House Committee Calls DeepSeek a National-Security Threat and Probes Nvidia Chip Use

The House CCP committee alleged data, censorship, model-distillation and Nvidia-chip risks tied to DeepSeek. Its probe sought supply-chain records, but the public report does not prove Nvidia knowingly supplied restricted chips.

On April 16, 2025, the bipartisan House Select Committee on the Strategic Competition Between the United States and the Chinese Communist Party called DeepSeek a “profound threat” to U.S. national security and scrutinized whether restricted Nvidia chips reached the Chinese AI company. The committee alleged risks involving user data, censorship, model distillation and advanced chips. Its report and request for Nvidia records raised serious questions, but the public documents do not establish that Nvidia knowingly supplied DeepSeek or that every chip allegation has been proved.

What the House committee said about DeepSeek

The report, titled “DeepSeek Unmasked: Exposing the CCP’s Latest Tool for Spying, Stealing, and Subverting U.S. Export Control Restrictions”, was issued by the House Select Committee on the Strategic Competition Between the United States and the Chinese Communist Party, commonly called the House Select Committee on the CCP. Chairman John Moolenaar, a Michigan Republican, and Ranking Member Raja Krishnamoorthi, an Illinois Democrat, led the committee. The report was bipartisan; that does not mean every member endorsed every allegation or recommendation.

The committee’s executive summary made four principal claims. They are committee findings and allegations, not court judgments or a final executive-branch enforcement determination.

  • Data: The committee alleged that DeepSeek sends Americans’ data to the People’s Republic of China through backend infrastructure linked to a Chinese company designated by the U.S. government as connected to the military.
  • Model behavior: It said DeepSeek’s outputs are censored or manipulated to align with Chinese Communist Party messaging and Chinese legal requirements.
  • Model distillation: The committee said it was highly likely DeepSeek used unlawful distillation techniques to obtain capabilities from leading U.S. AI models. Distillation generally means training a model using the outputs of a more capable model; the committee’s assessment is not a finding by a court that a particular company stole a model.
  • Hardware: It said DeepSeek’s model appeared to rely on Nvidia hardware and reportedly used tens of thousands of chips subject to export restrictions.

The committee characterized DeepSeek as more than a commercial AI competitor. Its concerns combined possible exposure of user data, Chinese state influence over information, potential unauthorized use of U.S. AI outputs, and access to advanced computing that could support military, intelligence, cyber, surveillance or influence activities. Those risks depend on specific facts about ownership, legal obligations, data handling, infrastructure, model behavior and end users—not simply the fact that an AI company is Chinese.

Why Nvidia’s chips became part of the inquiry

The report raised a supply-chain question: whether advanced Nvidia processors subject to U.S. export controls may have reached DeepSeek through third countries, intermediaries or remote computing services. The committee’s public materials describe concerns and reported use, but do not supply a verified chain of custody for every processor or establish that Nvidia knowingly facilitated an illegal transfer.

Several chip names appear in the debate, but the committee’s request for records should not be mistaken for proof DeepSeek used each model.

  • H100 and A100: High-end Nvidia AI accelerators subject to U.S. controls on exports to China.
  • H800 and A800: Products configured for the Chinese market after earlier controls, but later affected by tighter restrictions. In a January 30, 2025 letter, the committee said DeepSeek had made extensive use of the H800 and argued the case showed how chip designs can create regulatory gaps. The committee’s letter on tightening chip controls records that argument.
  • H20: A China-focused product developed to comply with earlier export thresholds. Lawmakers later argued that its capabilities and use in large AI systems raised enforcement concerns; that argument is distinct from proof of DeepSeek’s specific H20 use.
  • L40S and other accelerators: These were among the product categories in the committee’s records request. Their inclusion does not independently verify that DeepSeek used them.

Training a model, running it for users, and accessing a cloud-hosted GPU are different activities. A company can use computing capacity in an overseas data center without importing the physical processors into mainland China. That distinction makes customer identity, end use, location and subsequent transfers central to the inquiry.

What the committee asked Nvidia to provide

In its letter to Nvidia CEO Jensen Huang, the committee sought records to understand Nvidia sales and possible diversion routes. The request covered customers purchasing more than 499 AI-related chips or accelerators, including transactions connected to China, Hong Kong, Macau and ASEAN countries. It sought information such as chip type, quantity, customer, purchase date and declared end-use country, as well as communications involving DeepSeek and its affiliates and contracts with relevant Chinese entities. The requested product categories included H100, A100, H800, A800, H20, L40S, B100, B200 and other accelerators.

The committee also focused on possible third-country distributors, shell or front companies, inaccurate end-user declarations, and cloud or data-center arrangements. Its letter referred to a Singapore case in which three men, including a PRC national, were accused of mislabeling the end user of Nvidia chips. That is an allegation described by the committee, not a final criminal finding in the materials cited here. Read the committee’s Nvidia letter and records request.

What is established—and what remains unproven

The public record supports a distinction between what lawmakers said, what they sought to investigate and what has been independently established in the cited documents.

Question What the public committee materials establish What they do not establish
What did the committee allege? The report described data-transfer, censorship, distillation and Nvidia-hardware concerns and called DeepSeek a “profound threat.” That every technical, intelligence or legal assertion has been independently verified or adjudicated.
Did restricted Nvidia chips reach DeepSeek? The report said the model appeared to use Nvidia hardware and reportedly used tens of thousands of restricted chips. A public, verified chain of custody identifying every chip, its location and end user.
Did Nvidia sell directly to DeepSeek or knowingly enable a diversion? The committee sought customer, sales, communications and contract records to investigate the supply chain. That Nvidia directly supplied DeepSeek or knowingly facilitated an unlawful transfer.
Was export law violated? The report and letters raised concerns about restricted hardware, third-country routes and enforcement gaps. A criminal conviction or final Commerce Department enforcement finding in the cited public materials.

A congressional committee report is an oversight and policy document. It can present investigative findings and technical analysis, but it is not equivalent to an indictment, court ruling or final determination by the executive branch. The committee’s own request for additional Nvidia records underscores that key questions about customers, routes, quantities and end users remained under examination.

How export-control gaps can arise

U.S. controls set technical and licensing limits; they do not automatically reveal where every processor ends up or how it is used after sale. Potential vulnerabilities include products configured just below a threshold, purchases through resellers or shell companies, cloud access to overseas computing, weak end-user checks, and equipment legally sold at one point but later repurposed. These are possible routes and policy concerns, not proof that DeepSeek used each one.

Controls can also change as chip designs evolve. A product designed to meet an earlier threshold may become subject to tighter rules later. Enforcement therefore involves more than blocking a direct shipment: it can require visibility into beneficial customers, data-center operators, ownership changes, remote access and onward transfers.

What the report recommended—and the policy trade-offs

The committee recommended expanding export controls, strengthening enforcement and interagency coordination, reinforcing the Bureau of Industry and Security, improving chip end-user tracking, addressing risks from PRC-developed AI models and preparing for what it called “strategic surprise” in advanced AI. It also raised technical approaches such as location verification and remote-access controls for restricted AI infrastructure. These are policy proposals, not all current legal requirements.

Stronger controls could make it harder for China to access advanced computing, but they also carry costs and uncertainties. They can increase compliance and tracking burdens for U.S. chipmakers, reduce sales, encourage foreign customers to turn to non-U.S. suppliers, and accelerate investment in Chinese alternatives. The policy challenge is to limit sensitive capabilities and diversion without assuming that stricter rules have no effect on U.S. companies or the wider AI market.

Likewise, making model weights publicly available does not settle questions about data privacy, update control, moderation, training provenance or end use. Access to a model and the governance of the service around it are separate issues.

What happened after the April report

The April report was followed by a separate debate over Nvidia’s H20. In a July 18, 2025 letter, Chairman Moolenaar objected to Nvidia’s plan to resume applying for licenses to sell H20 chips to China. He argued that H20 hardware had enabled development related to DeepSeek R1 and could be used in Chinese supercomputing systems. Those are the chairman’s policy and technical claims, not a definitive independent finding about DeepSeek’s hardware or a legal determination. The July 18 letter on H20 sales is distinct from the April report and Nvidia inquiry.

The central unresolved questions are whether restricted chips were physically diverted to China or accessed through cloud infrastructure; which customers and intermediaries were involved; what Nvidia and regulators knew; and whether any agency ultimately found violations or imposed penalties. The committee’s documents establish that lawmakers pursued those questions, not their final answers.
