Re:

How Divorce Affects Social Security Benefits for Women

Divorce does not automatically divide Social Security. Here are the 10-year marriage, age, remarriage, amount and application rules for divorced-spouse and surviving-divorced-spouse benefits.

Divorce does not split a Social Security retirement check or automatically give a woman a payment from her former husband’s record. If the former spouse is living, a divorced-spouse benefit may be available when the marriage lasted at least 10 years and the claimant meets age, marital-status, filing and benefit-coordination rules. If the former spouse has died, the claim is a different surviving-divorced-spouse benefit with different age and remarriage rules.

What divorce changes—and what it does not

Social Security eligibility is determined under federal program rules, not by the property terms in a divorce decree. A decree does not itself assign or divide a former spouse’s Social Security benefit. Instead, the Social Security Administration (SSA) may pay a benefit on a former spouse’s covered earnings record if the statutory conditions are met.

The rules are gender-neutral, but women often ask whether they can collect from an ex-husband. The answer depends first on whether that former spouse is alive. Use divorced spouse for a living former spouse and surviving divorced spouse when the former spouse has died; the two programs should not be mixed.

An eligible divorced-spouse claim generally does not reduce the worker’s own retirement benefit. It also does not mean the claimant receives two full benefits. SSA coordinates a claimant’s own retirement benefit with any divorced-spouse amount for which she qualifies.

Can someone get Social Security on a former spouse’s record?

For a living former spouse, the usual requirements are:

  • The marriage lasted at least 10 years.
  • The claimant is at least 62.
  • The claimant is unmarried.
  • The claimant applies for the benefit.
  • Her own retirement or disability benefit is not already at least as large as the applicable divorced-spouse amount.

The former worker must have enough Social Security-covered work to qualify for retirement or disability benefits. The former worker’s remarriage does not, by itself, disqualify an otherwise eligible ex-spouse. SSA’s prior-marriage guidance expressly recognizes that an ex-spouse may qualify even if the worker has remarried.

The two-year rule when the worker has not claimed

A divorced spouse can sometimes qualify even before the former worker has become entitled to retirement benefits. Under 20 CFR § 404.331, the worker must be at least 62, and the divorce generally must have been final for at least two years. The claimant must still satisfy the other conditions, including the 10-year marriage, age, unmarried status and application requirements.

The regulation states: “You are entitled to these benefits even though the insured person is not yet entitled to benefits, if the insured person is at least age 62 and if you meet the requirements of paragraphs (a) through (f).” This provision is about independent entitlement; it does not eliminate the other eligibility tests.

How much can a divorced-spouse benefit pay?

At the claimant’s full retirement age, a living divorced-spouse benefit can be as much as 50% of the former worker’s primary insurance amount (PIA). The PIA is the worker’s Social Security calculation used to determine a full-retirement-age benefit; it is not necessarily the amount the former spouse currently receives.

Claiming before full retirement age permanently reduces the divorced-spouse amount under the program’s early-claiming formula. The 50% figure therefore describes the maximum at full retirement age, not a promise that every claimant receives half of an ex-spouse’s check.

SSA compares the divorced-spouse amount with the claimant’s own retirement benefit. If her own benefit is equal to or greater than the applicable divorced-spouse amount, an additional payment on the former spouse’s record may not be payable. If the divorced-spouse amount is higher, SSA coordinates the two entitlements rather than paying both full amounts. A personal estimate requires the claimant’s earnings record, birth date and intended start month.

Does my ex-husband’s remarriage affect my claim?

No. The former worker’s remarriage is not, by itself, a bar to an otherwise eligible divorced-spouse benefit. His new marriage does not cancel the former spouse’s independent eligibility on his earnings record.

That rule is different from the claimant’s own marital status. For a living divorced-spouse benefit, the regulation requires the claimant not to be married. Remarrying can therefore end or prevent this type of payment, subject to SSA’s determination of the claimant’s circumstances.

What if the former spouse has died?

A deceased former spouse creates a potential surviving-divorced-spouse claim, not an ordinary divorced-spouse claim. The basic marriage-duration rule remains: the marriage generally must have lasted at least 10 years. The age and remarriage rules change.

Age and disability thresholds

  • A surviving divorced spouse can generally qualify beginning at age 60.
  • If disabled, the threshold is generally age 50, subject to SSA’s disability and timing requirements.
  • A qualifying child-in-care situation may provide a separate path to survivor eligibility.

SSA describes survivor benefits as ranging from 71.5% to 100% of the deceased worker’s benefit depending on the age at which the survivor applies. That range is not a guaranteed payment for every surviving divorced spouse; the actual percentage depends on the claimant’s facts and filing age.

Remarriage after the former spouse’s death

Survivor rules do not use the living-divorced-spouse rule that requires the claimant to remain unmarried. SSA generally says remarriage after age 60 does not prevent a surviving divorced spouse from qualifying; age 50 is the relevant remarriage threshold when disability is involved. A remarriage at a younger age can affect eligibility, so the date and circumstances of every marriage should be disclosed to SSA.

Work and earnings before full retirement age

If a survivor claims before full retirement age and continues working, the Social Security earnings test may affect payments. The applicable earnings limit and withholding formula can change, so a claimant should use the current SSA figures for the year in which she works and claims. This issue is especially important when comparing an early survivor claim with waiting.

Living divorced spouse versus surviving divorced spouse

Issue Former spouse is living Former spouse has died
Program name Divorced-spouse retirement benefit Surviving-divorced-spouse benefit
Marriage duration At least 10 years Generally at least 10 years
Common age threshold 62 60, or 50 if disabled
Claimant remarriage Claimant generally must be unmarried Remarriage after 60 generally does not prevent qualification; age 50 is relevant when disabled
Former spouse’s remarriage Does not by itself bar an eligible ex-spouse Not applicable after death
Potential amount Up to 50% of the worker’s PIA at the claimant’s full retirement age; reduced when claimed earlier SSA describes 71.5% to 100% of the deceased worker’s benefit depending on claim age and individual circumstances

Will my ex-wife’s or ex-husband’s benefits reduce my Social Security?

For an ordinary divorced-spouse claim, SSA’s eligibility materials indicate that the former spouse’s payment is based on the worker’s record and generally does not reduce the worker’s own retirement benefit. The worker can therefore claim without treating the ex-spouse’s application as a division of the worker’s check.

This statement should not be expanded into a guarantee about every Social Security family-maximum or benefit category. A worker with several dependents, survivor claims or other entitlements should ask SSA how the specific combination is handled.

How your own record affects the decision

Before filing, compare the estimate from your own retirement record with the estimate for the divorced-spouse or survivor benefit. The relevant comparison is not simply “half of my ex’s check.” It is based on the former worker’s PIA, your age at the start month, your own entitlement and, for survivor benefits, the deceased worker’s benefit and your survivor-claim age.

  • Your age and start month: Starting a living divorced-spouse benefit before full retirement age reduces it. Survivor percentages also depend on claim age.
  • Your own retirement benefit: SSA coordinates benefits instead of paying two full amounts.
  • Living or deceased status: This determines which program and age rules apply.
  • Remarriage history: Record the date of every remarriage, particularly for survivor claims.
  • Two-year final-divorce period: If the former worker is at least 62 but has not become entitled to retirement benefits, the divorce generally must have been final for two years.
  • Employment: Earnings before full retirement age can affect a survivor payment under the earnings test.

Because a personal calculation requires birth dates, earnings estimates, marital history and the former worker’s benefit status, no universal “best month” or claiming recommendation exists.

How to apply

Living divorced-spouse benefit

SSA lists three application routes for spouse and divorced-spouse benefits:

  1. Online: Start through the Social Security retirement or spouse-benefit application pathway and follow the prompts for a divorced-spouse claim.
  2. By phone: Contact SSA to request an appointment or complete the application process with an agency representative.
  3. At a local office: Make an appointment if you need help documenting the marriage, divorce or earnings record.

SSA may request a final divorce decree and other proof. The exact documents vary by case. Do not assume that knowing the former spouse’s Social Security number is universally required; provide the information and records SSA actually requests.

Surviving-divorced-spouse benefit

Survivor applications use a distinct process. Current SSA materials direct prospective survivors to contact the agency rather than relying on the ordinary online retirement application. Have the death information, marriage and divorce records, dates of remarriage, disability information when relevant and work details available so SSA can identify the correct survivor pathway.

A surviving family member who meets the conditions for the one-time survivor payment may also be eligible for a $255 lump sum under SSA’s rules. That payment is separate from ongoing survivor benefits and has its own eligibility requirements.

Common mistakes that delay or reduce a claim

Counting the wrong years

The 10-year test concerns the length of the legal marriage. Periods of dating, cohabitation or an engagement do not satisfy it. Gather the marriage certificate and final divorce decree so the dates can be verified.

Using the 50% figure as a general promise

Fifty percent is the maximum living divorced-spouse rate at the claimant’s full retirement age, measured against the worker’s PIA. It is not half of every amount the former spouse receives, and early filing reduces it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Applying the living-spouse rule to a survivor claim

A claimant who remains unmarried may qualify on a living former spouse’s record, while a surviving divorced spouse can generally remarry after age 60 without losing eligibility. Treating those as one rule can produce the wrong filing decision.

Ignoring the two-year condition

If the former worker is at least 62 but has not become entitled to retirement benefits, check whether the divorce has been final for two years. The condition is relevant to independent entitlement and is separate from the 10-year marriage requirement.

Failing to update SSA about work or remarriage

Employment before full retirement age can affect a survivor payment, and a new marriage can change eligibility. Report these events promptly rather than relying on an old estimate.

Questions to take to SSA

  • What is my own retirement estimate at each possible start age?
  • What is my divorced-spouse estimate at 62, at full retirement age and at my planned month?
  • Is my former spouse already entitled to retirement benefits, or does the two-year independent-entitlement rule apply?
  • Does my remarriage history change a survivor claim?
  • Would current earnings trigger the earnings test before full retirement age?
  • Which marriage, divorce, death and disability documents should I submit?

Use your my Social Security account for your own earnings and benefit estimates, then ask SSA to confirm eligibility and the amount under the current rules. Estimates, earnings limits and application procedures are time-sensitive and can change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bottom line

Divorce alone does not create a Social Security payment. A woman with a living former spouse may qualify at 62 or later after a marriage of at least 10 years if she is unmarried, applies and meets the other entitlement rules. A former spouse’s remarriage does not by itself block her claim. If the former spouse has died, survivor rules apply instead: the usual age is 60, or 50 when disabled, and remarriage after 60 generally does not prevent qualification. The right amount and start date depend on her own record, the former spouse’s PIA or benefit, filing age, marital history and— for survivors who work—earnings before full retirement age.
