There is no universal professional-liability limit for freelance designers. Start with the client contract: identify the required insurance type, per-claim and aggregate limits, deductible, certificate wording, and any additional-insured or waiver provisions. If the contract is silent, choose a limit by weighing the plausible financial impact of an alleged error against the project’s scale, your revenue, assets, and the policy’s actual wording.
Professional liability, also called errors and omissions (E&O), can pay defense costs and covered settlements or judgments arising from alleged negligent professional services. It is not a substitute for general liability, and a certificate of insurance does not expand coverage beyond the policy.

What professional liability covers for a freelance designer
Professional-liability insurance is designed for claims that your professional work caused a client financial loss. A client might allege that a design error, missed requirement, negligent recommendation, or similar service failure caused damage. The insurer may provide a legal defense even when you believe the allegation is wrong; covered defense costs, attorney fees, settlements, and judgments are subject to the policy’s terms and limits.
The exact result depends on the policy form. “Designer” is not a complete description of the work an insurer is covering, so the application should identify the services you actually provide, such as branding, graphic design, web design, UX work, packaging, marketing creative, art direction, or production management.

Professional liability is different from general liability
These policies address different categories of risk. Professional liability concerns alleged mistakes or negligence in your services. General liability is aimed at third-party bodily injury, property damage, and related premises or operations claims. For example, if a client visits your studio and slips, that is the kind of exposure generally associated with general liability rather than professional liability.
Hiscox’s graphic-designer guidance specifically says its professional-liability policy does not cover bodily injury or property damage. Do not treat an E&O limit as proof that you have the general-liability protection a client may separately require.
Read the client’s insurance clause before choosing a limit
The contract is the most concrete starting point because it may define both the amount and the evidence the client expects. AIGA’s Standard Form of Agreement for Design Services notes that “Large clients often specify minimum insurance levels for the designer’s business.” A large company, government contractor, venue, or regulated-sector client may also require particular endorsements or certificate language.
Identify the required insurance type
Check whether the clause asks for professional liability, errors and omissions, general liability, workers’ compensation, cyber coverage, or several policies. “Liability insurance” by itself is ambiguous. Ask the client or its procurement contact to confirm which policy must carry the stated limit.

Separate each limit the contract mentions
Look for a per-claim (or each-claim) limit and an aggregate limit. A $1 million per-claim limit with a $1 million aggregate is materially different from a $1 million per-claim limit with a $2 million aggregate. The aggregate is the most the policy will pay for all covered claims during the policy period, subject to the form’s rules.
Also look for a deductible or self-insured retention, a required policy period, a retroactive date, and any requirement that coverage remain in force after the project ends. If the wording is unclear, obtain clarification in writing before purchasing or signing.
Check certificate and endorsement requirements
A certificate of insurance normally summarizes existing coverage; it does not rewrite the policy. The contract may request the client be shown as an additional insured, a waiver of subrogation, notice provisions, or another endorsement. Ask the insurer whether the requested language is available for the policy you are buying and whether it applies to professional liability, general liability, or both.
If the contract is silent, use a documented risk decision
Without a contractual minimum, there is no authoritative industry-wide number for freelance designers. Choose a limit by documenting the largest credible loss your work could create and the amount of business risk you can retain.

Map the services and failure modes
- Scope: list every service you sell, including subcontracted production, strategy, content, implementation, or launch support.
- Client reliance: note whether the client will use the work in a national campaign, a product package, a public-facing website, a regulated communication, or an internal project.
- Potential correction cost: estimate redesign, reprinting, redevelopment, rush production, and outside legal costs if an alleged error is disputed.
- Contract exposure: flag indemnities, warranties, liquidated damages, intellectual-property promises, confidentiality obligations, and broad “all losses” language. Ask an agent how the policy treats each provision rather than assuming a contract makes it covered.
Match the limit to the project, not just annual revenue
Annual revenue helps an insurer price the risk, but it does not cap a client’s potential loss. A small studio can work on a high-value launch, and a single alleged mistake can consume defense costs before any settlement is considered. Conversely, a low-value, low-reliance project may not justify buying a very high limit if the contract does not require it. The decision should reflect the largest plausible claim from your actual work, not a generic number copied from another designer.
Consider what you could pay yourself
Compare the proposed deductible and uncovered costs with cash reserves and business assets. A high limit with a deductible you cannot fund is not a practical plan. Ask whether defense expenses reduce the liability limit; if they do, legal fees can leave less available for settlement or judgment.
Limits commonly available and figures that are not universal recommendations
Hiscox describes professional-liability options for designers up to $2,000,000 and says higher limits may be considered on request when a contract requires them. That is an insurer-specific availability statement, not a rule that every freelance designer needs $2 million.
The same Hiscox contract guidance says most standard contracts require at least $1,000,000 of general liability. That figure concerns general liability and should not be converted into a universal professional-liability benchmark.

| Figure | What it means | How to use it |
|---|---|---|
| Up to $2,000,000 | Professional-liability limits described by Hiscox for designers; higher limits may be considered on request. | Use only as an indication of one insurer’s available limits when matching a contract. |
| At least $1,000,000 | General-liability minimum described by Hiscox as appearing in most standard contracts. | Do not treat it as a professional-liability recommendation. |
Compare quotes on more than the headline limit
Request quotes at comparable limits and deductibles, then compare the policy forms. A lower premium can reflect narrower services, a larger retention, defense costs inside the limit, or more exclusions.
| Item to compare | Questions to ask |
|---|---|
| Covered professional services | Does the description include your actual graphic, web, UX, marketing, product, and production work? Are subcontractors’ services addressed? |
| Per-claim and aggregate limits | What is the limit for one claim, and what is the total available for the policy period? |
| Defense-cost treatment | Are defense expenses inside the liability limit or paid separately? When does the insurer’s duty to defend apply? |
| Deductible or retention | What amount do you pay, and does it apply to defense, indemnity, or both? |
| Exclusions | How does the form treat intellectual-property, copyright, confidentiality, contractual-liability, intentional-act, or fraud allegations? |
| Claims-made conditions | What is the retroactive date? How must circumstances and claims be reported? Is an extended reporting or tail option available? |
| Geography | Where may the work be performed, and where must a claim be filed for coverage to respond? |
| Contract services | Can the insurer issue the certificate and endorsements the client’s clause actually requests? |
| Total cost | Compare premium and payment terms only after the limits, deductible, and wording are equivalent. |
Claims-made conditions, retroactive dates, continuity provisions, and reporting options vary by policy form. The available materials do not establish a universal wording, so confirm each item in the quotation and policy documents.

Hiscox publishes examples showing why price cannot be inferred from the limit alone. One illustration is a California information-technology consultant with a $500,000 limit, a $5,000 deductible, and a premium of $42.92 per month. Another is a Florida business consultant with a $1,000,000 limit, a $500 deductible, and a premium of $102.46 per month. These are consultant examples, not quotes or averages for freelance designers.

Coverage wording can matter more than the limit
Professional-service definition
If your application says only “graphic design” but you also provide website implementation, marketing advice, copy coordination, or production supervision, an alleged loss may not fit the policy’s professional-services definition. Describe the full mix of work and keep written confirmation of how the insurer classifies it.
Intellectual-property and contract allegations
AIGA notes that professional liability may be relevant to intellectual-property infringement or errors and omissions. That does not mean every copyright, trademark, license, or contractual claim is covered. Ask for the actual exclusion language and whether any limited coverage or endorsement applies.
Intentional, fraudulent, bodily-injury, and property-damage claims
Hiscox’s designer description excludes fraudulent acts, bodily injury, and property damage from the professional-liability policy it describes. Intentional misconduct is treated differently from an accidental error, and bodily-injury or property-damage allegations may belong under another policy. Never infer coverage from the policy title alone.

Worldwide work and filing location
Hiscox describes worldwide work coverage when the covered claim is filed in the United States, a U.S. territory, or Canada. This is an insurer-specific description, not a market-wide promise. If you serve clients abroad, verify both where services may be performed and where a claim may be brought.
Buy the policy in a controlled sequence
- Extract the contract requirements. Copy the insurance clause into a checklist, separating policy types, per-claim and aggregate limits, deductible caps, certificate wording, additional-insured requests, waivers, and deadlines.
- Ask the client to resolve ambiguity. Confirm whether the stated limit applies to professional liability, general liability, or both, and whether the client needs an endorsement rather than a certificate alone.
- Describe your real work to a licensed agent. Include project types, subcontractors, locations, revenue, largest clients, and any unusual contractual promises. Ask specifically about intellectual-property, confidentiality, and contract-related allegations.
- Request comparable quotations. Hold the limit, aggregate, deductible, and payment basis constant while comparing insurers. Obtain the specimen policy or key exclusions, not only a price screen.
- Test the certificate and endorsements. Before binding, have the insurer confirm it can issue the exact evidence the client requests and that the named parties and dates are correct.
- Check claims-made continuity. Record the retroactive date, renewal date, notice procedure, and any extended-reporting option. Report circumstances promptly according to the policy rather than waiting for a formal lawsuit.
- Keep records. Save the application, quote, policy, endorsements, certificates, contracts, and project correspondence. Notify the insurer as soon as a demand or circumstance may trigger the policy.
Common mistakes and how to correct them
- Buying the contract’s general-liability number as E&O: ask which policy the number belongs to and obtain separate limits when required.
- Choosing the cheapest quote: compare defense-cost treatment, deductible, exclusions, services, and aggregate before comparing premium.
- Assuming a certificate guarantees coverage: read the policy and endorsements; the certificate is evidence, not an expansion of rights.
- Leaving new services off the application: update the insurer when your business moves into web implementation, strategy, production, or other materially different work.
- Ignoring the aggregate: several smaller claims can exhaust an annual aggregate even when each individual claim is below the per-claim limit.
- Waiting until a dispute becomes a lawsuit: follow the policy’s notice requirements when you first learn of a demand or circumstance.
U.S. scope and professional advice
The contract practices and insurer descriptions discussed here are U.S.-oriented. Insurance availability, mandatory coverage, court jurisdiction, tax treatment, and policy wording vary by country and state. No universal legal requirement for every freelance designer is established by these materials.
A licensed insurance agent can evaluate your actual services, contract, financial capacity, and jurisdiction. For a high-value or unusually broad agreement, have a qualified attorney review the indemnity and insurance clauses before you sign. Confirm current prices, limits, exclusions, and endorsement availability directly with the insurer because they can change.
