To challenge a GST assessment or demand order in India, file FORM GST APL-01 before the appropriate Appellate Authority, normally within three months from the date the order was communicated. You must pay the amount you admit as payable and the statutory first-appeal pre-deposit before filing. If the order copy is not already on the GST Portal, submit a certified or self-certified copy and supporting documents within seven days. The appeal becomes formally identifiable when the portal issues final FORM GST APL-02 with an appeal number. You can then monitor it through Services > User Services > My Applications.
This is the general first-appeal workflow for Indian GST. The correct authority, appeal category, limitation date, payment amount and grounds depend on the actual order, the issuing officer and the applicable version of the law. Treat the portal status as a progress marker, not as a substitute for reading every notice and order.

1. Confirm that a first appeal is the correct remedy
Start with the document itself, not with the portal menu. Record the order number, order date, issuing authority, tax period, sections cited, amounts of tax, interest and penalty, and the date and method by which the order was communicated. An “assessment order” may appear in the portal’s demand-order workflow, but the legal route can differ by order type and stage.
The GST Portal’s appeal FAQ identifies demand-related categories that can use the APL-01 workflow, including orders under sections 62, 63 and 64; listed orders under sections 73, 74, 74A and 76; specified penalty orders; and certain rectification-related orders. That list is a portal workflow description, not a conclusion that every document with a similar label is appealable in the same way. Check the actual section and order before selecting a category.
#1 Best Overall
- Identify the decision-maker: confirm which officer passed the order and which Appellate Authority has jurisdiction.
- Check the order’s legal section: the section affects the available category, amounts and arguments.
- Verify communication: limitation generally runs from communication, not simply from the date printed on the order.
- Preserve the complete record: download the order, demand summary, notices, replies, hearing records, payment challans and relevant returns or invoices.
If the order is not one of the categories supported by the first-appeal workflow, filing an APL-01 without checking the remedy can create a procedural problem. A GST practitioner, chartered accountant or tax lawyer can assess the route when the order involves multiple periods, disputed jurisdiction, a prior appeal or an unusual statutory provision.
2. Calculate the filing deadline from communication
Normal period: three months
Section 107(1) of the Central Goods and Services Tax Act gives an aggrieved person three months from the date of communication of the decision or order to present the appeal. The CBIC text used for this guide is identified as updated through 1 October 2025. Use the communication date supported by the record: for example, the date shown in a valid electronic delivery record or another legally recognized method of service. Do not assume that a portal display date automatically resolves a dispute about when service occurred.
Possible condonation: up to one additional month
Under section 107(4), the Appellate Authority may allow a further period of up to one month if it is satisfied that sufficient cause prevented timely presentation. This is a discretionary condonation period, not an automatic extension. If you are late, submit a clear explanation supported by dates and evidence, and do not treat the extra month as a routine grace period.
| Requirement | Period or rate | What it means |
|---|---|---|
| First-appeal presentation | Three months from communication | The ordinary section 107(1) limitation period. |
| Possible delay condonation | Up to one further month | Available only when the Appellate Authority accepts sufficient cause under section 107(4). |
| Order copy and supporting documents | Seven days | Submit the required certified or self-certified copy and supporting documents within the portal/rules period. |
Build in time for payment, document scanning, signing, portal errors and the seven-day document rule. Keep screenshots, acknowledgment numbers and payment evidence. If the communication date itself is disputed, obtain case-specific advice before relying on a limitation calculation.
3. Work out what must be paid before filing
Payment is a filing condition. Section 107(6) requires two components in the usual tax-and-demand case:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- Payment of the full amount admitted from the impugned order.
- A first-appeal pre-deposit equal to 10% of the remaining disputed tax, subject to the statutory cap in the current text of the Act.
There is a separate rule for an order demanding penalty without tax: the section 107(6) proviso requires payment of 10% of the penalty to appeal. Do not apply the tax formula to a penalty-only order or assume that interest and penalty are treated identically to disputed tax. Reconcile the order, the current statutory text and the live portal before paying.
Because the cap and the order’s components affect the amount, do not calculate an individual taxpayer’s liability from a headline percentage alone. Separate admitted tax, disputed tax, interest and penalty in a working sheet, then verify the figures against the demand and payment screens. Retain the challan, transaction reference and ledger entries.

Section 107(7) provides that, once the required payment is made, recovery proceedings for the balance amount are deemed stayed while the appeal is pending. The GST Portal FAQ also describes the portal flagging the balance disputed amount as non-recoverable when the appeal is admitted. The statutory stay and the portal label are related but different: the statute creates the legal effect, while the portal displays an administrative status. Continue monitoring notices and comply with any directions issued in the appeal.
4. Assemble the appeal record
APL-01 is not just a payment receipt. It states the grounds of appeal and includes a verification that must be signed in the prescribed manner. Organize the filing so the Appellate Authority can match each ground to the order and evidence.
Core documents
- Copy of the impugned assessment, demand, penalty or rectification order.
- Relevant show-cause notices, replies, personal-hearing submissions and hearing records.
- Return extracts, invoices, contracts, ledgers, reconciliations and other documents that directly support a ground.
- Proof of payment of admitted amounts and the section 107(6) pre-deposit.
- Evidence of the communication date when limitation could be questioned.
- Authority documents or authorization required for the person signing or representing the appellant.
Write grounds that can be tested against the record
Each ground should identify the finding being challenged, explain why it is wrong and point to the supporting document or legal provision. Keep factual objections separate from legal objections. For example, distinguish an incorrect turnover figure from an argument that the officer applied the wrong statutory section. State the relief sought—such as deletion or reduction of a demand, correction of a calculation or reconsideration of a specific finding—without asking the Authority to decide issues that are outside the order.
Rank #3
Do not copy a generic list of grounds. The appeal should address the exact reasoning, evidence and amounts in the order. If a document was unavailable during adjudication, explain its relevance and why it is being produced with the appeal. A professional adviser can help test limitation, jurisdiction, classification, valuation, input-tax-credit and natural-justice issues against the record, but professional representation is not automatically mandatory for every filing.

5. File FORM GST APL-01 on the GST Portal
For a demand order, the GST Portal FAQ gives this navigation path:
- Sign in to the GST Portal using the taxpayer credentials.
- Open Services > User Services > My Applications.
- Choose the application type “Appeal to Appellate Authority”.
- Select New Application.
- Choose the order category as Demand Order when that matches the document.
- Enter the order details, disputed amounts, grounds and relief requested as prompted.
- Upload the order and supporting documents in the prescribed formats and sizes shown by the live portal.
- Complete the verification and sign using the permitted method for the entity and filing context.
- Submit the application and save every reference, acknowledgment and payment record.
The rules require FORM GST APL-01 with the relevant documents. The grounds and verification must be signed in the prescribed manner. The FAQ says the applicant may use a digital signature certificate (DSC) or electronic verification code (EVC), with DSC mandatory for companies and limited liability partnerships. Portal requirements can change, so confirm the current prompt shown for your entity before submission.
6. Submit the order copy within seven days
The seven-day rule is one of the easiest ways to lose the date you intended to preserve. Where the order is not uploaded on the portal, the FAQ says the appellant must submit a self-certified copy within seven days of filing APL-01. The CBIC appeal rules describe submission of the certified copy and supporting documents within seven days.
The timing has two consequences:
- If the copy is submitted within seven days, the provisional acknowledgment date is treated as the filing date.
- If the copy is submitted after seven days, the document-submission date is treated as the filing date for the rule described in the FAQ and appeal rules.
The FAQ also states that the appeal is considered filed when final FORM GST APL-02 with an appeal number is issued. These are different milestones: an initial or provisional acknowledgment records the submission, while APL-02 confirms the appeal number and final filing event described by the portal guidance. Download the final APL-02 and keep it with the order and payment proof.

If the portal does not accept a document, do not wait until the seventh day to investigate. Check the file type, size, legibility and signature requirements, and preserve the error message and attempted-submission time. If the order was already uploaded but the application still requests a copy, follow the specific prompt and keep evidence of what was submitted.
7. Track the appeal after submission
Use the same GST Portal account and navigate to Services > User Services > My Applications. Select the appeal application type, enter the relevant From and To dates, and choose Search. Narrow the date range if the list is long, then open the application to view notices, replies, uploaded documents and orders.
The FAQ lists these status labels and related milestones:
| Portal status | How to use it |
|---|---|
| Appeal Submitted | Confirm that the submission exists and check whether any document or payment action remains. |
| Appeal admitted | Read the admission record and confirm the appeal number, documents and recovery treatment shown. |
| Appeal Rejected | Open the rejection communication immediately; the reason and stage determine what, if anything, can be done next. |
| Appeal Withdrawn | Read the withdrawal record and do not assume withdrawal restores or extends the original limitation period. |
| Hearing Notice Issued | Open the notice, diarize the hearing date and follow its attendance or written-submission instructions. |
| Reply Submitted | Check the filed reply and its acknowledgment; retain the exact version submitted. |
| Adjournment Granted | Verify the new date or deadline in the actual communication rather than relying only on the label. |
| Show Cause Notice Issued | Read the notice and respond within the period stated in it. |
| Appeal Order Passed | Download and review the appellate order; the label alone does not show the result or reasoning. |
| Rectification Order Passed | Open the rectification order and compare it with the earlier appellate record. |
Remand-related labels may also appear. Treat every status as a pointer to a document. A status can lag behind an uploaded notice, and a status cannot replace the operative order, hearing notice or statutory direction.

Admission-stage rejection
The GST Portal FAQ says an appeal rejected at the admission stage may be re-filed once. That operational facility is tied to the case stage and the portal’s rules; it is not a general entitlement to restart limitation. Read the rejection reason, correct the identified defect and preserve the original filing and communication dates. If the problem concerns limitation, payment or jurisdiction, obtain advice before re-filing.

Withdrawal
Withdrawal is also stage-dependent. Do not assume that withdrawing an application cancels the demand, revives a lapsed deadline or permits an unrestricted second appeal. Read the withdrawal record and any applicable order before taking another step.
Missing notices or an unchanged status
First check the application’s document tab, registered email and portal inbox, then confirm that the From and To dates include the submission date. Download what is available and record the time of each check. If a statutory response period is running, act on the actual notice and contact the jurisdictional office or an adviser through an appropriate channel rather than waiting for the status label to change.
9. A practical filing-and-tracking checklist
- Save the complete order and identify the issuing authority, sections and communication date.
- Confirm that the order fits the first-appeal route and select the matching portal category.
- Mark the three-month deadline and, separately, the outside one-month condonation possibility.
- Separate admitted amounts from disputed tax, interest and penalty.
- Pay the admitted amount and the applicable section 107(6) pre-deposit; save proof.
- Draft order-specific grounds, relief and verification.
- File APL-01 through My Applications and complete the required DSC or EVC signing.
- Submit the certified or self-certified order copy and supporting documents within seven days.
- Download the provisional acknowledgment and final APL-02 with appeal number.
- Track the application using the appeal type and From/To date search.
- Open every hearing notice, show-cause notice, reply acknowledgment and order.
- Keep a dated case log containing payments, uploads, communications, hearings and deadlines.
10. Common mistakes that create avoidable risk
- Counting from the order date without checking communication: limitation generally runs from communication.
- Assuming the extra month is automatic: condonation requires sufficient cause accepted by the Appellate Authority.
- Paying only the amount you agree with: the statutory pre-deposit is an additional filing condition in the ordinary tax-demand case.
- Using the tax formula for a penalty-only order: the Act contains a separate penalty-only proviso.
- Uploading the order late: late document submission can shift the filing date under the portal FAQ and rules.
- Stopping after provisional acknowledgment: look for final APL-02 and its appeal number.
- Treating “admitted” as a final win: admission and recovery treatment do not decide the merits.
- Relying on a status label without opening the document: the operative directions are in the notice or order.
- Re-filing or withdrawing without checking limitation: portal options do not automatically reset statutory deadlines.
11. When individual advice is warranted
Consider advice from a GST practitioner, chartered accountant or tax lawyer experienced in indirect-tax appeals when the communication date is unclear, the three-month period may have expired, the order combines several statutory sections, the demand is large enough to affect cash flow, the payment amount is disputed, a prior appeal was rejected or withdrawn, or the case involves complex evidence. Professional representation is not a universal filing requirement, but applying the deadline, pre-deposit and grounds to a particular order requires the complete case record.

12. Authority and currency of the procedure
The process described here is based on the GSTN FAQ titled “FAQs: Filing an Appeal against Demand Order (FORM GST APL-01),” the CBIC text of CGST Act section 107 identified as updated through 1 October 2025, and the CBIC chapter containing the appeal rules. GST law, portal labels and filing requirements can change. Before submitting, compare the live portal instructions and the current statutory text with the order in hand.
