If you think Social Security calculated your benefit incorrectly, read the decision notice, identify the precise amount or input you dispute, and request reconsideration using the instructions in that notice. If the calculation may be wrong because your earnings record is inaccurate, ask Social Security to correct the record too. These are related but distinct steps: do not let an earnings-record inquiry cause you to miss the appeal deadline for a benefit decision.

First identify what Social Security decided

Start with the notice that states your benefit amount or explains a change. Find the amount, the date it takes effect, the decision being made, and the appeal instructions. Then pin down what you believe is wrong. A disagreement with a benefit amount is not automatically the same issue as a missing year of earnings, and a notice may involve more than one issue.

Social Security Administration (SSA) Form SSA-561, Request for Reconsideration, lists the amount of a benefit, a recomputation, and revision of an earnings record as examples of initial determinations that can be appealed. That means you can challenge the amount itself; you do not have to frame every dispute as an earnings-record problem.

Separate the possible error types

  • Benefit amount: You disagree with the amount SSA awarded or is paying. Identify the figure in the notice and the part of the decision you believe produces the wrong amount.
  • Recomputation: SSA recalculated a benefit, and you dispute the revised calculation or its inputs.
  • Earnings record: A year of covered earnings is missing, recorded incorrectly, or attributed incorrectly. That may affect the benefit calculation and may require a separate correction request.
  • Another adjustment or deduction: Identify the specific item in the notice rather than describing the problem only as “my benefit is wrong.” The benefit program and the notice determine which rules and filing instructions apply.

Do not assume the stated amount can be checked from the notice alone. Determining whether a calculation is mathematically correct may require the covered earnings record, benefit type, entitlement date, applicable adjustments, and SSA’s underlying computation. If the notice does not explain a figure clearly, ask SSA what calculation or information produced it while preserving any appeal deadline.

Check your earnings record if earnings may be involved

SSA uses earnings to calculate monthly retirement and disability benefits and encourages people to review their yearly earnings record. Check the record in a my Social Security account or request a statement. Compare the years shown with your own employment and wage records, giving particular attention to the year or years that appear connected to the disputed amount.

If an earnings year is missing or wrong, request correction of the earnings record and provide evidence for the period in question. A my Social Security account may allow an online correction request, but SSA says online correction is not available to everyone. If you cannot use that option, follow SSA’s instructions for submitting a correction request.

Keep the two tracks distinct. A request to correct earnings is not a substitute for appealing a benefit determination when you have received a benefit notice with appeal rights. Pursue the record correction if needed, but separately act on the notice within its deadline. SSA identifies earnings correction and appeals as separate procedures, so do not assume one automatically preserves the other.

Know which deadline applies

SSA generally gives claimants 60 days to request the next review after receiving an appealable notice. For its deadline calculation, SSA generally presumes that a notice arrived five days after its date unless you can show that it arrived later. The actual notice’s date, instructions, and any program-specific rule should guide your filing; do not wait until the last day to clarify a deadline.

The earnings-record correction limit is different from an appeal deadline. SSA says earnings ordinarily cannot be corrected after three years, three months, and 15 days from the end of the taxable year in which the wages were paid. Exceptions may apply, but an old earnings year is not automatically correctable: the facts must fit an applicable exception.

Action Usual timing described by SSA Form or route identified by SSA
Reconsider an initial determination Generally 60 days after receipt of the notice Form SSA-561; online services may be available for some requests
Request an administrative law judge hearing Generally 60 days after receipt of the reconsideration decision Online request or Form HA-501
Request Appeals Council review Generally 60 days after receipt of the administrative law judge decision or order Online request or Form HA-520, mailed or faxed as SSA instructs
File a civil action in federal district court Generally 60 days after receipt of notice of the Appeals Council’s adverse decision or denial of review File in the appropriate U.S. district court and follow SSA’s venue and service instructions
Request correction of earnings Ordinarily, within three years, three months, and 15 days after the end of the taxable year in which wages were paid Online request may be available to some people; otherwise follow SSA’s correction instructions

These are general time limits, not a replacement for the instructions on your notice. At each stage, count from receipt as SSA directs. If you believe you are late, explain why and ask SSA to extend the deadline; SSA decides whether to allow an extension. A late filing should not be treated as automatically accepted or automatically rejected.

Request reconsideration of the benefit decision

Reconsideration is generally the first appeal step for an initial determination. Use Form SSA-561 or another filing route SSA permits for your case. The form asks you to identify the claim type and issue and explain why you believe the decision is incorrect. Be direct: name the decision being challenged and describe the specific calculation, earnings year, or other item you want reviewed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Read the notice and locate its appeal instructions. Note the notice date, the decision being challenged, the benefit amount or change at issue, and the filing deadline.
  2. State the issue precisely on the request. For example, distinguish a disputed benefit amount from a request to revise an earnings record. If both are involved, identify each rather than assuming one description covers both.
  3. Explain the alleged error and its basis. Point to the year, amount, or notice item in dispute and state what information or record supports your position. Avoid a bare statement that the calculation is wrong.
  4. Include evidence that matches the issue. Attach copies of relevant records where available, and identify which disputed point each record supports.
  5. Submit through the method SSA specifies and keep a copy. Retain the request, attachments, and any confirmation or other proof of submission. SSA provides filing channels, but there is no single proof-of-submission method that applies to every route.

If the deadline has passed, include the reason you could not file on time and request an extension. If you are uncertain whether an earnings correction will resolve the benefit dispute, preserve the appeal route rather than waiting for the correction process to finish.

Build evidence around the disputed calculation

The most useful evidence is evidence that addresses the particular error. A broad stack of unrelated paperwork can make the issue harder to understand; organize records by year or disputed item and explain what each one shows.

If the earnings record is wrong

SSA identifies Forms W-2 and pay stubs as potentially helpful evidence for earnings corrections. Depending on the discrepancy, relevant records may also include tax returns, employer records, or prior SSA notices. The governing rule asks you to identify the period being questioned and describe or attach available evidence.

  • Identify the calendar or taxable year and the employer or earnings entry in question.
  • Say whether the earnings are missing, incorrect, or attributed to the wrong person.
  • Provide the records you have that relate to that year, such as W-2s or pay stubs, and explain what they establish.
  • If you lack a particular record, describe the discrepancy and provide whatever supporting information is available rather than claiming to have documentation you do not have.

If the benefit amount or recomputation is wrong

Use the notice and the calculation information SSA provides to identify the contested figure or input. If the dispute concerns earnings, connect the benefit appeal to the specific earnings year and pursue the record correction as well. If the issue concerns another stated adjustment or deduction, identify that item and provide records that bear on it. Do not substitute a general belief that the payment “should be higher” for an explanation of what decision or information needs review.

Keep a simple record of what you sent, when you sent it, and how it was submitted. Save copies of the notice, forms, evidence, and any response from SSA. This is practical organization advice, not a claim that SSA requires one particular receipt or filing method.

What happens if reconsideration is unfavorable?

If SSA denies reconsideration and you still disagree, the review process generally continues in sequence. Each request responds to the preceding decision; follow the instructions that accompany it rather than sending the same initial appeal request again.

Administrative law judge hearing

Request a hearing before an administrative law judge (ALJ) if you disagree with the reconsideration decision. SSA identifies an online request and Form HA-501 as routes. For a hearing about a nonmedical amount issue, make the calculation or record error clear and identify evidence supporting your position. The hearing request is a further review of the decision, so carry forward the relevant documents and explain why they matter.

Appeals Council review

If you disagree with the ALJ’s decision or order, you may request Appeals Council review through an online request or Form HA-520, which SSA says may be mailed or faxed as instructed. The Council may deny review, decide the case, or return it to a judge for further review. Read the Council’s notice carefully because its result determines what, if anything, comes next.

Federal district court

After an adverse Appeals Council decision or a denial of review, a claimant may file a civil action in the appropriate U.S. district court. This is court litigation, not another SSA form request. SSA’s court-process information explains venue and service requirements, and filing has a fee. Because court procedure differs from the earlier administrative stages, consider qualified legal help before filing. SSA says claimants may choose an attorney or another qualified person to help with an appeal.

How to correct an older earnings year

The ordinary earnings correction period runs from the end of the taxable year in which the wages were paid. For example, do not calculate the limit simply by counting three years from the date you notice the problem; SSA describes the period as three years, three months, and 15 days from the taxable year’s end. Check the applicable period promptly, especially if the disputed year is approaching or may have passed the ordinary limit.

SSA describes exceptions that can permit changes after the usual limit, including certain tax-return corrections, timely correction requests or benefit applications, errors apparent on the face of SSA’s records, fraud, or wages that were paid but not recorded. These are categories of possible exceptions, not a guarantee that any old earnings entry can be changed. Explain the circumstances and supply supporting records; SSA must determine whether an exception applies.

When SSA makes an initial determination about a non-claim earnings-record discrepancy, internal SSA guidance says it provides a notice with appeal rights. If you disagree with that correction determination, read the notice and use its appeal instructions. This is another reason to retain the correction decision: an earnings record dispute can itself produce a decision with a separate review path.

Common mistakes that can weaken or delay a dispute

  • Waiting for a record correction before appealing the benefit notice. These are separate procedures; protect the benefit appeal deadline while asking SSA to correct earnings when needed.
  • Appealing without naming the issue. Specify whether you dispute the amount, recomputation, earnings record, or another item so SSA can identify what you want reviewed.
  • Sending evidence without explaining it. Tie each document to the year or calculation point it supports.
  • Assuming an old earnings record is always fixable. The ordinary correction limit applies, with exceptions only where the particular facts meet the rules.
  • Using a deadline from a general webpage instead of the notice. Apply the actual notice’s instructions and receipt rules to your case.
  • Discarding records after filing. Keep the notices, requests, evidence, and submission information together so you can respond consistently at later review stages.

A practical filing checklist

  1. Keep the SSA notice and record its date, appeal instructions, and deadline.
  2. Write down the exact issue: benefit amount, recomputation, earnings-record revision, or another determination.
  3. Identify the year, amount, or notice item involved and describe what you believe is wrong.
  4. Check your yearly earnings record if wages may be part of the problem.
  5. Gather relevant evidence, such as W-2s, pay stubs, tax returns, employer records, or prior SSA notices, as applicable.
  6. File at the current stage using the form or route SSA identifies: SSA-561 for reconsideration, HA-501 for an ALJ hearing, or HA-520 for Appeals Council review.
  7. Keep a complete copy of what you submit and any confirmation or other submission record.
  8. If the filing deadline has passed, explain the reason and ask SSA to extend it; do not assume an extension will be granted.

No general guide can determine whether an individual award is wrong without the person’s earnings history, benefit type, entitlement date, applicable adjustments, and the agency’s underlying calculation. Use the notice to define the issue, ask SSA for clarification when needed, and consider an attorney or other qualified representative if the dispute is difficult or reaches court.
