For a trust, who reports that income depends on whether the trust is a grantor trust, non-grantor trust, or partly both. A new, narrow safe harbor applies only to certain qualifying exchange-traded trusts; it is not a general rule for family or private trusts.
When staking rewards become taxable income
Revenue Ruling 2023-14 addresses a cash-method taxpayer who stakes cryptocurrency and receives additional units as validation rewards. It says the fair market value of the rewards is included in gross income for the tax year in which the taxpayer gains dominion and control. The value is measured at the date and time control is obtained. The IRS says the same holding applies when staking is done through an exchange.
The practical question is whether the taxpayer can sell, exchange, or otherwise dispose of the reward. A protocol’s reward calculation or display alone does not establish that the taxpayer has control. A lockup, custodial restriction, or trust agreement may affect the facts, so the ruling should not be read as deciding every case involving restricted rewards or trust accounting.
The ruling’s stated holding concerns a cash-method taxpayer. It does not expressly resolve every trust-specific question, including who is treated as the taxpayer under a particular trust arrangement. Determine the trust’s tax classification and ownership facts before deciding whose return should include the reward.

Which taxpayer reports the income?
First establish whether the trust is a grantor trust, non-grantor trust, or a combination. The IRS’s 2025 Instructions for Form 1041 generally treat grantor-trust income as belonging directly to the grantor or other deemed owner. If only part of a trust is grantor-type, that portion is reported to the owner through an attachment, while the non-grantor portion follows the normal trust rules. Applicable distributions from the non-grantor portion are reported to beneficiaries on Schedule K-1.

These are classification principles, not a determination of how a specific reward must be allocated. The governing instrument, ownership of the staked assets, and other facts matter. Do not assume every staking reward is reported in the same way on Form 1041.

How the special exchange-traded trust safe harbor works
Revenue Procedure 2026-20, issued October 6, 2026, creates a limited safe harbor. If all of its requirements are satisfied, authorizing and conducting staking will not, by itself, prevent a trust within the procedure’s scope from qualifying for federal income tax purposes as an investment trust and a grantor trust. It covers a specific category of exchange-traded trusts—not ordinary family trusts or all trusts that stake crypto.
Eligibility is conditional and depends on the entire arrangement, not just the fact that a trust stakes digital assets. The procedure includes requirements concerning exchange trading and applicable SEC and exchange conditions; the assets and network the trust may hold; custody and tax ownership of private keys and assets; the trust’s activities and purpose; and custody, liquidity, staking-provider, slashing, and reward-distribution arrangements. Meeting only some of these conditions does not establish eligibility.

One requirement sets a distribution deadline: qualifying net rewards must be distributed proportionately, in kind, for cash, or in a combination, no more than 60 days after the end of the calendar quarter in which the trust gains dominion and control over them. This is a condition of the safe harbor, not a general deadline or income-recognition rule for every trust. Revenue Ruling 2023-14’s general timing principle remains distinct from this special distribution condition.
The procedure also cautions that it does not address every federal tax consequence of staking. It specifically says not to infer conclusions about matters it does not expressly cover, including whether staking income is effectively connected with a U.S. trade or business or is unrelated business taxable income. State and non-U.S. tax treatment are outside the federal guidance discussed here.

Form 1041 and later sales or dispositions
The 2025 Form 1041 instructions include receiving new digital assets through staking in the return’s digital-assets question. A fiduciary should answer the applicable question for the relevant tax year using that year’s form and instructions. The question does not replace the need to determine which person or trust portion is treated as earning the income.
Keep the initial reward inclusion separate from a later sale, exchange, or other disposition. If the digital asset is a capital asset, IRS guidance directs taxpayers to calculate the disposition on Form 8949 and report it on Schedule D (Form 1041), as applicable. The reward’s value when control was obtained is relevant to the income inclusion; records of that value and subsequent transactions help establish basis and any later gain or loss.

Trustee recordkeeping workflow
Maintain a transaction-level record for each reward and each later disposition. IRS digital-asset guidance calls for records of receipts and dispositions and the U.S.-dollar fair market value of digital assets received as income. For disposition calculations, it identifies asset type, date and time, units, value, and basis as relevant records.
- Record each reward: note the asset and network, units received, date and time, wallet or trust account, and the custodian or staking provider.
- Document control: preserve evidence of when the trust or deemed owner could sell, exchange, or otherwise dispose of the reward. Keep relevant custodian statements, exchange reports, and terms or restrictions affecting access.
- Support the valuation: record the U.S.-dollar fair market value at the date and time control was gained and the source used to determine it.
- Track later activity: for each sale or other disposition, retain the date and time, asset type, units, proceeds or other value, and basis records. Keep fee and withholding details where applicable.
- Reconcile ownership and reporting: compare on-chain activity, provider or exchange statements, and the trust ledger. Preserve a workpaper showing how rewards and expenses were allocated between grantor and non-grantor portions, where relevant.
- Prepare the return using current instructions: apply the relevant year’s Form 1041 digital-assets question and disposition instructions, while reporting grantor-trust amounts to the appropriate deemed owner when required.
Reconciliation and allocation workpapers are practical ways to support reporting; they are not a prescribed IRS software system or a substitute for applying the trust’s actual terms and tax classification.
