How India’s GST Reforms Affect Small Businesses, Freelancers and Consumers

India’s GST reforms include rate changes effective in September 2025 and separate process recommendations announced in October 2026. Here’s what each round means for businesses, freelancers and consumers.

India’s GST changes came in two separate rounds: the 56th GST Council meeting recommended major rate changes, most effective from 22 September 2025, while the 57th meeting on 8 October 2026 recommended process changes covering registration, returns, refunds and trade facilitation. The first round can affect the tax charged on particular goods and services; the second includes proposals that should not be treated as live options until the relevant rules and portal features are in force.

Two reform rounds, with different effects

The GST Council’s 56th meeting, held on 3 September 2025, recommended rationalising the previous multi-tier rate structure toward standard 18% and merit 5% rates, alongside a special 40% rate for selected goods and services. It also recommended exemptions for individual life and health insurance policies and rate reductions on a range of goods. The Ministry of Finance’s follow-up FAQ says the relevant changes for goods and services, other than specified tobacco products, took effect on 22 September 2025.

The 57th meeting, held on 8 October 2026, focused instead on the way taxpayers register, report and reconcile tax, and obtain refunds. Its release describes recommendations and an in-principle concept note; those are not automatically equivalent to an operative rule or an available GST portal feature.

The distinction matters: a rate change does not itself alter registration eligibility, and a process recommendation does not necessarily give a taxpayer a new filing route today. For the operative position, use the relevant notification and current GST portal guidance, not the Council announcement alone.

What the 2025 rate changes mean for businesses

Identify the correct rate for the exact supply

A business cannot determine its rate from the broad labels “small business,” “freelancer” or “consumer.” The applicable rate depends on the precise goods or service, the transaction and its timing, and the applicable notification. The 56th-meeting FAQ explains that time-of-supply provisions determine which rate applies around a rate change. A general announcement that rates have been rationalised is not a substitute for checking the classification and notification for a particular supply.

This is especially important for transactions close to 22 September 2025. If an invoice, payment or supply falls on different sides of the change date, do not assume that the invoice date alone settles the rate. Apply the relevant time-of-supply rules to the facts and preserve the records needed to support that treatment.

Account for input tax credit under the applicable rules

For a registered business, eligible input tax credit (ITC) on a purchase is tied to tax properly charged at the rate prevailing when the inward supply occurred, and remains subject to statutory conditions. A later rate change does not automatically rewrite the tax charged on an earlier purchase. Check the underlying supply date and supporting tax documents before changing an ITC claim or attempting to reconcile a difference.

For purchases and sales around the transition, keep invoices and other transaction records that let your accounts team match the supply, payment and tax treatment. If a supplier’s invoice appears inconsistent with the applicable rate or timing, resolve the discrepancy through the appropriate records and rules rather than assuming that a new headline rate applies retroactively.

Do not infer a business’s net savings from a lower rate

A rate reduction may change tax charged on an affected supply, but it does not by itself establish how much a business saves overall. The outcome depends on what it buys and sells, the tax treatment of those transactions, its eligibility to claim ITC and the price ultimately charged. The official materials on these reforms do not provide a measured causal estimate of small-business cost reductions or household savings.

What the 2026 process recommendations could change

A targeted route for some small e-commerce goods sellers

The 57th meeting recommended a simplified registration mechanism for certain small suppliers of goods using e-commerce platforms. Under the stated proposal, a qualifying seller could use an e-commerce operator’s warehouse as its principal place of business in a state or union territory where it has no physical presence, subject to conditions and automatic system registration. The described route also includes an intended monthly ITC pass-through limit of ₹2.5 lakh.

This is a specific, conditional pathway—not a general exemption from registration, a universal marketplace-registration service or permission to use any warehouse without meeting the conditions. A seller should not restructure registrations based only on the Council release. Confirm that final rules and portal instructions have implemented the mechanism, then check that the business, goods, warehouse arrangement and relevant state or union territory meet its eligibility conditions.

Return reconciliation and electronic statements

The Council’s recommendations include measures intended to improve reconciliation between outward-supply details and GSTR-3B, as well as electronic statements for reverse-charge tax and credit reversal or reclaim. These areas matter to finance teams because differences between sales reporting, tax liability and ITC records can create follow-up work and uncertainty.

The announcement describes intended process improvements, not proof that a specific statement or automated reconciliation is already available in every taxpayer’s portal account. Before changing a filing workflow, check the current portal screens, instructions and applicable rules. Keep the underlying invoices and calculations available even if an electronic statement becomes available; a statement can support review but should not be treated as a substitute for verifying the transactions.

ARQP remains an in-principle concept unless implemented

The 57th meeting approved in principle an optional Annual Return Quarterly Payment (ARQP) concept note. The described potential eligibility is for taxpayers with preceding-financial-year aggregate turnover of no more than ₹5 crore who make supplies exclusively to unregistered persons (B2C). The Council release does not establish that taxpayers can currently elect this scheme.

Before relying on ARQP, check whether it has been implemented in current GST rules and whether the GST portal provides applicable election and filing guidance. If it is implemented, a taxpayer would still need to confirm both conditions: the relevant preceding-year turnover and the requirement to supply exclusively to unregistered persons. The concept note should not be treated as a filing option merely because it has a name or an announced threshold.

Refunds, adjudication and trade facilitation

The 57th meeting also recommended process measures concerning refunds, adjudication and trade facilitation. These are relevant to businesses that export, seek refunds or are involved in tax proceedings, but the meeting summary alone does not establish a revised deadline, document list or procedural right for an individual case. Use the operative notification, current instructions and case-specific rules to determine what applies; do not assume a recommendation has already changed a statutory process.

What freelancers should check

A freelancer’s GST obligations depend on the nature and location of the supply, the customer, turnover and the registration provisions that apply to that fact pattern. The 2025 rate-reform FAQ establishes that the reforms did not change the CGST registration threshold for goods. That statement is not a complete answer for service providers and does not decide whether a particular freelance occupation must register.

  • Identify the service supplied and check its current GST treatment and any relevant notification.
  • Assess registration using the rules that apply to the freelancer’s actual supplies, location, customers and turnover; do not rely on a statement about the threshold for goods as if it covered all services.
  • If registered, check the rate and time-of-supply treatment for the service, and retain records supporting eligible ITC claims.
  • For transactions near a rate-change date, apply the time-of-supply provisions rather than choosing a rate based only on when an invoice was issued.

The official materials discussed here do not determine the registration status of every freelance occupation or individual situation. Where the facts are unclear, obtain advice based on the actual supply and applicable rules instead of treating a broad summary as a ruling.

What consumers may notice

Insurance exemptions and the premium a customer pays

The 56th-meeting rate decisions included an exemption for individual life and health insurance policies. The official follow-up FAQ describes the exemption as applying to individual life and health insurance supplied to an individual or an individual with family, and also describes related ITC treatment for insurers. A consumer should check the policy and current treatment rather than assume that every insurance product or arrangement is covered by the description.

An exemption does not, on its own, establish how much a customer’s final premium will fall. The official materials state the tax measure but do not provide a measured estimate of the resulting premium savings or prove how an insurer’s final price changes. Compare the actual premium and policy terms offered; do not infer a particular saving from the tax change alone.

Product rates require product-specific checks

The follow-up FAQ gives examples that show why a single rate headline cannot stand in for a full rate list: drones received a recommended uniform 5% rate, while categories such as hotel accommodation have their own conditions and ITC treatment. These examples are not an exhaustive schedule. A consumer checking a bill should identify the exact product or service and use the applicable current notification; a category name in a news summary may be too broad to establish the tax on a particular purchase.

Consumers may see a lower GST amount on an affected item, but the change does not guarantee an equivalent fall in the retail price. The seller’s price is distinct from the tax rate, and the official releases do not quantify realized household savings attributable to the reform.

How to verify which rule applies

  1. Pin down the transaction. Record what was supplied, by whom, to whom, where and when. For a rate transition, note the relevant supply, payment and invoice details needed to apply time-of-supply provisions.
  2. Separate rate from registration. Check the rate notification for the supply, then assess registration under the provisions applicable to that taxpayer. A change in the rate does not itself change registration status.
  3. Check whether an announced measure is operative. For 2026 process changes, look for the implementing rule, notification or live portal guidance. Treat recommendations and the ARQP concept note as proposals unless implementation is confirmed.
  4. Review ITC against the underlying transaction. Match the tax charged, purchase timing and required records, and apply statutory eligibility conditions before claiming credit.
  5. Retain evidence and revisit volatile details. Keep invoices and relevant filing records. GST notifications and portal procedures can change, so verify the current position when filing or changing a business process.

The GST Council’s 56th and 57th meeting releases and the Ministry of Finance FAQs explain the announced measures and examples. For a filing decision, however, the applicable notification, statute and current GST portal instructions determine the operative requirements.
