NRIs can generally remit rental income from India as current income after accounting for applicable Indian taxes. Property-sale proceeds follow a different route: eligibility depends on how the property was acquired and funded, its type, and the relevant RBI conditions. Before transferring either kind of money abroad, identify the correct route, settle or provide for tax, and get the chosen authorised dealer bank’s document requirements for your specific transaction.
First distinguish rent from property-sale proceeds
“Repatriation” means sending money out of India through an authorised dealer bank, or crediting it to an account from which it can be converted into foreign currency. The Reserve Bank of India (RBI) uses a specific regulatory definition: “’Repatriation outside India’ means the buying or drawing of foreign exchange from an authorised dealer in India and remitting it outside India through banking channels or crediting it to an account denominated in foreign currency or to an account in Indian currency maintained with an authorised dealer from which it can be converted in foreign currency.”

The first decision is what the money represents. Rent is current income; money received when you sell a property is a capital receipt. They do not automatically share the same remittance permission, even if both are held in an Indian bank account. For a sale, the property’s acquisition and funding history can determine whether a specific property-sale permission is available or whether the annual asset-remittance facility is the relevant route.

| Rent | Current-income remittance from an NRO account, or in eligible cases through a route for an NRI without an NRO account | Are applicable taxes paid or provided for, and does the bank accept the supporting certification? |
| Property-sale proceeds | A property-sale route for qualifying foreign-exchange-funded purchases, or a separate asset-remittance route that may cover rupee-funded, inherited, or legacy property | How was the property acquired and funded, what type of property is it, and which permission applies? |
These are permissions and compliance routes, not a guarantee that a bank will approve a transfer without checking the transaction. RBI places responsibility on the authorised dealer to examine the information and documents.

How to remit rental income
Using an NRO account
RBI lists rent among current income that may be remitted from an NRO account. Current-income treatment describes the remittance route; it does not make rent tax-free. NRO income is taxable, and the applicable Indian tax must be addressed before the bank permits the remittance.
Keep records that show the source and amount of the rental income and the tax position. The authorised dealer may allow the eligible amount to be remitted net of applicable taxes, after it has obtained declarations and other information sufficient to satisfy itself that the transaction complies with FEMA.
If you do not maintain an NRO account
RBI directions describe a route under which an authorised dealer may allow an eligible NRI who does not maintain an NRO account to remit current income. The bank must receive a chartered accountant’s certification that the amount is eligible for remittance and that applicable taxes have been paid or provided for. This is not an automatic alternative for every person or payment: confirm eligibility and the bank’s required certificate and supporting papers before arranging the transfer.
How property-sale proceeds are routed
For a sale, start with the acquisition record rather than assuming that all sale proceeds qualify under one general limit. The principal distinctions are the property’s funding source, whether it was acquired while the owner was resident or non-resident, whether it was inherited or received as a legacy asset, and the property type.

| Acquisition and funding history | Potential RBI route | Important conditions |
|---|---|---|
| Property bought with eligible foreign exchange received through banking channels, or with funds in an NRE or FCNR account | Specific property-sale repatriation permission | The acquisition must comply with applicable foreign-exchange rules. For residential property, this route is limited to no more than two properties. Agricultural land, farmhouses, and plantation property are excluded from this NRI/OCI sale permission. |
| Property bought as a resident or with rupee funds; inherited or held as a qualifying legacy asset | Potential use of the USD 1 million per-financial-year asset-remittance facility | Eligibility, documentation, and applicable tax compliance must be established. The financial year runs from April through March. |
| Property or proceeds outside the applicable route, or a remittance beyond the relevant permission or limit | Case-specific review; prior RBI permission may be required in some cases | Do not assume an authorised dealer can remit the amount automatically. Certain cases, including assets acquired under FEMA section 6(5), require particular attention. |
When the foreign-exchange-funded purchase route may apply
RBI’s immovable-property regulations allow an authorised dealer to permit repatriation of sale proceeds where the property was acquired in accordance with the applicable foreign-exchange rules and the purchase consideration was paid using foreign exchange received through banking channels or funds held in an NRE or FCNR account. If the property is residential, no more than two such properties may be repatriated under this route. The permission described here does not cover agricultural land, farmhouses, or plantation property.
Be ready to show both that the property was lawfully acquired and how the purchase consideration was paid. A property’s present ownership status alone may not establish that the funding conditions for this route were met. If your records show mixed funding or do not clearly establish the source, ask the bank to assess the case before you rely on this permission.
When the USD 1 million annual facility may apply
RBI directions provide an eligible NRI/PIO route for remitting up to USD 1 million per financial year from NRO balances, sale proceeds, and qualifying inherited or legacy assets. The directions require documentation supporting acquisition, inheritance, or legacy status and applicable tax compliance. The USD 1 million figure is the annual limit for this facility, as reflected in RBI’s 2016 remittance-of-assets directions; it is not a universal cap on every property sale. A qualifying sale under the separate foreign-exchange-funded property route is not simply subject to this facility’s limit.

Property type and unusual cases matter
The property-sale permission tied to foreign-exchange-funded acquisition specifically excludes agricultural land, farmhouses, and plantation property. Do not apply its residential-property conditions to those categories as if the same permission covered them. Where the property type or the acquisition history places the case outside a stated route, the bank may need to consider whether another permission applies or whether prior RBI approval is required.
How NRE and NRO accounts affect the transfer
NRE and NRO accounts are not interchangeable. RBI describes NRE balances as repatriable. NRO balances are generally non-repatriable except for current income and specified permitted remittances, including eligible remittances of up to USD 1 million per financial year. Rent may be credited to an NRO account as current income, but the account label by itself does not establish that every balance can be freely sent abroad.
For sale proceeds, establish which permission covers the underlying asset and how the proceeds will be held and remitted. Ask the bank to confirm the account route it will accept for your case rather than transferring funds between accounts on the assumption that doing so changes their source or eligibility.
Tax, withholding, and remittance forms
Address Indian tax before initiating the transfer
Applicable Indian tax must be paid or provided for before the eligible amount is remitted. Tax on rental income and tax arising from a property sale are different questions; the amount due depends on the person’s and transaction’s facts. The remittance permission does not determine your final tax liability, tax rate, capital gain, or eligibility for treaty relief. Obtain advice from an India-qualified tax professional where needed, and confirm with the bank what evidence of tax compliance it requires.

Form 15CA and Form 15CB
Form 15CA is filed before remittance when required. The Income Tax Department describes four parts, selected according to the remittance’s chargeability, amount, and any relevant Assessing Officer order or certificate:
| Form 15CA part | When the Income Tax Department describes it as applicable |
|---|---|
| Part A | Chargeable remittances up to ₹5 lakh in a financial year. |
| Part B | Chargeable remittances above ₹5 lakh where the specified Assessing Officer order or certificate has been obtained. |
| Part C | Chargeable remittances above ₹5 lakh accompanied by Form 15CB. |
| Part D | Remittances that are not chargeable. |
The ₹5 lakh threshold and the parts above describe specified Form 15CA filing situations; they are not a general tax-free allowance or a limit on how much property proceeds may be repatriated. Form 15CB is not universally mandatory. Where relevant, a chartered accountant’s certificate addresses the nature of the payment and tax determination, including applicable treaty considerations. Which filing path applies depends on the payer, amount, chargeability, and whether an Assessing Officer order or certificate exists. Check the live Income Tax Department guidance and have the bank or tax professional confirm the appropriate filings for the actual remittance.
Property purchases from non-resident sellers from 1 October 2026
For a transfer on or after 1 October 2026 in which a resident individual or Hindu Undivided Family (HUF) buys immovable property from a non-resident seller, the Income Tax Department’s Form 141 guidance says Schedule E applies to TDS reporting under section 393(2) of the Income-tax Act, 2025. The guidance says that, from that date, this reporting route replaces the earlier requirement for the resident individual or HUF purchaser to obtain a TAN and report using Form 144 for such transactions. This is a reporting change for the purchaser; it does not itself determine the seller’s final tax liability or the RBI route for remitting the proceeds. Verify the forms and tax treatment against the actual transaction date.

Documents and bank review
RBI does not publish one universal checklist for every rent remittance and property sale. It directs authorised dealers to obtain declarations and other information that reasonably satisfy them the transaction complies with FEMA, and to verify the material facts. Banks can therefore request different evidence depending on the route, transaction, and account.

Before you initiate a transfer, request the chosen authorised dealer’s current checklist and ask it to confirm the proposed route. Depending on your facts, useful records may include:
- Documents showing title, acquisition date, and how the property was acquired.
- Evidence of the purchase consideration’s funding, such as records of inward foreign exchange or eligible NRE/FCNR funds, where you rely on that route.
- Sale documents and evidence of the proceeds received, or rental records showing the income being remitted.
- Inheritance or legacy documents if you rely on the asset-remittance facility on that basis.
- Evidence that applicable tax has been paid or provided for, together with the required tax forms or chartered accountant certification.
This is a list of records that may be relevant, not a substitute for the bank’s case-specific document list. Keep copies of the records and remittance paperwork together in case the bank needs to clarify the source or eligibility of the funds.
A practical sequence before sending money abroad
- Classify the payment. Decide whether the funds are rental income or proceeds from a property sale; do not use the sale route for rent or treat sale proceeds automatically as current income.
- For a sale, document the acquisition history. Establish whether you bought the property as a resident or NRI/OCI, inherited or received it as a legacy asset, and whether the consideration came through inward foreign exchange, NRE/FCNR funds, or rupee funds.
- Check the property category and route conditions. Confirm whether the property is residential, agricultural land, a farmhouse, or plantation property. If relying on the foreign-exchange-funded residential route, establish whether the two-property ceiling applies to your case.
- Settle the tax and filing questions. Determine applicable Indian taxes, whether tax has been paid or provided for, and which Form 15CA or Form 15CB requirements apply. For a relevant purchase from a non-resident seller on or after 1 October 2026, check the Form 141 Schedule E guidance.
- Get the bank’s approval path and checklist. Ask the authorised dealer which RBI route it will use, what declarations and records it requires, and whether it needs further permission or review before transfer.
- Submit the documents and retain proof. Keep the bank’s remittance records with the acquisition, sale or rental, funding, and tax documents supporting the transfer.
When the route is uncertain
Pause before treating the funds as freely repatriable if the property has mixed or undocumented funding, the acquisition history is unclear, the property falls into an excluded category, the relevant annual facility may be exceeded, or the bank cannot confirm an available permission. RBI materials contemplate prior permission in certain cases, including some assets acquired under FEMA section 6(5); whether that applies is fact-specific. Ask the authorised dealer and an India-qualified tax professional to review the facts before initiating a transfer. Citizenship, FEMA residence status, title, property type, source of funds, transaction date, amount, and tax facts can all affect the result.
