The Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) no longer reduce Social Security benefits for benefit months beginning January 2024. The Social Security Fairness Act, signed on January 5, 2025, repealed both provisions retroactively. The change can increase payments for people whose benefits were reduced under the former rules, but a public-sector job or pension alone does not establish eligibility or determine the amount.
WEP and GPO addressed different Social Security benefits
Before repeal, WEP and GPO affected some people who had both a pension based on work that did not pay Social Security taxes and an entitlement to a Social Security benefit. They were not one general rule that reduced every public employee’s retirement income. The central difference was which person’s Social Security record supported the benefit at issue.

| Provision | Benefit record involved | What could be reduced under the former rule |
|---|---|---|
| Windfall Elimination Provision (WEP) | The beneficiary’s own earnings record | The person’s own Social Security retirement or disability benefit, if the person also received a pension based on non-covered work |
| Government Pension Offset (GPO) | A spouse’s or deceased spouse’s earnings record | A Social Security spouse or survivor benefit, if the beneficiary received a pension based on their own work for a government employer that did not pay Social Security taxes |
In everyday terms, WEP concerned a person’s own Social Security benefit; GPO concerned a benefit claimed on a spouse’s record. The Social Security Administration (SSA) describes these separately in its FAQs on pensions from non-covered work and on government pensions and spouse benefits, both dated April 16, 2025.

WEP: a worker’s own benefit
WEP applied to some people who qualified for Social Security retirement or disability benefits through work covered by Social Security and also received a pension based on other work that did not pay Social Security taxes. The provision changed the calculation of the worker’s Social Security benefit. It did not mean that the person had no Social Security-covered work; eligibility for a benefit on the person’s own record was part of the situation in which WEP could apply.

This distinction matters when reviewing an old benefit notice or trying to understand a past payment. A pension from non-covered work was not, by itself, the Social Security benefit. WEP concerned the calculation of a separate benefit tied to the worker’s covered earnings record. A person whose own retirement or disability payment was reduced may therefore have been affected by WEP, but the occupation or pension label alone cannot confirm that.
GPO: a spouse or survivor benefit
GPO applied to some people receiving a Social Security benefit as a spouse or surviving spouse while also receiving a pension based on their own work for a federal, state, or local government employer that did not pay Social Security taxes. Under the former rule, the offset could reduce or eliminate the spouse or survivor payment.
That was different from WEP: the relevant Social Security benefit was based on another person’s record, while the pension arose from the beneficiary’s own government work. Someone trying to identify a past GPO reduction should look at whether they were receiving, or had applied for, a spouse or survivor benefit—not only at whether they had a government pension.

When repeal took effect—and why payment dates can look later
The Social Security Fairness Act became law on January 5, 2025. Its benefit effect is retroactive: WEP and GPO do not apply to benefits payable for January 2024 and later. December 2023 was the final benefit month to which the provisions applied, according to SSA’s implementation guidance and its January 6, 2025 legislative bulletin.
A benefit month and the date money reaches a bank account are not necessarily the same month. Social Security benefits are generally paid one month after the month for which they are due. So a payment received in February 2024 generally corresponds to the January 2024 benefit month. That timing explains why the effective month can appear earlier than the deposit associated with it; the law’s cutoff is based on the benefit month, not simply the date a deposit arrived.
The retroactive start also explains why the change could involve both a revised monthly payment and money for earlier eligible months. It does not mean that every person who has a public pension is due a retroactive amount: there must have been a Social Security benefit for which the former reduction applied, or another basis to qualify under SSA’s benefit rules.

Who may be affected—and who should not assume they qualify
SSA gives teachers, firefighters, police officers in many states, some federal employees covered by the Civil Service Retirement System, and people whose work was covered by a foreign social security system as examples of people who may benefit. These examples are not automatic eligibility categories. The relevant question is whether a pension is based on work not covered by Social Security and whether a Social Security benefit was subject to WEP or GPO.
Public employment does not necessarily mean non-covered employment. SSA’s Fairness Act page, last updated July 21, 2025, says about 72 percent of state and local public employees work in Social Security-covered employment and are not affected by WEP or GPO. That population-wide figure is not a test for any individual worker: coverage depends on the work and pension at issue, rather than simply the employer’s public-sector status.

- Do you receive a pension based on work for which Social Security taxes were not paid?
- Did you receive a Social Security retirement or disability benefit on your own earnings record, or a spouse or survivor benefit on someone else’s record?
- Was that benefit reduced or eliminated under WEP or GPO, or have you not yet applied for a benefit you may be entitled to?
A “yes” to a job-title question is not enough to establish the answers. Nor does the repeal itself create an entitlement to a benefit that someone did not otherwise qualify to receive. SSA’s general guidance is the relevant source for benefit requirements; an individual account or direct contact with SSA is needed to resolve an individual record.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How much could a benefit change?
There is no single increase that applies to everyone. SSA says the change varies according to the type of Social Security benefit and the pension amount. The repeal removes the WEP or GPO reduction for eligible benefit months, but the individual’s resulting payment depends on their own circumstances. The historical agency totals below describe SSA’s implementation, not a personal estimate.

SSA also issued a February 25, 2025 press release referring to more than 3.2 million people whose benefits had been affected. Its later Fairness Act page states that over 2.8 million people had their benefits reduced or eliminated. These figures come from differently dated agency statements and use different descriptions; they should not be collapsed into one supposedly contemporaneous count.
What to do if you already receive Social Security
SSA’s implementation guidance said that people whose benefits had already been reduced by WEP or GPO generally did not need to contact the agency to receive an adjustment, provided their mailing address and direct deposit information on file were current. The agency said it would remove the reduction and adjust monthly payments for eligible people. This describes the process for existing beneficiaries; it is not a reason to assume that a particular record was adjusted correctly or that every person with a pension was eligible.
- Check your SSA account. Review your current benefit information through my Social Security and look for the payment and benefit details associated with your record.
- Confirm your contact and payment information. If your address or direct deposit details have changed, update them through your account or contact SSA using its current instructions.
- Review your own notices and deposits. Compare the benefit month shown in agency information with the date money was deposited. Because benefits are generally paid one month after the month they cover, do not use the deposit month alone to identify the effective benefit month.
- Ask SSA about a specific unresolved adjustment. If your account does not answer whether a payment was adjusted, or your work and pension history is complicated, use current SSA guidance or contact the agency. SSA says it may request updated pension information in some cases.
Occupation, pension amount, or a national average cannot substitute for an SSA review of an individual record. Have the relevant benefit notices and pension information available when asking about a specific case; SSA can tell you what information it needs.
If you have not applied—or the beneficiary has died
If you have not claimed a possible benefit
The automatic-adjustment guidance addressed people already receiving benefits that had been reduced. If you have not applied for a retirement, disability, spouse, or survivor benefit, the repeal does not itself file a claim for you. Check SSA’s current eligibility information and application instructions, then apply if you believe you meet the requirements. Do not infer eligibility solely from having worked in a listed occupation or receiving a government pension.
If an affected beneficiary has died
A family member can check whether an amount may be due to the estate or an eligible person. SSA’s pension guidance identifies the Claim for Amounts Due in the Case of a Deceased Beneficiary form, SSA-1724-F4, as a route for making that inquiry. Confirm the current form, instructions, and who may file on SSA’s website before submitting anything; the possibility of an amount due is not a guarantee that one is payable.
How to avoid common misunderstandings
- Do not treat WEP and GPO as interchangeable. One concerned the worker’s own Social Security record; the other concerned a spouse or survivor benefit on another person’s record.
- Do not equate public employment with non-covered work. Some public jobs are covered by Social Security, and SSA says most state and local public employees work in covered employment.
- Do not read a population average as a personal award. The reported $7,208 retroactive average describes SSA’s Fiscal Year 2025 reporting, not what an individual should expect.
- Do not confuse the law’s effective benefit month with the deposit date. A January benefit is generally paid in February.
- Do not assume that repeal means everyone has a benefit to claim. A person still has to meet the applicable SSA requirements for the particular benefit.
For the authoritative current instructions, consult SSA’s Fairness Act implementation page and its guidance on pensions and work abroad. SSA’s account tools and direct assistance are the practical way to confirm how the repeal applies to a particular benefit record.
