Whether a claim qualifies depends in part on when each loan was taken out or consolidated, what the school did, and whether the borrower can show the elements required for that loan’s applicable standard. A disappointing education or job outcome by itself does not establish eligibility.
The Department of Education’s surfaced application lists an expiration date of July 31, 2026, which has passed. Confirm the current form, eligibility rules, and submission instructions at StudentAid.gov/borrower-defense before applying.

What borrower defense is—and what it does not cover
Borrower Defense to Repayment is a federal process for asking the U.S. Department of Education to discharge eligible federal student loans because of certain conduct by the school. The application describes potential grounds that can include misleading statements, certain omissions, some favorable contested court judgments, and certain failures to perform important contractual obligations. Which grounds apply depends on the loan’s timing and the facts.

A borrower’s dissatisfaction, an unexpectedly difficult job search, or an outcome that fell short of personal hopes is not automatically proof that the school committed qualifying misconduct. The relevant question is whether the evidence and harm satisfy the standard that applies to the particular loan.

This is a federal loan-discharge process, not a general remedy for every dispute with a school. The application includes Direct, Federal Family Education Loan (FFEL), and Perkins loan sections, but loan-program eligibility and the consequences of any consolidation depend on the loan and applicable rules.
Which eligibility standard applies to your loans?
The Department’s application divides claims into three timing groups. For a consolidated loan, the application says the consolidation date controls. If a borrower has loans from different periods, those loans may be evaluated under different regulations and standards; do not assume one answer applies to the entire account.
| Loan taken out or consolidated | Potential basis described in the application | What the borrower must establish, in broad terms |
|---|---|---|
| On or before June 30, 2017 | Untruthful or misleading statements or acts made while trying to persuade the borrower to enroll or remain enrolled. | The information mattered to the enrollment decision, caused harm, and gave the borrower a basis to successfully sue under applicable state law. |
| July 1, 2017 through June 30, 2020 | Misleading statements and certain concealed, suppressed, or omitted information concerning employment outcomes, educational programs, or financial charges; certain favorable contested judgments; or certain failures to perform an important contract obligation. | The claim must meet the applicable standard and show harm where required. The judgment route described in the application does not include a settlement alone. |
| On or after July 1, 2020 | Untruthful or misleading statements concerning employment outcomes, educational programs, or financial charges. | The school must have made the statement knowing it was false, misleading, or deceptive; it must have mattered to enrollment; and it must have caused financial harm. |
This table is a guide to the distinctions in the surfaced application, not a substitute for its current legal definitions. In particular, “harm,” “materiality,” and the requirements for a judgment or contract claim depend on the applicable rule and the individual facts. Read the live application’s questions and definitions rather than treating a general description as a complete eligibility test.
Examples of statements that may be relevant
The application gives examples involving graduates’ job prospects or salary, whether a program qualifies graduates for a license or certification, instructor availability or qualifications, whether credits transfer, program costs, and available financial aid. A statement about one of these topics is not automatically a qualifying claim. The borrower still needs to explain who made it, when and how it affected the decision to enroll or stay enrolled, and how the relevant standard’s other elements are met.

Understanding the financial-harm requirement
For claims under the standard for loans taken out or consolidated on or after July 1, 2020, the application distinguishes financial harm from nonmonetary harm and requires financial harm. Examples it gives include a significant discrepancy in tuition or fees, being unable to secure a job the school expressly guaranteed, or being unable to complete the program after a necessary requirement was discontinued without an acceptable alternative. These examples should be checked against the current instructions; they do not mean that every cost difference, job difficulty, or program change meets the standard.
How to assess whether you may qualify
Start with each loan, not just the school or the overall balance. The most useful initial review connects the timing, loan program, alleged conduct, evidence, and harm for each loan. This helps identify when different loans may fall under different rules.
- Identify the loan and its relevant date. Review your loan records to determine when each loan was taken out. If it was consolidated, identify the consolidation date, which the application says controls for consolidated loans.
- Identify the loan program. Note whether the loan is Direct, FFEL, Perkins, or Parent PLUS. Do not assume that the same eligibility or consolidation consequences apply to every program.
- Describe the school conduct precisely. Record what was said, done, concealed, omitted, or not performed, and connect it to enrolling or continuing enrollment. Identify the subject involved, such as job outcomes, program requirements, costs, or financial aid.
- Match the facts to the applicable period. Determine which timing group applies, then compare the facts with its requirements. For example, a pre-July 2017 claim described by the application includes a state-law basis to successfully sue; the post-June 2020 standard includes knowledge, materiality, and financial harm.
- Identify the harm and the supporting records. Explain how the conduct affected you and what records support that account. For a claim involving a judgment, distinguish a contested judgment from a settlement; the application says a settlement alone does not qualify under that route.
- Check the current official instructions. Because the surfaced application has passed its stated expiration date, use the current online form and guidance to verify the applicable questions, definitions, and procedures before submitting.
This approach can help you organize a claim, but it does not predict whether the Department will approve it. Eligibility is fact-specific, and multiple loans held by one person may require separate analysis.
What evidence to gather and how to explain it
The application encourages detailed, specific accounts. The Department’s Federal Student Aid borrower-defense application says: “ED strongly encourages you to provide as much detail as possible in this application for your relevant claim or claims.” Specificity helps the Department understand what the school representative communicated, how the communication affected the enrollment decision, and what harm followed.

Build a clear account of the conduct
For each relevant event, write down the representative’s name or title if known, the approximate timeframe, what was said or done, and whether it happened before enrollment or while you were deciding whether to remain enrolled. Explain what you understood the statement or conduct to mean, why it mattered to your decision, and what happened afterward. If you do not know an exact date or name, identify the uncertainty accurately rather than filling in details from memory as if they were certain.
Then connect the event to the appropriate claim. For instance, if the issue concerns a claim about licensing, describe the specific representation and the resulting licensing problem. If it concerns a promised job outcome, distinguish an express promise from a general expectation, and state what happened when you tried to obtain the job. The examples in the form are topics to investigate, not a checklist that proves a claim.
Collect records that support the account
The application lists these examples of potentially relevant material:
- Emails and other communications from the school
- School catalogs, student manuals, advertisements, and brochures
- Enrollment agreements and other contracts
- Transcripts or diplomas
- Court judgments
Keep records that relate to the claim and describe accurately what each one shows. A brochure may document how a program was promoted; an enrollment agreement may show contract terms; a transcript may document coursework completed. A record’s existence does not establish every element of a claim, so explain how it supports the particular statement, omission, judgment, or contract issue you are raising.

Organize materials by the loan and the event they relate to. If several documents support one allegation, explain the connection rather than expecting the reviewer to infer it. Be candid about missing documents or details, and do not state that a record proves more than it actually contains.

The surfaced application recommends online submission through StudentAid.gov/borrower-defense and also lists a paper-mail option and the contact number 1-855-279-6207. Because the PDF identifies July 31, 2026 as both its approval date and expiration date, these details may no longer be current. Confirm the live application, any mailing address, contact information, and submission method on the official page before sending personal information or documents.
According to the application, the Department reviews the allegations and evidence, may request a response from the school, and notifies the borrower when it makes a decision. The form warns that review may take years depending on application volume. It does not establish a guaranteed completion date, so plan for uncertainty rather than relying on a particular estimate.

What happens to payments while a claim is pending?
The surfaced application says that, during review, loans that are not in default are placed into forbearance and defaulted loans into stopped-collections status unless the borrower requests otherwise. It also says borrowers may choose to continue making payments. The current application should be checked to confirm the treatment available for your loans and what request, if any, is needed.

This is a personal financial decision, not a one-size-fits-all choice. The form warns that if a claim is denied, the total owed may be higher. Before deciding whether to request a payment pause or continue paying, review the current terms and consider how the choice fits your budget and circumstances. Do not assume a pending application itself discharges a loan or permanently ends payment obligations.
Direct, FFEL, Perkins, and Parent PLUS loans
The application includes sections for Direct, FFEL, and Perkins loans. A federal loan servicer’s guidance says FFEL and Perkins loans may become eligible if consolidated into the Direct Loan Program. That does not make consolidation a universal solution: eligibility and the consequences can depend on the loan and applicable rules. Check your loan records and current official guidance before making a consolidation decision.
The application also specifically includes Parent PLUS borrowers and asks about the child whose attendance the loan financed. A parent considering a claim should use the current form’s instructions for the borrower and the student, and should not assume that the student’s own loans and the parent’s loan are treated as one claim. Each loan’s program and relevant date still matter.
Common mistakes that can weaken or confuse a claim
- Using one date for every loan. A borrower may have multiple loans with different dates, and consolidated loans use the consolidation date under the application’s description.
- Describing only a bad result. Explain the school’s conduct and its connection to enrollment, not simply that employment, transfer, or program outcomes disappointed you.
- Leaving out the applicable elements. The standards differ by timing. A claim should address the requirements that apply, including relevant materiality, knowledge, state-law, judgment, contract, or harm elements.
- Submitting documents without context. Identify what each document shows and how it supports the allegation rather than relying on a pile of records to tell the story on its own.
- Treating a settlement as a qualifying judgment. The application says a settlement alone does not satisfy the judgment route it describes for the July 2017–June 2020 period.
- Consolidating without checking consequences. FFEL or Perkins loans may become eligible after Direct consolidation, but eligibility and consequences vary; do not consolidate solely on the assumption that it will improve a borrower-defense claim.
- Relying on an expired form. The surfaced PDF’s expiration date has passed. Confirm the current version and instructions before using its procedural details.
A practical way to organize your records
A simple claim worksheet can keep the facts tied to the right loan without replacing the official application. For each loan, record its program, original borrowing date, consolidation date if any, the timing group you believe applies, the school conduct, the enrollment decision it affected, the harm, and the documents that support each point. Use separate entries when different loans or events require different standards.
Keep a copy of the application and the materials you submit, along with any official communications about the claim. If the Department asks for additional information or the school responds, use your records to answer accurately and consistently. If the claim turns on state-law rights, contract terms, or the significance of evidence you cannot interpret, individualized legal or consumer-protection assistance may be useful; no single organization or service is required by the application.
