How India’s GST exemption changes insurance premiums, renewals and refunds from 22 September 2025

Individual life and health insurance GST is exempt in India from 22 September 2025, but group cover remains taxable and earlier valid GST is not automatically refunded. Learn how payment dates, advances, instalments and renewal bills are treated.

India exempted GST on covered individual life and individual health insurance policies from 22 September 2025. The tax applied to those policies changed from 18% to 0%, while employer-sponsored group health and life cover, group credit life and group term insurance remain taxable at 18%.

The change removes the GST line when the exemption’s timing and policy-category rules are met. It does not guarantee that every renewal bill will fall by exactly 18%, and it does not automatically refund GST that was correctly charged before the effective date. To check a bill, separate the insurer’s base premium from GST, identify whether the policy is individual or group, and apply the payment, invoice and supply dates that govern the transaction.

What the exemption covers

The Department of Financial Services (DFS) describes the measure as an exemption from GST on all individual life insurance and individual health insurance policies, including reinsurance of those policies, from 22 September 2025. The policyholder’s location and the product label are not enough on their own; the legal classification of the cover matters.

Policy or arrangement GST treatment under the post-22 September 2025 rules Examples and cautions
Individual life insurance Exempt when the applicable timing rules are met Term, endowment and ULIP policies are included in the official FAQ
Individual health insurance Exempt when the applicable timing rules are met Family floater and senior-citizen plans are expressly included
Individual health product with embedded add-ons The entire product can be exempt Travel or personal-accident features embedded in one individual health product sold for one price are covered according to the DFS FAQ
Employer-sponsored group health or life 18% GST remains applicable Do not treat a group certificate as an individual policy merely because you are the insured employee
Group credit life and group term insurance 18% GST remains applicable A lender- or employer-arranged group policy stays in the group category
Qualifying NRI individual policy exported as a service Zero-rated export treatment may apply Zero-rated export treatment and an ordinary GST exemption are different legal treatments

An employer or lender can arrange a policy without changing its classification. Check the policy schedule, certificate, proposal and invoice for wording such as “individual,” “group,” “master policy,” or “certificate of insurance.” A family floater is still an individual health policy for this purpose when it is issued as an individual contract.

Why the date on the renewal notice is not enough

The exemption is effective from 22 September 2025, but the renewal due date printed on a notice does not by itself determine the rate. DFS directs insurers and policyholders to examine when the premium was paid and, for certain advance transactions, the statutory time-of-supply events.

Premium due before 22 September but paid on or after it

The DFS FAQ answers this situation directly: the payment-date rate applies. Its example is a premium due on 21 September 2025 but paid on or after 22 September. Under that example, the payment is not subject to the former 18% GST, despite the earlier due date. Keep the payment receipt or bank transaction date with the renewal documents.

Advance premiums that straddle the change

Advance payments use the section 14 test in the Central Goods and Services Tax Act. Compare three events: the date of supply, the invoice date and the payment date. If at least two of those three events occur on or after 22 September 2025, the exemption applies. If at least two occur before that date, the earlier rate applies. An advance paid before the change therefore cannot be classified solely by looking at the policy’s future coverage period or the renewal date.

Instalment premiums

Each instalment is assessed separately by its payment date, subject to the FAQ’s timing rule. For example, an instalment paid on 15 September 2025 attracts the old 18% rate, while an instalment paid on 15 October 2025 for the same policy is exempt if the policy is otherwise an eligible individual policy. A bill showing several instalments should therefore be checked line by line rather than given one rate based on the policy anniversary.

Reinstating a lapsed individual life policy

DFS specifically states that the premium paid for an individual life policy reinstated on or after 22 September 2025 is exempt. Confirm that the transaction is a reinstatement of an individual life policy, not a new group arrangement or another product with different terms.

How to read a renewal notice

Start with the invoice rather than the total displayed in a payment app. A useful review has five passes.

  1. Identify the policy category. Confirm whether the document describes an individual life, individual health, family floater or senior-citizen plan, or a group policy. Group status generally appears in the certificate, master-policy reference or employer/lender documentation.
  2. Find the base premium before tax. This is the insurer’s charge for the cover before GST. It can change because of age, claims, medical underwriting, sum insured, location, plan design, riders or revised renewal terms.
  3. Read the GST line separately. An eligible post-effective-date payment should not carry the former 18% GST overlay. A zero GST line does not prove that the base premium is unchanged.
  4. Check the relevant dates. Record the payment date and, where an advance is involved, the invoice and supply dates. Do not rely only on the due date printed on the notice.
  5. Compare coverage and renewal terms. Check insured people, sum insured, deductibles, exclusions, riders, add-ons, waiting periods, discounts and policy duration before comparing totals.
Field to compare Question to ask Why it matters
Classification Is this an individual contract or group cover? Only the covered individual categories receive the exemption
Base premium What amount is shown before GST? The insurer can change this amount independently of tax
GST Is GST shown, and at what rate? The former 18% line should not apply to an eligible payment after the effective date
Dates When were payment, invoice and supply recorded? These determine treatment for late payments and advances
Benefits Are riders, add-ons and insured members identical? A different package makes total-price comparisons misleading
Renewal terms Did duration, deductible, limits or conditions change? Term changes can alter the premium even when GST is exempt

Why the total bill may not drop by exactly 18%

GST is a tax overlay, not the insurer’s underlying premium. If a covered premium before tax is ₹10,000, an old 18% GST charge would have added ₹1,800, producing ₹11,800 before any other adjustment. Removing that tax line would produce ₹10,000 only if the base premium and every other charge stayed the same. The example illustrates the tax arithmetic; it is not a promise about any particular policy’s renewal price.

Insurers may revise the base premium or change the package at renewal for reasons unrelated to GST. A health policy can reflect an age band, a higher sum insured, changed deductibles or an added benefit. A life policy can have different riders, payment frequency or underwriting terms. Conversely, a discount or a reduced benefit can make the total fall by more than the tax saving. Compare the pre-tax amount and coverage before deciding whether the exemption was passed through.

In a 3 February 2026 Rajya Sabha answer, the Finance Ministry reported that IRDAI had collected rates prevailing on 3 September 2025, monitored new and renewal policies and sought clarification where premiums appeared to rise after the announcement. The answer says all general and health insurers confirmed that they had not increased premiums and that the GST relief had been fully passed on to policyholders. That is the Ministry’s account of information supplied through IRDAI; it is not an independent adjudication of every individual invoice.

“All General and Health Insurers have confirmed that they have not increased premium and the GST relief granted by government has been fully passed on the policyholders.”

A 15 September 2025 Press Information Bureau release also records DFS Secretary M. Nagaraju emphasizing that the benefit should be fully passed on to existing and prospective policyholders. The statement expresses the implementation objective; the invoice remains the document to check for an individual transaction.

What the change means for renewals

For an eligible individual policy, a payment to which the exemption applies should show no GST overlay. The insurer may still issue a renewal quote with a different base premium, and the policyholder still has to meet the insurer’s renewal conditions. A lower tax line is therefore evidence about tax treatment, not a guarantee that the entire contract price has fallen in the same proportion.

Like-for-like comparison

When comparing two renewal notices, hold the insured people, sum insured, policy duration and optional benefits constant. Put the notices side by side and compare the base premium, GST, add-ons and final amount. A total-price difference alone cannot show whether the exemption was applied, because a coverage change can move the base premium in either direction.

New policies and existing policies

The exemption applies to qualifying supplies from the effective date, including eligible renewals and instalments whose timing falls under the new regime. It is not a discount that must be separately requested, and purchasing a new policy or switching insurers is not required to receive it. Continue a policy only after checking its coverage and renewal terms, not solely because the tax line has changed.

Will GST already paid be refunded?

The exemption is prospective from 22 September 2025. The official insurance-specific material does not announce a general refund of GST that was correctly charged on a premium payment made before the effective date. Therefore, the rate change itself does not create an automatic refund for an earlier, properly taxed premium.

That conclusion is different from a possible billing error. If the insurer applied 18% to an eligible individual payment made on or after 22 September, used the wrong policy category, or misapplied the advance-payment test, ask for a written, itemized review. The date change does not decide every cancellation, correction or disputed invoice.

Documents to gather for a disputed charge

  • The policy schedule or certificate showing whether the contract is individual or group.
  • The renewal notice and tax invoice, including the base premium, GST line and any add-ons.
  • Bank, card or payment-gateway proof showing when the premium was actually paid.
  • For an advance, the invoice date and any document identifying the date of supply.
  • Earlier and current notices if the policy terms or premium changed at renewal.

Send the insurer a concise request identifying the policy number, the disputed line and the relevant dates, and ask it to state which GST rule it applied. Keep the response and any revised invoice. The available official guidance does not establish a universal refund entitlement or a single complaint script for every fact pattern, so do not assume that a disputed charge is automatically refundable.

Special situations to check

Bundled individual health cover

If travel or personal-accident protection is embedded in an individual health policy and the insurer sells the combined product for one price, DFS says the entire product is exempt. A separately invoiced standalone add-on may need its own classification and should not automatically be treated as part of the bundled product.

Employer or lender arrangements

The person paying a premium is not the test. Employer-sponsored group health or life cover, group credit life and group term insurance remain at 18%. Review the certificate and master-policy structure before asking for the individual-policy exemption.

NRI policyholders

DFS distinguishes an individual policy that qualifies as an export of services under GST law from one that does not. The former can remain zero-rated; the latter is treated as exempt. “Zero-rated” and “exempt” should not be used interchangeably because they have different GST consequences.

Single-premium and recurring-payment plans

For a single premium, apply the relevant payment and, where applicable, supply and invoice dates. For recurring instalments, evaluate every payment separately. A policy can consequently have one instalment taxed under the old regime and a later instalment exempt.

A practical decision path

  1. Classify the cover. Mark it individual life, individual health, family floater, senior-citizen health, group health, group life, group credit life or group term.
  2. Mark the payment date. Use the date funds were received or the transaction was completed, not merely the due date.
  3. Apply the advance test if needed. For an advance, list supply, invoice and payment dates and count how many fall on or after 22 September 2025.
  4. Inspect the invoice. Separate base premium, GST, riders, add-ons, fees and discounts.
  5. Compare equivalent coverage. Confirm that changes in price are not caused by a different sum insured, member list, deductible or benefit.
  6. Request clarification when the facts do not align. Ask the insurer for an itemized explanation and retain the documents rather than assuming either an automatic saving or an automatic refund.

Common mistakes

  • Assuming every insurance policy in India became GST-free. Group categories remain taxable at 18%.
  • Using the renewal due date as the only timing test. Payment date controls the stated late-payment example, while advances require the section 14 analysis.
  • Expecting an 18% reduction in the final bill. The exemption removes GST; it does not freeze the base premium or coverage terms.
  • Calling an earlier, correctly taxed premium refundable solely because the rate later changed.
  • Calling an NRI export “exempt” without checking whether the transaction qualifies as a zero-rated export of services.
  • Comparing two totals without checking riders, add-ons, insured members and deductibles.

The actionable rule is simple but date-sensitive: first establish whether the policy is an eligible individual contract, then determine which timing rule applies, and only after that evaluate the GST line against the underlying premium and coverage. A written, itemized explanation from the insurer is the appropriate next step when those details do not reconcile.
