The 10% is not calculated on a demand total that includes interest, penalties or fees. A taxpayer generally has three months from communication of the order to appeal; the Appellate Authority may allow up to one additional month for sufficient cause. A later appeal to the Appellate Tribunal has a separate 20% disputed-tax deposit, in addition to the first-appeal payment.
The exact amount and filing route depend on the order, what is admitted, qualifying payments already made, the applicable cap and any special rule. Treat this as a guide to the ordinary process, not a calculation for an individual case. Check the current legislation, notifications and portal instructions for the relevant appeal date and State or Union Territory.

Which GST appeal stage applies to your order?
Start with the order you want to challenge. A taxpayer aggrieved by an adjudicating authority’s order generally files a first appeal with the Appellate Authority under section 107 of the Central Goods and Services Tax Act (CGST Act). A further appeal from an order under section 107 or 108 may be made to the Appellate Tribunal under section 112.
These are distinct stages, not interchangeable routes. The ordinary first-appeal deposit is based on 10% of the remaining tax in dispute, subject to the applicable statutory cap. At the Tribunal stage, section 112(8) calls for a further 20% of the remaining tax in dispute, in addition to the amount paid under section 107(6). Do not substitute one percentage for the other or assume the Tribunal deposit replaces the first one.

The Central Act is not the only legislation to check. Section 107 operates within the CGST, State GST (SGST) and Union Territory GST (UTGST) frameworks. Confirm the matching State or Union Territory provisions, local notifications, designated authority and filing procedure for the taxpayer’s jurisdiction.
How much is the first-appeal pre-deposit?
Separate the amount arising from the order into what you admit and what you contest. Under section 107(6), the admitted portion of tax, interest, fine, fee and penalty must be paid in full. The percentage deposit is calculated on the remaining amount of tax in dispute—not automatically on the total demand printed in the order.
For an ordinary first appeal, use this framework:
Required first-appeal pre-deposit = the lower of (10% × remaining disputed tax) or the applicable statutory cap.
This percentage deposit is separate from payment of the admitted amounts. Section 107(6) sets the payment condition for filing an appeal: the appellant pays the admitted amount and the prescribed share of remaining disputed tax, subject to the cap in force. Check the applicable amended text for the specific appeal rather than relying on an older version or assuming one cap applies universally. Do not infer a cap from an unrelated case or a general online calculator.
Calculate it in an orderly way
- Read the operative order. Identify the amounts confirmed and classify each component as tax, interest, fine, fee or penalty. Use the order and its demand details rather than relying only on an aggregate balance displayed elsewhere.
- Mark the admitted portion. Decide which amounts arising from the order are not being challenged. The admitted tax, interest, fine, fee and penalty are not part of the 10% calculation; they are payable in full under the ordinary section 107(6) rule.
- Isolate disputed tax. Determine the remaining tax amount contested in the appeal. Keep disputed interest, penalty and fee separate: the statutory 10% base is the remaining amount of tax in dispute, not all disputed components combined.
- Apply the percentage and cap. Calculate 10% of the remaining disputed tax, then compare it with the cap in the law applicable to the appeal. The required percentage deposit is the lesser amount.
- Check prior payments and the payment ledger. Verify whether any amount already paid legally counts toward the amount required for the appeal and whether it is correctly reflected against the relevant demand. Do not subtract a payment merely because it appears in a ledger; confirm its legal treatment and allocation.
- Reconcile the filing amount. Keep separate figures for admitted dues, the statutory pre-deposit, and any other balance. Check the order, payment records and current filing instructions before submitting the appeal.
Example: disputed tax is not the whole demand
Suppose the remaining disputed tax is ₹1,00,000 and the applicable statutory cap does not reduce the result. Ten percent is ₹10,000. If the same order also lists interest and penalty, those amounts do not become part of the 10% base merely because they appear in the aggregate demand. Any admitted amounts remain a separate full-payment item. This illustration does not determine the amount due under a particular order; the order, qualifying prior payments and applicable cap still need to be checked.
The key distinction is between the amount that is admitted and the tax amount that remains disputed. For example, an appellant should not treat the entire demand balance as the percentage base merely because tax, interest and penalty appear together in a summary. Nor should a payment be counted twice: first as payment of an admitted amount and again as credit against the disputed-tax pre-deposit. Reconcile each payment to the demand and to the legal requirement it satisfies.
What changes at the Tribunal stage?
Section 112(8) sets a different calculation for an appeal to the Appellate Tribunal. The appellant must pay admitted tax, interest, fine, fee and penalty in full, plus 20% of the remaining amount of tax in dispute. That 20% is in addition to the amount paid under section 107(6), so the Tribunal-stage requirement is cumulative.

As with the first appeal, the 20% base is the remaining disputed tax, not an undifferentiated total containing interest, penalties or fees. Determine which order is being challenged and reconcile prior payments before calculating. On payment of the amount required under section 112(8), recovery of the balance is deemed stayed until disposal of the appeal.
The general section 112 period is three months from communication of the order appealed against. Admission may be allowed within a further three months where sufficient cause is shown. This is a separate limitation rule from the first-appeal period; do not carry the first-stage extension period over to a Tribunal appeal.
In practical terms, a Tribunal appeal should not be calculated as though it were a fresh first appeal with a 20% rate replacing the earlier 10%. Check the payment made under section 107(6), the remaining disputed tax at the Tribunal stage, the admitted components and the section 112(8) requirement. Confirm the exact treatment against the operative order and payment record.
What is the time limit for filing a first GST appeal?
Under section 107, a taxpayer ordinarily has three months from the date the order is communicated to file the appeal. The Appellate Authority may allow a further period of no more than one month if satisfied that sufficient cause prevented filing within the ordinary period. That extra month is a limited discretionary extension, not an automatic grace period.
Because the deadline runs from communication, preserve evidence showing when and how the order was communicated. Record the date used for the limitation calculation and seek case-specific advice promptly if the deadline is close, has passed, or the communication date is disputed. The applicable State or Union Territory enactment and notifications should also be checked.
Do not assume that starting to prepare an appeal, making a payment or receiving a provisional acknowledgement by itself resolves a limitation issue. The rules describe the appeal as filed only when the final acknowledgement with appeal number is issued. Plan time for completing the required document steps and verify current filing instructions well before the deadline.
How do you file FORM GST APL-01?
The CBIC appeal rules identify FORM GST APL-01 for an appeal to the Appellate Authority. They describe electronic filing, a provisional acknowledgement, submission of a certified copy of the order and supporting documents within seven days, and a final acknowledgement in FORM GST APL-02. Under the rules, the appeal is treated as filed only when the final acknowledgement bearing the appeal number is issued.

- Assemble the case record. Keep the challenged order, relevant demand details, grounds of appeal, supporting documents and payment evidence together. Verify the current portal’s document and format requirements; these can be affected by applicable notifications and instructions.
- Complete the first-appeal form. File FORM GST APL-01 using the applicable electronic process and enter the appeal and payment details consistently with the order and ledger.
- Save the provisional acknowledgement. It is evidence of the initial submission, but it is not the final acknowledgement described in the appeal rules.
- Submit the certified order copy and supporting documents within seven days as the rules require. Follow the instructions applicable to the filing date and jurisdiction rather than assuming one document-handling method applies in every situation.
- Confirm FORM GST APL-02 and the appeal number. Retain the final acknowledgement, the filing record and proof of payment. The rules state that the appeal is treated as filed only when this final acknowledgement is issued.
The appeal rules also describe FORM GST APL-04 as a summary issued with the Appellate Authority’s order that indicates the final amount of demand confirmed. Use the actual order and summary when assessing any later step; do not assume that the original demand total remains unchanged after appeal.
The distinction between provisional and final acknowledgement matters. Keep both records, but do not treat the provisional acknowledgement as conclusive proof that the appeal has been filed for the rules’ purposes. Save evidence that the certified copy and supporting material were submitted within the required seven-day process, along with the final APL-02 and appeal number.
How is a Tribunal appeal filed?
The appeal rules identify FORM GST APL-05 for an appeal to the Appellate Tribunal. They describe a seven-day process for accompanying hard copies and supporting documents, followed by a final acknowledgement in FORM GST APL-02. The rules and procedural requirements should be read alongside current instructions for the relevant bench and filing date.
Tribunal operation and filing arrangements may not be uniform or settled for every location and date. Before relying on a particular bench’s process, verify which procedures are operational, the documents required, and how the appeal and payment must be submitted. The rules’ form reference alone does not establish that every bench follows an identical practical workflow.
As with the first appeal, preserve the order being challenged, grounds, supporting documents, payment evidence, submission records and final acknowledgement. Confirm that the Tribunal-stage filing form corresponds to the order and appeal route, and check the applicable limitation period separately from the first appeal.

What if the order involves a penalty-only demand?
A penalty-only case requires special care because the ordinary deposit formula is expressed by reference to disputed tax. A press release for the GST Council’s 55th meeting recommended a 10% pre-deposit for appeals involving only penalty and no tax, for both Appellate Authority and Tribunal appeals, and described proposed amendments as effective from 1 April 2025.
A Council recommendation or press release is not, by itself, the operative amending statute or commencement notification. The cited Council announcement does not establish whether the proposal was enacted and commenced for every relevant filing date. Before applying a 10% penalty-only rate, verify the enacted provision and commencement status that govern the appeal. Do not treat the recommendation date as proof that the rate is in force.

This is a distinct question from the ordinary calculation on disputed tax. Check whether the appeal is genuinely penalty-only, whether any tax is involved, and which statutory text and commencement notification apply on the filing date. If the order includes multiple components or the classification is uncertain, do not use the penalty-only treatment without case-specific verification.

CBIC Circular 238/32/2024-GST addresses an order in FORM GST SPL-07 rejecting an application for waiver of interest or penalty under section 128A. The circular says the rejection order is appealable under section 107. The issue in that appeal is whether the waiver applies; it is not a fresh appeal on the merits of the original notice, statement or order.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
The circular also explains that amounts already paid toward tax dues may meet some or all of the usual pre-deposit, while any shortfall may have to be paid. Reconcile payments against the applicable requirement and identify the issue actually open for appeal. Do not assume that challenging the waiver rejection automatically reopens the underlying tax merits.
For this route, distinguish the question of eligibility for waiver from an attempt to dispute the original tax determination. Review the SPL-07 rejection, the original proceedings, payment history and the circular’s guidance together. Work out whether prior tax-dues payments satisfy the required amount or leave a shortfall, rather than assuming either that all payments qualify or that none do.
What should you verify before submitting?
- Appeal stage and order: confirm whether section 107 or section 112 applies and identify the order and authority being challenged.
- Limitation date: establish the communication date and preserve the evidence supporting it; do not rely on an assumed automatic extension.
- Component-by-component figures: distinguish tax, interest, fine, fee and penalty, and separate admitted from disputed amounts.
- Pre-deposit base: calculate the percentage only on remaining disputed tax under the ordinary rules, then apply the cap applicable to that appeal.
- Prior payments: confirm whether and how they count toward the amount required, and ensure the ledger reflects them correctly.
- Special rules: check for a penalty-only case, a section 128A waiver-rejection appeal or another applicable statutory provision before using the ordinary formula.
- Jurisdiction and procedure: review matching SGST or UTGST provisions, local notifications, current portal requirements and, for a Tribunal appeal, the relevant bench’s operational process.
- Proof of filing: retain payment evidence, document submissions, acknowledgements and the final appeal number.
The amount payable cannot reliably be calculated from a demand total alone. For a live case, compare the operative order, the admitted and disputed components, qualifying payments, the current statutory text and the instructions for the relevant jurisdiction. A suitably qualified Indian tax practitioner or advocate can assess case-specific questions, especially where limitation, the cap, special provisions or the appeal’s scope is uncertain.
Frequently Asked Questions
How much pre-deposit is required for a first GST appeal?
For an ordinary first appeal under section 107, pay the admitted amount of tax, interest, fine, fee and penalty in full, plus 10% of the remaining tax in dispute, subject to the applicable statutory cap. The 10% is not applied to interest, penalty or fees simply because they appear in the same demand total.
Is GST appeal pre-deposit calculated on tax or the total demand?
The ordinary percentage base is the remaining amount of tax in dispute arising from the order. Separate disputed interest, penalty and fees from that base, and account for admitted amounts separately because those must be paid in full under section 107(6). Check any special statutory provision that may apply.

What is the time limit for filing a GST demand appeal?
A first appeal under section 107 is generally due within three months from communication of the order. The Appellate Authority may allow up to one further month if satisfied that sufficient cause prevented timely filing; this is discretionary, not an automatic extension. A Tribunal appeal generally has a three-month period and may be admitted within a further three months for sufficient cause.
How do I file GST APL-01, and when is the appeal treated as filed?
The appeal rules identify FORM GST APL-01 for a first appeal to the Appellate Authority. They describe electronic filing, a provisional acknowledgement, submission of the certified order copy and supporting documents within seven days, and a final FORM GST APL-02 acknowledgement. The rules say the appeal is treated as filed only when the final acknowledgement with the appeal number issues. Check current portal and jurisdiction-specific instructions.
Does the Tribunal appeal deposit replace the first-appeal deposit?
No. Under section 112(8), the Tribunal-stage amount includes 20% of the remaining tax in dispute in addition to the amount paid under section 107(6), as well as full payment of admitted components. On payment of the amount required, recovery of the balance is deemed stayed until disposal.

CBIC Circular 238/32/2024-GST says an order in FORM GST SPL-07 rejecting a section 128A waiver application is appealable under section 107. The appeal concerns whether the waiver applies, not the merits of the original notice, statement or order. The Bottom Line
For an ordinary section 107 first appeal, pay admitted components in full and calculate 10% on the remaining disputed tax, subject to the applicable cap. A Tribunal appeal has a separate cumulative 20% disputed-tax deposit. Confirm the order, payment history, limitation date, current law and filing procedure before relying on a live-case calculation.
