A very large IRA is not automatically protected from every creditor. In the United States, the answer depends on whether the account is an owner-held IRA, an inherited IRA or an employer plan; whether the claim is being handled in bankruptcy; which federal or state exemption rules apply; and the account holder’s domicile history. The law offers important protections in some circumstances, but no account label or rollover is a universal shield.
What “protection” means for a large IRA
Creditor protection is not one rule that follows every retirement account everywhere. Bankruptcy exemptions, ERISA rules for covered employer plans, and state-law protections outside bankruptcy are distinct legal frameworks. A protection that applies in one setting may not apply in another, and the creditor and account holder’s circumstances matter.

The first question is therefore not how large the IRA is, but what kind of account it is and what legal process is involved. The federal Bankruptcy Code provides an exemption for qualifying retirement funds in specified tax-exempt accounts, but it also allows a choice between exemption systems in circumstances governed by applicable law and domicile rules. The text of 11 U.S.C. § 522 does not promise that every IRA balance is exempt or fully insulated from collection.
How owner-held IRAs, employer plans and inherited IRAs differ
| Account | Protection framework | Key qualification |
|---|---|---|
| Owner-held IRA | Bankruptcy Code and, where applicable, state nonbankruptcy exemptions | Whether funds qualify for an exemption depends on the account and the applicable exemption system; do not assume the federal rule settles every creditor claim. |
| Covered employer retirement plan, such as a 401(k) | ERISA rules generally protect covered plan assets from creditors | Family-support obligations and court orders dividing property in divorce can affect benefits. |
| Inherited IRA | The federal bankruptcy exemption for “retirement funds” does not cover inherited IRAs under the Supreme Court’s decision in Clark v. Rameker | Applicable state-law protections and the facts of a nonbankruptcy collection matter require separate analysis; do not treat the account as equivalent to the beneficiary’s own IRA. |
The table is a starting point, not a ranking. The Department of Labor says that when a person transfers a 401(k) to an IRA, the IRA funds generally cannot be reached by creditors in bankruptcy. That general guidance is not a guarantee for every state, creditor, or account arrangement.

Why inherited IRAs receive different treatment in bankruptcy
In Clark v. Rameker, decided June 12, 2014, the U.S. Supreme Court held that inherited IRAs are not “retirement funds” within the meaning of the federal bankruptcy exemption at issue. Justice Sonia Sotomayor, writing for a unanimous Court, stated: “Funds held in inherited IRAs are not ‘retirement funds’ within the meaning of §522(b)(3)(C).”
The Court identified features of inherited accounts that informed its conclusion: beneficiaries cannot add contributions, must take distributions under applicable rules, and can withdraw the balance for current use without the early-distribution penalty that generally discourages early withdrawals from an owner’s IRA. That holding concerns the federal bankruptcy exemption; it should not be stretched into a claim about every state-law exemption or every collection proceeding.

The Court’s earlier decision in Rousey v. Jacoway addressed a different statutory context and recognized an exemption for the debtors’ own IRAs under the provision then at issue. It does not erase Clark’s distinct holding on inherited IRAs.

There is no universal winner. The Department of Labor describes ERISA as generally protecting covered employer-plan assets from creditors, subject to exceptions that include family-support matters and court orders dividing property in divorce. An IRA is analyzed under different rules, including the Bankruptcy Code and potentially applicable state exemptions. After a plan-to-IRA transfer, the Department’s general bankruptcy guidance says the IRA funds generally cannot be reached by creditors in bankruptcy, but that statement is not an all-purpose guarantee.

Compare the actual account, the type of claim, the legal forum and the applicable law before deciding that keeping money in a plan or moving it to an IRA improves protection. A rollover may also have tax and plan consequences that are separate from creditor treatment.
How domicile and the type of creditor change the analysis
In bankruptcy, 11 U.S.C. § 522 allows qualifying retirement funds in listed tax-exempt accounts to be exempted, while its exemption provisions also address applicable nonbankruptcy federal or state law and a domicile-based period for determining which exemptions apply. The relevant analysis can therefore depend on where the debtor has lived, which exemption system is available and selected, and the precise account and facts.

Outside bankruptcy, do not assume that a federal bankruptcy exemption decides whether a creditor can collect. The applicable state’s nonbankruptcy law and the nature of the claim may matter. Because the governing rules can differ by jurisdiction and circumstances, a large balance does not by itself establish either complete protection or a particular exemption amount.

Distribution rules depend on the original owner’s date of death and the beneficiary’s category. For many defined-contribution plan participants and IRA owners who died after December 31, 2019, the SECURE Act generally requires the account to be distributed within ten years. Exceptions include surviving spouses, certain minor children, disabled or chronically ill beneficiaries, and beneficiaries not more than ten years younger than the owner. The beneficiary’s status and whether the owner had reached the required beginning date can change the calculation.

The IRS says many account owners begin required minimum distributions at age 73. For an inherited account, IRS Publication 590-B (2025) advises beneficiaries to check the governing IRA documents or consult the custodian or trustee to determine whether a five- or ten-year rule applies. Taxable distributions are generally included in gross income. These distribution and tax rules can shape estate planning, but they do not themselves confer creditor protection.
Actions that can put IRA status at risk
Do not treat an IRA as a personal bank account or use it casually to secure personal borrowing. IRS guidance identifies borrowing from an IRA, pledging it as loan security and buying property for personal use with IRA funds as examples of prohibited transactions that can cause the account to lose its IRA status. A transaction involving personal use, family members, a business or collateral should be reviewed with a tax professional and an attorney familiar with retirement accounts before it occurs.
A practical review for a very large IRA
- Identify the account precisely. Confirm whether the assets are in the owner’s IRA, an inherited IRA, or a still-covered employer plan. Keep inherited assets distinct from the beneficiary’s own retirement account.
- Define the legal setting. Establish whether the concern is bankruptcy, a nonbankruptcy collection action, family support, divorce, or another type of claim. Different rules may govern each.
- Map the relevant jurisdiction. For a potential bankruptcy, review domicile history and determine which federal or state exemption system can apply. For other collection matters, obtain advice on the relevant state law and claim.
- Check beneficiary and distribution terms. For inherited assets, establish the original owner’s date of death, beneficiary category, required distribution schedule, and any applicable five- or ten-year rule with the custodian or trustee.
- Review proposed transactions before acting. Get specialized legal and tax advice before a rollover, pledge, loan, personal-use purchase or other transaction involving IRA assets. Do not transfer or conceal assets to evade existing creditors.
This is a general U.S. legal and tax overview, not individualized advice. For a substantial account, have an attorney review the account documents, domicile facts, creditor context and applicable state law before relying on any protection strategy.
