There is no single amount or percentage that every Texas car-accident lawyer gets from a settlement. The fee is determined by the written agreement you signed with your lawyer. Your final payment may also be reduced by case expenses and valid medical liens or reimbursement claims, so the fee alone does not tell you how much you will take home.
What determines the lawyer’s fee?
For a private car-accident claim, start with the contingent-fee agreement. Texas Property Code § 82.065(a) requires a contingent-fee contract for legal services to be in writing and signed by both the attorney and client: Texas Property Code § 82.065.
Texas Disciplinary Rule of Professional Conduct 1.04 requires the agreement to explain how the fee is calculated. It must also state any different fee percentages for settlement, trial, or appeal; describe litigation and other expenses; and say whether expenses are deducted before or after calculating the fee. See Texas Disciplinary Rule 1.04.
Those rules require disclosure; they do not establish a universal percentage or a statewide average for private auto claims. The percentage and calculation method in your own signed agreement are what matter.

How much will you get after the lawyer is paid?
Your net payment is not necessarily the settlement amount minus the lawyer’s fee alone. Depending on the agreement and the facts, the closing accounting may also include case expenses and payments to resolve third-party claims, such as medical liens or an insurer’s reimbursement claim. The applicability and amount of those claims depend on the benefits involved, governing law, agreements, and case facts; they cannot be calculated from the settlement figure alone. The Texas State Bar discusses reimbursement in the specific context of workers’ compensation in its ethics opinion materials. That special context should not be treated as a universal rule for car-accident settlements.
In practical terms, the accounting follows the fee agreement’s stated base and order of deductions. The agreement determines how the fee is calculated and when expenses are deducted; the final accounting then reflects applicable expenses and any resolved third-party claims before showing the amount remitted to you.

Does the lawyer take expenses out before calculating the fee?
It depends on the written agreement. Texas Rule 1.04 requires the contract to state whether expenses are deducted before or after the lawyer’s fee is calculated. Check the agreement’s calculation method and expense section rather than assuming one order applies to every case. Also look for which expenses may be charged and whether the contract sets a cap.
What should the closing statement show?
At the conclusion of a contingent-fee matter, the lawyer must provide a written statement describing the outcome and, if there is a recovery, showing the remittance to the client and how it was determined. The rule’s language is in Texas Disciplinary Rule 1.04(d).

Use the statement to reconcile the settlement with the amount you received. Check for:
- The gross settlement amount.
- The fee basis, applicable percentage, and calculation method in your signed agreement.
- The order in which expenses were deducted and an itemization of those expenses.
- Payments made to resolve any lien or reimbursement claim.
- The final amount remitted to you.
If an item is unclear or does not match the contract, ask the lawyer to explain the calculation and identify the relevant agreement term or claim.

Why a precise estimate requires your agreement and case details
A settlement total by itself does not establish the lawyer’s fee or your take-home amount. You need the fee agreement to know the calculation method and expense order, and you need the closing accounting to see case-specific expenses and any third-party claims. State rules set disclosure requirements, but the sources cited here do not establish a standard private-claim percentage.
