It says it protects a whistleblower’s identity, and even the fact that the person provided information, to the maximum extent the law allows. Separately, Internal Revenue Code section 6103 generally makes tax returns and return information confidential. Neither rule is an absolute promise of secrecy: statutes permit certain disclosures, including limited notices to whistleblowers and disclosures in some tax-administration proceedings.
Two different kinds of confidential information
A whistleblower claim involves information about at least two people: the person reporting suspected tax noncompliance and the taxpayer or entity being reported. The law does not treat all information in a claim as one protected file with one confidentiality rule. It is more useful to distinguish the reporter’s identity from the target’s tax records.

The whistleblower’s identity
The IRS says it protects a whistleblower’s identity and even the fact that the person provided information “to the maximum extent that the law allows.” That qualification matters. It describes the agency’s approach within legal limits; it is not a guarantee that a person’s identity can never be disclosed, inferred, or discovered through another route. The IRS’s statement is on its Whistleblower Office page.

Identity protection also does not mean an award claim is anonymous to the IRS. A person applying for an award files Form 211 and supplies identifying and contact information. The IRS therefore knows who the claimant is, even while it seeks to protect that identity from disclosure beyond what law permits.

The target’s tax information
Internal Revenue Code section 6103(a) establishes the general rule that tax returns and return information are confidential, subject to statutory exceptions. This is the rule relevant to a taxpayer’s return information; it is not the source of a blanket promise that a whistleblower will remain unknown. The IRS describes the rule and its exceptions in its Whistleblower Office information and its explanation of the whistleblower law.
Return information is broader than the pages of a filed return. It can include information collected or generated in administering tax laws. But the fact that a whistleblower submitted a tip does not give that person general access to the target’s complete tax file. Any information disclosed to a claimant is bounded by statutory authorization and the circumstances in which disclosure is made.
What section 6103 allows the IRS to disclose
Confidentiality is a strong default, not a rule without exceptions. The statutes allow specified disclosures for tax administration, including certain information shared in administrative or judicial proceedings. The IRS explains that section 6103(h)(4) authorizes some disclosures in proceedings pertaining to tax administration, and that a whistleblower administrative proceeding under section 7623 is such a proceeding.
Limited notices to a whistleblower
Section 6103(k)(13) authorizes certain notices and information for whistleblowers under statutory conditions. The categories include notice that information has been referred for an audit or examination, notice that a related tax payment has been made, and information about the status and stage of a related investigation or action. These provisions give a claimant some process visibility; they do not amount to a right to inspect the taxpayer’s return, examination file, or every enforcement decision.

Congress added whistleblower notice procedures through the Taxpayer First Act, signed on July 1, 2019. The Act amended sections 7623 and 6103 and also included whistleblower retaliation protections. The IRS summarizes the changes in its guidance on whistleblower reforms under the Taxpayer First Act.
Proceeding-related disclosures
Some information may be disclosed as part of an administrative or court proceeding even though it would not be provided as a routine status update. A proceeding can require the IRS or a court to consider information relevant to a claim or appeal. The legal basis and scope depend on the proceeding and applicable statutory conditions; the existence of a whistleblower claim alone does not mean every participant sees the target’s return information.
What an award claimant must provide
A person seeking an award submits Form 211, Application for Award for Original Information. The IRS requests the claimant’s identity and contact information, details identifying the person or entity reported, a specific and credible account of the alleged noncompliance, available supporting documents, how and when the claimant learned the information, and the claimant’s relationship to the subject. The IRS’s current submission guidance is at Submit a whistleblower claim for award.

A claim is not a way to pass a tip anonymously while preserving eligibility to receive an award. The claimant identifies themself to the IRS and makes a declaration under penalty of perjury. If a person wants to provide information without becoming an award claimant, the IRS has other reporting channels, including anonymous reporting options. Anonymous reporting and filing an award claim are distinct routes, not interchangeable versions of the same application.

When preparing a claim, describe the suspected conduct accurately and distinguish what you personally know from what you infer. Include available supporting material and explain how it was obtained. Do not assume that submitting documents automatically makes their contents confidential in every setting or authorizes access to records you otherwise may not use. The IRS says it generally conducts a taint review to address legal, ethical, evidentiary, and privilege concerns; material considered tainted generally will not be used.
There is an additional concern for someone who currently represents the taxpayer or entity being reported. The IRS says such a representative may face limits on continuing that representation after making a whistleblower submission. A person in that position should consider the professional obligations and consequences before filing. The IRS’s claim guidance discusses both taint reviews and representative issues.
What the IRS may tell you after you file
A claimant should expect limited process information rather than a running account of the target’s tax affairs. Under the whistleblower notice provisions, the IRS says it will notify a whistleblower when a case is referred for audit or examination and when a related tax payment is made. The notices do not establish why the IRS acted, what the target’s complete tax position is, or whether the claimant will receive an award.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteA referral notice is not proof an audit began
A notice that information was referred for audit or examination means the information reached that procedural stage. It does not prove that an examination was opened, completed, or resulted in an adjustment. Nor does it guarantee that the IRS will use the information in a way that produces an award. The IRS describes these limits in its Taxpayer First Act whistleblower guidance.

A payment notice is not an award decision
A notice that a related tax payment was made is likewise not an award determination. It does not establish that the IRS acted because of the whistleblower’s submission, that all relevant amounts have been collected, or that an award has been approved. The IRS’s general award guidance describes a range of 15% to 30% of proceeds collected that are attributable to the information, but that is not a guaranteed payment and is separate from confidentiality protections. Eligibility and award decisions depend on the governing rules and the facts of a claim.
Requests for claim status
Written requests for claim status must meet the requirements in IRS Publication 5251. The publication, revised August 2026, explains the claim process and timeline. It also says the IRS generally will not disclose whether it took particular enforcement actions when disclosure could seriously impair federal tax administration. Because procedures and publication details can change, use the current Publication 5251 for the applicable request requirements rather than relying on an old form, address, or checklist.

The IRS’s stated policy is to protect the whistleblower’s identity and the fact of the submission as far as the law allows. That supports a qualified answer, not an absolute one: the IRS does not promise that a reported taxpayer can never learn or infer who supplied information. The identity protection is constrained by law, and the surrounding facts or a proceeding may affect what is disclosed or what can be inferred.

Do not confuse a taxpayer’s possible knowledge of a reporter with an IRS disclosure of the reporter’s identity. A target might suspect a person based on circumstances outside the IRS’s communications. Conversely, the fact that the IRS protects identity does not erase the possibility of authorized disclosures in legal proceedings. The available official guidance does not establish that every whistleblower is identified to the target, or that identification routinely occurs.

Can a whistleblower see the taxpayer’s return?
Filing a claim does not give the whistleblower a general right to the target’s return or tax records. Section 6103 protects return information subject to exceptions, and the notice rules give only specified information about referrals, payments, and status or stage. Any disclosure in a proceeding is governed by the relevant legal authority and context, not by a general right to review the taxpayer’s file.
There is a notable qualification in the IRS’s own reporting. In its Whistleblower Office Annual Report 2024, the IRS discusses Whistleblower 972-17W v. Commissioner, 159 T.C. 1 (2022). The agency says the court’s interpretation of section 6103(h)(4)(A) can permit broader disclosure of a target’s return information in some whistleblower appeals than the IRS had previously provided.
The report also raises a concern about possible redisclosure of third-party return information that is disclosed during administrative claim-file reviews or Tax Court proceedings. The IRS notes that the Tax Court may use protective orders, but says such orders are not statutorily required in every situation, and describes a need for statutory clarification. This is the IRS’s identified concern about particular proceedings; it should not be read as evidence that every claimant receives a target’s returns or that redisclosure is routine.
How to think about the two reporting routes
| Route | Identity given to the IRS | Award claim | Information and follow-up |
|---|---|---|---|
| Anonymous reporting through another IRS reporting channel | Anonymous options exist, depending on the channel. | An anonymous tip by itself is not a Form 211 award claim. | Do not assume the channel provides award-claim notices or status information; the award process requires an identified claimant. |
| Form 211 award claim | The claimant supplies identifying and contact information and signs a declaration under penalty of perjury. | This is the route for an individual seeking an award for original information, subject to applicable requirements. | The IRS may provide authorized referral, payment, and status or stage information, but not unrestricted access to the target’s tax records. |
The route comparison follows the IRS’s claim submission guidance and the statutory framework summarized in its whistleblower law explanation. The choice is about more than whether to reveal a name: it determines whether the person is applying for an award and what process notices may be available.
Practical expectations before submitting information
- Separate the confidentiality questions. Ask separately how the IRS protects your identity and what limits apply to the target’s return information. The two protections come from different rules.
- Decide whether you are making an award claim. If you seek an award, the IRS requires an identified Form 211 claimant; do not treat an anonymous report as a substitute.
- Submit a clear, supportable account. Identify the subject, describe the suspected noncompliance specifically, explain how and when you learned the facts, and provide supporting documents that you can appropriately submit.
- Consider privilege and representation issues. The IRS’s taint review and guidance on representatives make these important questions, particularly if you obtained material through a professional relationship or currently represent the reported party.
- Set expectations about updates. A referral or payment notice is a limited procedural communication, not a finding that the tip caused an enforcement action or that an award will be issued.
- Use current IRS procedures. For claim-status requests, consult the current Publication 5251, which sets out written-request requirements and explains when disclosure may be withheld to avoid serious impairment to tax administration.
Why confidentiality should be described carefully
It is inaccurate to say either that a whistleblower is guaranteed anonymity or that a claimant routinely gets the target’s tax records. The IRS’s own language is qualified: identity and the fact of a submission are protected to the maximum extent the law allows. Section 6103 separately makes taxpayer returns and return information confidential, while statutes authorize particular notices and disclosures in defined settings.
For an individual deciding whether to report suspected noncompliance, the practical distinction is straightforward. An award claim identifies the claimant to the IRS, while the agency limits what it provides about the target and protects the claimant’s identity within legal bounds. Proceedings can complicate those protections, and the IRS has flagged a specific concern about disclosure and possible redisclosure in some appeal contexts. Those limits are reasons to understand the process before filing, not evidence that the usual protections do not apply.
