How Short-Term Disability Benefits Work

Short-term disability can replace part of your income while a covered condition keeps you from working, but eligibility, payment, timing, and duration depend on your plan or state program.

Short-term disability benefits replace part of your income for a limited time when a covered illness, injury, or other qualifying condition keeps you from working. Whether you qualify, how much you receive, when payments begin, and how long they last depend on your employer’s policy or your state’s program. The benefit is cash income replacement—not automatic job protection.

What short-term disability benefits do

Short-term disability (STD) insurance is designed to replace some earnings during a covered period when you cannot work. A plan may pay a percentage of prior pay or a flat amount. The insurer or plan administrator reviews the claim against the applicable policy or program rules; having a condition that prevents you from working does not by itself guarantee payment. The Texas Department of Insurance explains that a policy defines what it considers a disability, injury, or illness: Texas Department of Insurance consumer guidance.

Coverage may come through an employer plan, an individually purchased policy, or a state temporary disability system, depending on where you live and your circumstances. Not every worker has STD coverage. Employer plans may be self-funded or commercially insured, and state programs have their own requirements. Start by checking your benefits materials, policy certificate, insurer, and—if relevant—your state program. The U.S. Bureau of Labor Statistics describes the different plan arrangements and benefit forms in its glossary of employee-benefit terms.

How much short-term disability pays

There is no standard national replacement rate. Your policy or state program sets the amount and the earnings used to calculate it. A stated percentage is not necessarily a percentage of your full salary: definitions of covered earnings, weekly or monthly caps, offsets for other income, and interactions with paid leave can affect the payment. Check those terms in the governing documents rather than estimating from a headline percentage.

A state example: New Jersey in 2026

For New Jersey Temporary Disability Insurance claims in 2026, the state says the weekly benefit is 85% of average weekly wages, subject to a maximum of $1,119 per week. Eligibility also depends on the state’s earnings test and coverage rules. These figures apply to that state program and claim year, not to employer policies or other states. See the New Jersey Department of Labor and Workforce Development’s Temporary Disability Insurance guidance for current program details.

When payments start and how to apply

A waiting or elimination period may apply before benefits begin. Its length is plan-specific: the Texas Department of Insurance says a short-term policy’s waiting period can be up to 90 days, which is a general guide rather than a rule for every policy. State programs set their own timing.

In New Jersey, the state program generally has a seven-day waiting week and begins payment on the eighth consecutive day of disability, subject to program conditions. The state says claims should be filed within 30 days of the disability’s onset; late claims may be reduced or denied. Those deadlines are New Jersey rules, not nationwide filing requirements.

For any claim, follow the instructions and deadlines in your policy or state program. Complete the application, provide requested medical information, and coordinate promptly with your provider if the program requires medical certification. Do not assume you must use up paid time off before applying: whether paid leave interacts with a disability benefit depends on the specific plan and applicable state rules.

How long benefits can last

The maximum payment period depends on the policy or program. The Texas Department of Insurance says short-term policies usually pay for up to one year. The Bureau of Labor Statistics describes six to 12 months as a typical plan period. Those are general descriptions, not promises about a particular policy; check its stated maximum and any conditions that may end payments earlier. State programs have separate limits.

Does short-term disability protect your job?

Receiving disability payments does not, by itself, establish that your job is protected. Cash benefits and leave or accommodation rights have different rules. Depending on your circumstances, you may need to consider STD alongside the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), workers’ compensation, or state and employer leave policies.

FMLA leave

For eligible employees and qualifying reasons, the FMLA provides up to 12 workweeks of unpaid leave in a year under the law’s rules. It also provides for continuation of group health benefits during leave and restoration to the same or an equivalent position when leave ends, subject to those rules. FMLA leave is not a disability payment; a person may need to assess FMLA eligibility separately from an STD claim. See the U.S. Department of Labor’s FMLA fact sheet.

ADA accommodations

The ADA does not specifically require employers to provide medical leave, but reasonable-accommodation obligations may apply to a qualified employee with a disability, depending on the circumstances. A short-term health condition does not automatically meet the ADA’s definition of disability. The Department of Labor summarizes these distinctions in its guidance on medical and disability-related leave.

Workers’ compensation and other leave

If an illness or injury is work-related, workers’ compensation may be the relevant route for medical and wage-related benefits; state rules vary. Ordinary STD coverage is generally associated with non-work-related illnesses or accidents. Paid sick leave usually concerns an employee’s own illness or injury, while paid family leave generally concerns caring for a family member or bonding with a child. These programs serve different purposes, and their interaction with disability benefits depends on the plan and jurisdiction. The Bureau of Labor Statistics glossary distinguishes these leave types.

Short-term disability is not SSDI

Social Security Disability Insurance (SSDI) is a federal program with different eligibility rules, including work-credit requirements. The Social Security Administration says a qualifying total disability must have lasted, or be expected to last, at least 12 consecutive months or result in death. It does not pay SSDI benefits for short-term or partial disability, and a five-month waiting period generally applies. See the Social Security Administration’s disability eligibility guidance.

What to check before relying on a benefit

To understand what you could receive and what rights may apply, review the relevant documents and rules rather than relying on a general percentage or duration. Confirm:

  • Where coverage comes from and whether you are enrolled or otherwise covered.
  • How the policy or program defines disability and which conditions or causes it covers.
  • Any waiting period, filing deadline, and required medical evidence.
  • The earnings basis, replacement rate, maximum benefit, offsets, and interaction with paid leave.
  • The maximum payment period and circumstances that could end benefits sooner.
  • Whether separate FMLA, ADA, workers’ compensation, or state leave protections may apply.

For a personal claim or leave decision, consult the policy certificate or state program rules and contact your benefits administrator, insurer, or state agency. Only those sources, together with your facts and medical evidence, can establish your eligibility and payment.
