How the Trump Administration Could Affect Aviation Unions

The administration’s March 2025 order concerns federal labor protections and potential FAA exclusions. Private airline workers remain under a separate Railway Labor Act system administered by the NMB.

The Trump administration’s March 27, 2025 order created a potential path to change federal labor protections for some Department of Transportation subdivisions, including the FAA. It did not, by itself, end FAA employees’ union rights. Nor did it automatically change the separate Railway Labor Act system that governs union representation and bargaining for employees of private airlines.

Which aviation workers could be affected?

“Aviation unions” covers workers subject to different labor laws. The key distinction is who employs the worker: a federal agency such as the FAA, or a private airline. That determines which labor-relations system applies.

The National Mediation Board describes the RLA as giving airline and railroad employees the right to organize and bargain through representatives of their choosing. The FLRA’s federal-sector role is distinct from the NMB’s, as well as from the National Labor Relations Board’s role in other private industries.

What did the March 2025 order authorize?

President Donald Trump’s March 27, 2025 order delegated authority under the federal labor statute to the Secretary of Transportation. Under Section 5(b), the Secretary may issue orders excluding any Department of Transportation subdivision—including the FAA—from coverage, or suspending provisions of the statute for DOT installations or activities outside the 50 states and the District of Columbia. The order says this authority may not be delegated further and that determinations under the specified provisions must be published in the Federal Register.

Authority is not the same as an exclusion

The order supplies a route for a later decision; its delegation is not itself a decision that a particular FAA subdivision is excluded. Its implementation provisions also refer to steps agency heads may take after employees have been excepted under the order. The White House’s August 2025 fact sheet lists exemptions at federal agencies with national-security missions but does not name the FAA in its reproduced list. The cited official materials do not establish a later published exclusion of a named FAA subdivision or resolve the status of any related litigation. A reader seeking the current status of a specific unit would need to check Federal Register notices and court records.

Would the order change private airline union rights?

Not automatically. Private airline employees’ representation and bargaining are governed by the RLA, not the federal-sector labor statute addressed by the order. Under the NMB’s description of the process, representation units are organized by craft or class and determined system-wide. When employees vote for representation, NMB certification triggers the carrier’s statutory duty to bargain.

The NMB’s FY 2026 determinations list includes airline representation decisions involving Alaska Airlines/Hawaiian Airlines, JetBlue, and Republic Airways. Those examples show the RLA process at work; they do not show that the administration caused a particular case or affected its outcome.

Where could the administration’s actions matter in practice?

Federal FAA labor relations

For federal FAA workers, the consequential next step would be a Transportation Secretary determination under the delegated authority, with the publication and scope described in the order. The practical effect would depend on which subdivision or activity an order covers and what it says. Without a specific determination, it is not accurate to say that FAA unions as a whole have been abolished or that all FAA bargaining relationships have changed.

FAA organization and staffing

In January 2026, the FAA announced a reorganization involving airspace modernization, safety management, and other offices. The FAA said the plan would not result in reductions in force. An organizational change can be relevant to how work is managed, but the announcement does not say that the reorganization ended or changed a union agreement.

Union participation in safety programs

The FAA says its Aviation Safety Action Program may include an employee’s labor organization as a third-party partner. That makes union participation relevant to the agency’s reporting and safety processes. The FAA’s program description, however, does not establish that the administration changed the union’s role or altered safety outcomes.

Private airline bargaining conditions

Economic pressures can shape negotiations without being caused by a federal policy change. The NMB’s FY 2026 budget justification, published in 2025, cites labor shortages, inflationary costs, and health-insurance changes as challenges at bargaining tables. It also reports that 30 mediation cases produced ratified collective bargaining agreements for more than 65,000 workers in FY 2024. Those figures describe bargaining activity and context, not an effect attributable to the administration.

What do NMB workload figures show?

The NMB’s FY 2025 annual report records 34 representation cases resolved and 33 docketed, with 9 pending at fiscal year-end. These are case counts, not counts of unions or workers affected by administration policy. Alongside the later FY 2026 decisions, they indicate that NMB representation work continued; they do not demonstrate that presidential policy caused a particular result.

How should workers and readers assess a claimed impact?

Start with the worker’s employer and the legal framework, then distinguish an announced authority from an implemented decision. For a claim about changed rights, look for the specific action and the group it covers—not just a broad reference to aviation or federal workforce policy.

  • Federal FAA employee: Check whether a Transportation Secretary determination identifies the relevant FAA subdivision or activity, and whether it has been published as required.
  • Private airline employee: Identify the RLA/NMB representation or bargaining process involved. The March 2025 federal labor order does not itself rewrite that process.
  • Claim about restructuring or safety: Separate organizational changes and program descriptions from evidence that a union agreement, participation role, or labor right actually changed.
  • Claim about bargaining outcomes: Distinguish general pressures such as labor availability, inflation, or insurance costs from evidence tying a particular outcome to administration action.
