In the United States, people often mean a 40-hour workweek when they say “full-time,” but federal law does not set one weekly-hours definition for every full-time job. Under the Fair Labor Standards Act (FLSA), employers generally determine whether a position is full-time or part-time. A separate 30-hour measure applies only to specific Affordable Care Act employer health-coverage rules.
What counts as full-time under federal law?
The FLSA does not define full-time or part-time employment. The U.S. Department of Labor says that classification is generally determined by the employer. As a result, a job’s full-time label can depend on the employer’s policy rather than a universal federal hours threshold. The Department of Labor’s FLSA FAQ explains this distinction.
Is 40 hours a week full-time?
A 40-hour week is a familiar full-time schedule, not a universal legal definition. The Department of Labor describes a traditional 9-to-5, 40-hour workweek when discussing flexible schedules, while recognizing that work arrangements can differ. Its flexible-schedules guidance uses the 40-hour week as a traditional schedule, not as a rule that determines every job’s status.
Does 30 hours a week count as full-time?
It can count for a specific purpose: under the Affordable Care Act’s employer-shared-responsibility provisions, full-time generally means averaging at least 30 hours of service per week or 130 hours per month. This measure applies to those employer health-coverage rules; it does not automatically make a 30-hour position full-time for every employer policy, benefit, or legal purpose. How is full-time status different from overtime?
Overtime rules address pay, not whether a position is classified as full-time. Under federal law, covered nonexempt employees generally must receive overtime pay for hours worked over 40 in a workweek. The workweek is a fixed, regularly recurring period of 168 hours—seven consecutive 24-hour periods—and does not have to match the calendar week. How to check whether your job is full-time

Check the employer’s written policy. Look for the stated hours or eligibility definition in your offer documents, handbook, or benefits materials.

Identify the specific benefit or rule. Health coverage, paid leave, retirement plans, and overtime can have different eligibility terms; a full-time label alone does not establish that you qualify for every benefit.

Confirm which law applies. The figures above describe U.S. federal guidance. State or local rules, contracts, collective bargaining agreements, and benefit-plan terms may also matter. Outside the United States, consult the relevant country’s law and your employer’s policy.
