If you received a Social Security overpayment notice, first decide which problem you are addressing: the debt is wrong (request reconsideration), the debt is correct but collecting it would be unfair or unaffordable (request a waiver), or the debt is correct but the proposed monthly withholding is too high (request a lower recovery rate). These are separate requests, use different forms, and have different timing rules.
Read the notice closely, save the envelope, and act promptly. Social Security Administration (SSA) guidance says collection generally will not begin for at least 30 days after the notice is sent. An appeal or waiver requested within that 30-day period pauses collection while SSA decides. The usual appeal deadline is 60 days from when you receive the notice.

What a Social Security overpayment notice means
SSA uses an overpayment notice to tell you that it believes it paid more than you were entitled to receive. As SSA puts it: “An overpayment is when you receive more money than you should have from us.” The notice should identify the amount SSA says you owe, explain why it believes an overpayment occurred, and describe how and when the amount accumulated.

Federal notice rules also call for the proposed recovery method, any available repayment alternatives such as different withholding or installments, and a warning that recovery may begin if you do not request reconsideration or a waiver within the applicable period.

The reason can be specific to your benefit record. SSA lists changes in work, earnings, income, resources, living arrangements, marital status, or information that was missing or recorded incorrectly as possible causes. A general list is not a finding about your case; the explanation in your own notice controls.
What to locate on the notice
- The total overpayment amount and the benefit involved.
- The months or other period SSA says the overpayment covers.
- The stated reason and any earnings, income, or household information SSA used.
- The proposed withholding amount or repayment instructions.
- The reconsideration, waiver, and payment-rate instructions, including addresses or submission methods.
- The date on the notice and the date you actually received it.
Your three response options
Choose the option that matches your disagreement. Filing the wrong request can leave the underlying issue unresolved.
| Request | What you are challenging | Primary form | Timing described by SSA | Potential result |
|---|---|---|---|---|
| Reconsideration (appeal) | Whether an overpayment exists or whether SSA calculated the amount correctly | SSA-561 | Generally within 60 days of receiving the notice; SSA usually presumes receipt five days after the notice date unless you show later delivery | SSA reviews the determination and may revise or remove the debt |
| Waiver | Collection would be unfair, you were not at fault, or you cannot afford repayment | SSA-632-BK | The May 2024 SSA fact sheet says there is no time limit to request a waiver; request promptly to address collection | SSA may excuse recovery of some or all of the debt |
| Change in recovery rate | The debt is accepted, but the proposed monthly withholding or installment is unaffordable | SSA-634 | Request as soon as the proposed rate creates a hardship | A lower monthly payment or withholding amount; SSA reported options as low as $10 per month |
Deadlines and when collection can start
There are two separate clocks. Do not treat “30 days” and “60 days” as interchangeable.
The 30-day collection period
SSA’s current overpayment-resolution guidance says it waits at least 30 days after sending the notice before starting collection. If you request reconsideration or a waiver within 30 days, SSA says it will not collect while it decides that request. This is a pause in collection, not an automatic cancellation of the debt.

The 60-day appeal period
SSA’s May 2024 fact sheet states that reconsideration is generally due within 60 days of receipt. SSA materials commonly presume that you received a notice five days after the date printed on it, unless you can establish that it arrived later. Keep the envelope, make a copy of every page, and record when and how you submitted your request.
If the 60-day period has passed, you may still ask SSA to accept a late appeal for good cause. Explain the circumstances and follow the instructions on your notice; do not assume a late filing will be accepted.
Why preserving dates matters
The notice date, actual delivery date, date you submitted a form, and date SSA received it can affect your rights. Use a delivery method that creates a record, retain confirmation, and write down the name of any SSA representative you speak with and the date of the call.
How to appeal a Social Security overpayment
Use reconsideration when you believe you were not overpaid or SSA’s amount is wrong. You can challenge the entire debt or a specific part of it.

- Compare the notice with your records. Gather benefit statements, pay stubs, tax or wage records, bank statements, disability or retirement records, and correspondence showing when a change occurred.
- Identify the exact disputed months and numbers. State which payment, income figure, resource, living arrangement, or other fact is incorrect. A broad statement that “the amount is wrong” is less useful than a month-by-month explanation.
- Complete Form SSA-561. Explain why you disagree and attach copies of supporting documents. Keep the originals.
- Submit it through the route in your notice. SSA instructions may direct online submission, mail, fax, telephone contact, or an office appointment depending on the request and your circumstances.
- Keep proof of filing. Save a copy of the signed form, attachments, delivery confirmation, and any receipt or online confirmation.
- Respond to follow-up requests. SSA may ask for additional evidence or clarification. Missing a response can delay review or leave the original determination in place.
Reconsideration addresses the calculation or existence of the debt. It does not by itself ask SSA to excuse a correctly calculated debt because repayment is difficult; that is the purpose of a waiver.
How a waiver works
A waiver asks SSA not to collect some or all of a debt you do not necessarily dispute. SSA’s fact sheet describes waiver as appropriate when you believe you were not at fault and cannot afford repayment, or when recovery would be unfair for another reason. The fact sheet says there is no time limit to file a waiver request, but waiting can allow collection activity to begin, so submit it promptly.
Information SSA uses for a waiver
SSA generally needs facts about how the overpayment happened, what you knew or reported, your income and resources, and your necessary living expenses. Be accurate and complete. Explain events in chronological order and attach documents that support your account, such as notices you sent to SSA, proof of reported wages, medical or caregiving circumstances, or evidence that withholding would prevent you from meeting basic expenses.

- Describe why you were not at fault, or why collecting would be against equity and good conscience or otherwise unfair.
- List household income, assets, debts, recurring bills, and essential expenses as requested.
- Attach copies of documents that verify the figures and circumstances.
- Submit the form using the online, mail, fax, telephone, or office process SSA identifies for your case.
- Retain the completed form and proof of submission.
A waiver is not guaranteed. SSA decides based on the facts in the record and the evidence you provide. If you also believe the amount is wrong, say so and submit reconsideration separately; a waiver request does not replace an appeal of the calculation.

How to request smaller monthly payments
If you accept that the debt is correct but cannot afford the proposed withholding, use Form SSA-634 to request a change in the recovery rate. This is a payment-arrangement request, not a challenge to the overpayment and not a waiver.
What to provide
- Your current income and the frequency of each payment.
- Cash, bank accounts, property, and other resources.
- Housing, food, utilities, medical care, transportation, insurance, and other necessary expenses.
- Any special circumstances that make the proposed withholding especially harmful.
SSA reported in 2024 that flexible repayment options could be as low as $10 per month. That figure is an agency-reported option, not a guarantee for every case. SSA also said that when a proposed rate would take more than 60 months to recover the debt, a representative would gather information about income, resources, and expenses. Ask SSA to confirm the rate available in your benefit type and circumstances.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How much can Social Security withhold?
SSA’s current online guidance says that, if you do not repay within 30 days, it will automatically withhold 50% of a Social Security benefit or 10% of an SSI payment each month until the overpayment is repaid. The proposal in your notice and any later agreement control your case. Contact SSA promptly if that amount would leave you unable to pay for necessities and request a different recovery rate on Form SSA-634.

Checking whether SSA’s calculation is correct
Reconstruct the period month by month rather than relying only on the total. Create a simple timeline with the date of each change, when you reported it, when SSA acknowledged it, and the payment you received. Then compare that timeline with the notice.
Common records to compare
- Pay stubs, employer wage statements, and dates work started or ended.
- Benefit award letters and payment histories.
- Bank statements or other resource records when SSI rules are involved.
- Lease, household, or address records when living arrangements matter.
- Marriage, divorce, separation, or household-change documents.
- Copies of reports, telephone notes, online submissions, and confirmation numbers sent to SSA.
Point out arithmetic errors, duplicate months, payments returned to SSA, or facts that changed during the period. Send copies, not irreplaceable originals, and label each attachment with the month or issue it supports.
If you cannot pay immediately
Do not ignore the notice. An unpaid balance can lead to benefit withholding under SSA’s collection process. Call or contact SSA using the instructions on the notice, explain whether you are appealing, requesting a waiver, or seeking a lower rate, and ask what will happen while the request is pending.

A request to reduce withholding does not necessarily stop collection, so confirm whether your submission qualifies for the 30-day pause or whether withholding has already begun.
Common mistakes to avoid
- Using the wrong form: SSA-561 disputes the debt, SSA-632-BK seeks a waiver, and SSA-634 seeks a lower recovery rate.
- Waiting for the 60-day appeal deadline: Collection may begin after the separate 30-day period, so file an appeal or waiver within 30 days when you need collection paused.
- Assuming a waiver proves the amount is wrong: Waiver concerns fault, affordability, or fairness; use reconsideration for a calculation dispute.
- Sending unsupported estimates: Provide documents for income, expenses, resources, and the event that caused the overpayment.
- Failing to document delivery: Keep the envelope, copies, receipts, fax confirmations, and online submission records.
- Assuming the $10 option applies automatically: SSA reported it as a flexible option, but the available rate depends on the case.
What to do next
- Read every page of the notice and mark the amount, months, reason, proposed withholding, and instructions.
- Write down the date you received it and preserve the envelope.
- Within 30 days, submit reconsideration or a waiver if you need collection paused while SSA reviews your request.
- If the debt is correct but the payment is unaffordable, submit SSA-634 and detailed financial information.
- Keep a complete file of forms, evidence, delivery proof, and SSA responses.
- Ask SSA to clarify any conflict between the notice and current instructions before choosing a repayment arrangement.
The correct response depends on the actual notice, your benefit type, SSA’s records, and your circumstances. General information cannot determine whether your calculation is correct or whether SSA will approve a waiver or reduced rate.
