Re:

How Are Investments and Capital Gains for a Minor Child Taxed in India?

A minor’s investment income is generally clubbed with a parent’s income in India, but statutory exceptions, parent-selection rules and asset- and date-specific capital-gains treatment affect the result.

In general, income from investments held by a minor child—including interest, dividends and capital gains—is included in a parent’s taxable income under section 64(1A) of the Income-tax Act, 1961. The main exceptions are income from the child’s manual work or qualifying personal skill, talent or specialised knowledge, and the specified disability case under section 80U. If the parents’ marriage subsists, the income is ordinarily included with the parent whose total income is higher before adding the child’s income; otherwise, it is included with the parent who maintains the child. Section 10(32) allows an exemption of up to ₹1,500 for each minor child whose income is included. The applicable capital-gains rate is a separate question: it depends on the asset, holding period, transaction conditions and transfer date.

Why a child’s name on an investment does not decide how it is taxed

Putting an investment in a minor’s name does not, by itself, mean that the income will be taxed separately from the parents. Under section 64(1A), income that arises or accrues to a minor child is generally included in an individual parent’s total income. The Income Tax Department’s page for section 64 sets out this clubbing rule and its exceptions.

“Clubbing” means adding the child’s relevant income to the selected parent’s income for tax purposes. It does not mean the parent must own the child’s investment, nor does it change whose name appears on the account. It answers a different question: whose total income includes the income arising from that investment? A child’s bank account, demat account or mutual-fund folio may therefore be in the child’s name while the tax treatment of its earnings is determined by the clubbing rules.

Separate the issue into two decisions. First, determine whether the child’s income is included with a parent or falls within an exception. Then, if it is a capital gain, determine the correct capital-gains treatment for the particular asset and transfer. A gain does not escape the clubbing question just because capital gains have their own rates and computation rules.

Which income is generally clubbed with a parent?

The rule concerns income arising or accruing to the minor child. For investments, that can include returns such as interest, dividends and gains on a sale or other transfer. The account label or investment product does not establish a blanket exemption. Instead, identify what income arose, to whom it arose, and whether one of the statutory exceptions applies.

Income or circumstance General treatment to consider What to establish
Interest from a deposit or other investment in the child’s name Generally considered under section 64(1A) for inclusion with a parent Whether the income arose to the child and whether an exception applies
Dividend or distribution from an investment Generally considered under the same clubbing rule The nature and source of the income, and the applicable tax-year rules
Profit on selling an investment The clubbing question applies before deciding the capital-gains rate Asset type, holding period, transfer date and any special transaction conditions
Income earned through the child’s own qualifying activity May fall outside the general rule where the statutory personal-activity exception applies Whether the income genuinely arises from the child’s manual work, skill, talent, or specialised knowledge and experience

The table describes the framework, not a conclusion for every product or transaction. The legal character of an amount and the facts behind it matter. For example, a sale may produce a capital gain, but that label alone does not determine which parent reports it or the rate that applies.

When a minor’s income is not clubbed

Section 64(1A) contains exclusions. The first concerns income arising to a child on account of the child’s manual work or an activity involving the child’s skill, talent, or specialised knowledge and experience. This is a fact-sensitive exception: the relevant connection is between the income and the child’s personal work or qualifying ability, not simply the fact that the child is young or that an asset is held in the child’s name.

The second exclusion is for a minor child suffering from a disability of the nature specified in section 80U. The statutory wording refers to the specified disability condition; it should not be broadened into a general exemption for any illness, impairment or additional support need. Whether the condition is met requires checking the applicable statutory requirements and the child’s circumstances.

  • Manual work: determine whether the income is earned on account of work performed by the child.
  • Skill, talent or specialised knowledge: identify the activity that produced the income and whether it depends on the child’s own qualifying ability or experience.
  • Section 80U disability: verify that the child falls within the disability condition specified by that provision.

Do not assume that all future income from money earned by a child’s personal activity is also automatically excluded. The official material establishes the exception for qualifying income from the child’s activity, but does not resolve every case where the child reinvests those earnings and the balance later generates interest, dividends or capital gains. The source and character of each later return may need separate evaluation. If the amounts are material or the facts are mixed, obtain advice for the specific year and transactions rather than treating reinvestment as a categorical answer.

The Income Tax Department’s section 64 text is the primary reference for the statutory rule and exclusions. The distinction is important in practice: income from a child’s personal work may be treated differently from passive returns produced by investments, but the result depends on the facts rather than the account name alone.

Which parent includes the child’s income?

When the parents’ marriage subsists, section 64(1A) ordinarily attributes the child’s income to the parent whose total income is greater, calculated before including the minor’s income. The comparison is not made after first adding the child’s income to one parent’s return. When the parents’ marriage does not subsist, the relevant parent is the one who maintains the child in the year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Check whether the parents’ marriage subsists. This determines which parent-selection rule to apply.
  2. If it subsists, compare the parents’ total incomes before clubbing. The child’s income is ordinarily included with the parent who has the higher total income on that basis.
  3. If it does not subsist, identify which parent maintains the child for that year. The income is ordinarily included with that parent.
  4. Keep the attribution consistent in later years unless the facts or applicable rule change. The stated rule ordinarily continues with the same parent in succeeding years.

These rules identify the parent for tax reporting; they do not settle every family or ownership question associated with the investment. Keep records that show the investment, the income or transfer, and the circumstances used to select the parent. Where the parents’ circumstances change, or there is uncertainty about who maintains the child, confirm the treatment for the particular year.

What the ₹1,500 exemption does—and does not do

Section 10(32) provides an exemption of up to ₹1,500 for each minor child whose income is included under section 64(1A). The Income Tax Department’s section 10 page sets out this provision. It is a capped exemption, not a general deduction for every amount invested for a child, and not an unlimited allowance against investment income.

The practical sequence is to identify the child’s income that is clubbed, include it with the appropriate parent under the applicable rules, and then consider the section 10(32) exemption subject to its cap and conditions. The ₹1,500 figure is per qualifying minor child, not per account, investment or transaction. Do not use it to conclude that all income above or below a particular amount is tax-free; the parent’s other income and the applicable computation rules still matter.

How to determine the tax on a minor’s capital gain

Capital gains have two distinct layers. The first is attribution: if the gain arose to the child and is not within a statutory exclusion, section 64(1A) generally brings it into the selected parent’s total income. The second is computation: the applicable capital-gains provision and rate depend on the asset and transaction. There is no single capital-gains rate for every investment held by a minor.

Use this checklist before relying on a rate:

  • Asset type: identify what was transferred and whether it is covered by a special capital-gains provision.
  • Holding period: establish how long the asset was held and whether the relevant law treats the gain as short-term or long-term.
  • Transfer date: check the date of transfer, including statutory transition dates that may affect the treatment.
  • Transaction conditions: verify whether a provision requires a specified exchange, securities-transaction conditions or other qualifications.
  • Parent’s wider tax position: account for which parent includes the amount and the effect of that parent’s other income under the applicable rules.

Current Income Tax Department guidance gives examples of rates for particular qualifying transactions, not universal rates. Its guidance on determination of tax in certain special cases, marked as amended by Finance Act 2026, describes a 20% rate for qualifying short-term capital gains under section 111A and a 12.5% rate for qualifying long-term capital gains under section 112A above the stated threshold. Those figures apply only where the asset and transaction satisfy the relevant provision’s conditions. The 12.5% section 112A treatment is not a rate for every long-term gain, or for every share or fund.

The Department’s guidance on treatment of income from different sources also describes 12.5% treatment for specified long-term capital-gains cases after July 23, 2024, subject to asset-specific rules and transitions. That date is relevant to the stated treatment; it does not make every transfer after that date eligible for the same rate. Different assets and transactions can be governed by different provisions, thresholds, holding periods or transition rules.

Accordingly, a parent should not take a rate quoted for qualifying listed-equity transactions and apply it to property, all mutual funds, all shares, or any other investment without checking the governing provision. A reliable calculation needs the asset classification, acquisition and transfer details, applicable holding-period rule, transaction evidence and the relevant parent’s tax position. If any of these are unknown, the rate cannot be responsibly inferred from the child’s age or account ownership.

Which tax-year law should you check?

Tax treatment is tied to the rules applicable to the relevant income and transfer, not simply to the date someone reads a webpage. The Income Tax Department’s current consolidated material includes the Income-tax Act, 2025 as amended by Finance Act 2026. The Department provides the consolidated Act at Income-tax Act, 2025 as amended by Finance Act 2026.

The section 64 and section 10 references above are to the Income-tax Act, 1961, while current Department rate guidance also reflects amendments and the later statutory framework. Before preparing a return or estimating tax, identify the relevant tax year and check the commencement and transition provisions for the rule at issue. In particular, do not assume that a provision, section number, rate or threshold found in guidance for one period applies unchanged to a different transfer year.

This matters most when an investment was bought in one period and sold in another, or when rules changed around a specified date. The transfer date, not just the date of purchase or the date the return is filed, can determine which capital-gains treatment needs to be examined. Where the transition provisions do not clearly resolve a case, seek individualized tax advice with the transaction records.

A practical record-keeping and decision sequence

Parents can avoid the most common errors by keeping the clubbing decision separate from the capital-gains calculation. Use the following sequence for each relevant year:

  1. List the child’s income by source. Separate interest, dividends, sale proceeds and any earnings from personal work or skill-based activity. Sale proceeds are not themselves necessarily the taxable gain; the applicable computation must be established.
  2. Trace the investment and the income. Keep account statements, investment documents and transaction records that show the child, source, dates and amounts involved.
  3. Test the statutory exclusions. Consider whether the income arose from the child’s manual work or qualifying skill, talent, specialised knowledge or experience, or whether the section 80U disability condition applies.
  4. Select the parent under the correct family circumstance. If the parents’ marriage subsists, compare total incomes before adding the child’s income; if it does not, determine which parent maintains the child in that year.
  5. For a gain, identify the applicable capital-gains rule. Confirm asset type, holding period, transfer date and transaction conditions before using a rate.
  6. Apply the limited section 10(32) exemption where eligible. Consider the cap of up to ₹1,500 for each qualifying child whose income is included.
  7. Check the law and return-year instructions that apply. Use the relevant statutory provisions and current official guidance for that period, especially where an amendment or commencement date may affect treatment.

This process is more dependable than beginning with a tax-rate table. If the child’s income is excluded under a statutory exception, the capital-gains rules still may matter to the child’s own tax position; if the income is clubbed, the correct parent and the correct rate both need to be established. The facts can alter either part of the answer.

Common mistakes to avoid

  • Assuming the child’s name determines the taxpayer. Ownership records and income attribution are related but not identical questions under section 64(1A).
  • Treating all investment income as exempt because the child earned money personally. The stated exception is for qualifying income from the child’s activity; later returns from reinvested funds may require separate characterization.
  • Applying the ₹1,500 figure to each investment. Section 10(32) caps the exemption per qualifying minor child, not per asset or account.
  • Using one capital-gains rate for all assets. Rates cited for sections 111A or 112A depend on the covered asset and transaction conditions.
  • Ignoring the transfer date or a change in law. Specified post-July 23, 2024 treatment and later statutory amendments require checking the applicable transition rules.
  • Choosing the parent after adding the child’s income. Where the parents’ marriage subsists, the comparison is based on total income before the child’s income is included.
