relevant to those issues.
- Choose the procedure named in the letter. For an examination appeal, the notice may call for a small case request or a formal written protest. Other matters—including collection actions and rejected offers in compromise—can have different procedures.
- Send the request to the address on the appeal-rights letter. IRS Appeals guidance says to file with the originating office, which reviews the request and may forward unresolved issues. Sending it directly to Appeals can delay the case or prevent it from being considered.
- Keep a copy and proof of filing. Retain the complete submission and documentation showing when and where you sent it. If you need representation, contact an LITC promptly, but do not assume that clinic intake or a request for TAS help changes your notice deadline.
How much time do you have to appeal?
Use the deadline printed in your notice. IRS Appeals says a formal protest is generally due within 30 days from the date of the letter, but that general rule is not a substitute for the specific notice: procedures and time limits vary by appeal type. For example, IRS guidance gives 30 days from the rejection letter for appealing a rejected offer in compromise. Collection matters involving liens, levies, seizures or installment agreements have their own rules; consult the notice and IRS Publication 1660.

If the deadline is near or has passed, contact a qualified tax representative or an LITC as soon as possible and ask about the procedure that applies to your case. Do not rely on a pending clinic application or contact with TAS to preserve an appeal right.
Should you make a small case request or a formal protest?
For certain examination cases, IRS Appeals allows a small case request when the total proposed additional tax and penalties for each tax period is $25,000 or less. The notice may provide Form 12203 or other instructions for making the request. IRS Publication 3498 (revised May 2025) explains that a formal protest is required above that threshold and in certain categories regardless of amount, including partnership and S corporation cases, employee plan cases, and exempt organization cases. Follow the notice because not every type of dispute qualifies for the small case procedure.

What to include in a formal protest
Use the current IRS Publication 5, “Your Appeal Rights and How To Prepare a Protest If You Don’t Agree,” and the notice for the exact requirements, including the declaration language and signature. In general, a written protest should:
- State that you want to appeal the IRS’s proposed action.
- Identify you and provide contact information, and list the tax periods and issues you dispute.
- Explain why you disagree with each proposed change, including the facts and any legal authority supporting your position.
- Include the required declaration under penalties of perjury and the required signature.
What if the notice gives you a court route?
Tax Court and a notice of deficiency
A statutory notice of deficiency proposes additional tax and may allow you to petition the United States Tax Court to dispute the proposed adjustment before paying it. This is a court proceeding, not an extension of the administrative appeal deadline. The petition deadline is specific to the notice; check it immediately and follow the court and notice instructions.

A refund suit
A refund suit is a separate route. IRS guidance says that, generally, a taxpayer may sue in a U.S. District Court or the U.S. Court of Federal Claims after fully paying the tax and having a refund claim denied, or if the claim has gone unacted on for six months. A refund-denial notice has its own limitation period. This process is distinct from an Appeals protest, so verify the applicable requirements and deadlines rather than treating one filing as a substitute for the other.

How do you find an LITC or contact TAS?
Check LITC eligibility and locate a clinic
LITCs are independent of both the IRS and TAS. The IRS and TAS provide a clinic locator, and IRS Publication 4134 lists clinics and language services. Each clinic sets its own intake process and decides whether a person meets its income and other criteria.

For calendar year 2026, TAS lists the following one-person household income ceilings for low-income representation, set at 250% of the federal poverty guidelines:

Ask TAS for help with a qualifying IRS problem
Call TAS at 877-777-4778 or use its contact page to find local help. Explain the hardship, unresolved issue or apparent system failure and the steps you have already taken with the IRS. Keep working from the deadline and filing instructions in your notice while seeking help.
What should you not confuse with an appeal?
Free tax-return preparation and dispute representation solve different problems. VITA and TCE can help eligible taxpayers prepare returns, but they are not substitutes for an LITC or other qualified representative in an IRS controversy. Likewise, contacting TAS is not itself an appeal filing. For your dispute, use the specific procedure and address in the IRS notice.
