Qualcomm’s patent licensing and chipset sales are separate business functions. Its licensing arm, Qualcomm Technology Licensing (QTL), offers phone makers rights to patents used in cellular devices; its semiconductor business sells chipsets. Qualcomm’s published 5G handset program describes a 3.25% rate for a cellular standard-essential-patent license and 5% for a broader portfolio license, each based on the handset’s net selling price and subject to a per-device cap. Those are public program descriptions—not a universal schedule for every negotiated agreement.
Who licenses the patents—and who sells the chips?
Qualcomm’s FY2025 Form 10-K distinguishes its licensing and semiconductor businesses. QTL is operated by QUALCOMM Incorporated, which owns most of the patent portfolio. Qualcomm Technologies, Inc. (QTI) runs substantially all engineering, research and development, and product businesses, including Qualcomm CDMA Technologies (QCT), the chipset business. That corporate distinction means a patent license is a separate commercial arrangement from buying a Qualcomm modem or other chipset. It does not, by itself, settle legal questions about alleged ties between chip supply and licensing, or establish what happens to a manufacturer’s licensing obligations if it uses a competing modem.
What rights can a phone maker license?
Qualcomm says it offers worldwide licenses to its cellular standard-essential patents (SEPs)—patents it considers necessary to implement cellular standards such as 3G, 4G and 5G. It also offers broader portfolio licenses that add other Qualcomm patents, including patents that are not essential to a standard but may be useful in licensed products. Qualcomm says it informed standards bodies of patents and applications that might be essential to 3GPP standards and committed to offer licenses for essential patents consistent with its commitments to those bodies. How are royalties calculated and paid?
Qualcomm’s FY2025 filing says QTL revenue consists primarily of per-unit royalties, with licensees generally paying quarterly based on sales of products incorporating or using licensed intellectual property. The filing says the usual calculation is a percentage of the licensee’s wholesale selling price of the complete licensed product, less certain permitted deductions. The brochure’s “net selling price” wording and the filing’s general description of a wholesale-price base should not be collapsed into one assumed formula. The applicable base, deductions, minimums and other terms depend on the relevant program and negotiated agreement; the public materials do not disclose every licensee’s contract.
How do standards commitments fit into the model?
Cellular standards let devices and networks interoperate. If a patent is essential to implementing a standard, a device maker may need permission to use it to build a compliant product. Qualcomm says it committed to offer licenses for its essential patents on terms consistent with its commitments to standards bodies. The specific legal and commercial terms of an individual license are not established by that general commitment alone.

What recent agreements show—and what they do not reveal
Announcements can confirm that licensing relationships change, but they do not necessarily disclose royalty rates or other financial terms.
- Huawei: On October 5, 2026, Qualcomm announced a multi-year broad patent license agreement involving cross-licenses across 5G, computing, AI and networking, as well as Qualcomm’s purchase of certain Huawei U.S. patents. - Apple: A Qualcomm announcement dated September 24, 2026 said the global patent license agreement with Apple was renewed, with the renewal effective April 1, 2027. Which Qualcomm licensing program applies to phones?
The handset program should not be confused with Qualcomm’s separate cellular IoT licensing program. Qualcomm says certain IoT products using third-party cellular modules may be covered through a module supplier’s license, and it offers a direct-license option for certain asset trackers, smart meters, payment terminals and industrial products using CAT-M or LTE CAT 1–4.
