Home-loan tax benefits: under-construction vs. ready-to-move-in homes in India (AY 2025-26 and AY 2026-27)

Home-loan tax treatment depends on regime, occupancy and documented timing—not simply whether the home is under construction or ready to move in.

Possession status alone does not decide your home-loan tax benefit. For an Indian individual, the result turns first on the income-tax regime selected, then on whether the property is self-occupied or let out, and finally on the loan and construction records that support the interest claim. The Income Tax Department’s AY 2025-26 guidance shows a maximum ₹2,00,000 section 24(b) deduction for qualifying interest on a self-occupied home under the old regime. Its AY 2026-27 new-regime guidance lists section 24(b) interest for let-out property and restricts house-property losses; CBDT validation rules say self-occupied interest cannot be claimed in the new regime.

Under-construction and ready-to-move-in homes are therefore not separate tax categories with automatic, opposite outcomes. A ready home usually involves a purchase, while a developing project may involve construction financing, but the official tables classify the loan by purchase or construction and the property by use. The reviewed official material does not establish the detailed timing rule for interest paid before completion or possession, so that point must be checked against the current statutory text and your completion records rather than assumed.

The three tests that determine the benefit

Use this order when comparing the two property types:

  1. Choose the tax regime. The old and new regimes do not provide the same section 24(b) treatment.
  2. Classify use. A self-occupied home is treated differently from a property that is let out.
  3. Establish the claim period. Your loan sanction, acquisition or construction documents, completion evidence and year-wise interest certificate must support the year in which you claim a deduction.

“Under construction” and “ready to move in” describe the project’s stage. They do not, by themselves, answer whether a deduction is available, how much can be claimed or whether an interest amount can be used in a particular assessment year.

Section 24(b) under the old regime

Self-occupied property: ₹2 lakh ceiling in the AY 2025-26 table

The Income Tax Department’s AY 2025-26 old-regime table shows a maximum deduction of ₹2,00,000 for qualifying section 24(b) interest on a self-occupied house bought or constructed with a qualifying loan. The ₹2,00,000 figure is a ceiling for eligible interest, not a guaranteed tax refund or a payment from the government. If your qualifying interest is lower, the deduction cannot exceed that lower amount; if it is higher, the table’s maximum still limits the self-occupied claim.

The figure is tied to the AY 2025-26 guidance and the conditions that apply to the qualifying borrowing and property. Keep the lender’s annual interest certificate and the documents showing the property and loan relationship. Do not apply the number automatically to another assessment year without checking that year’s guidance.

Let-out property: actual interest shown without the self-occupied cap

The same AY 2025-26 table distinguishes a let-out property from a self-occupied one and shows actual interest without a stated section 24(b) limit for the let-out category. “Actual interest” is not the same as an unlimited tax saving: the house-property computation, the property’s annual-value treatment and the rules governing any resulting loss still affect the final result. The table’s distinction means you should not carry the ₹2,00,000 self-occupied ceiling into a let-out calculation as if it were universal.

What changes in the new regime for AY 2026-27

Self-occupied interest is not claimable

The CBDT AY 2026-27 ITR-1 validation rules state that interest on borrowed capital cannot be claimed for a self-occupied property under the new regime. If you move from the old regime to the new regime, do not continue entering a self-occupied section 24(b) amount merely because the loan, property or possession date has not changed.

Let-out interest appears, but house-property losses are restricted

The Income Tax Department’s AY 2026-27 new-regime table lists section 24(b) interest for a let-out property. It also states that a loss under the house-property head cannot be set off against other income heads or carried forward under that regime. Consequently, a large interest figure on a rented property does not automatically produce an immediate reduction against salary or business income. The way the house-property result is treated matters as much as the interest figure itself.

Because the new-regime guidance is assessment-year specific, use the AY 2026-27 instructions and validation rules applicable to the return you are filing. Do not combine an old-regime self-occupied limit with new-regime treatment in the same calculation.

Under-construction homes: what you can and cannot conclude before possession

What is established

An under-construction purchase may generate loan interest before the home is complete, and the loan may be described as financing a purchase or construction. The official tables recognise both purchase and construction in the section 24(b) context. They do not say that every pre-possession amount is immediately deductible, nor do they make possession status the sole eligibility test.

What remains to be verified

The official material reviewed for this article does not establish the detailed timing rule for construction-period interest: specifically, it does not resolve when such interest becomes claimable after completion or possession, how the amount is divided among years, or which instalment treatment applies to your facts. Do not state a start year or assume a fixed instalment schedule from memory. Verify the current statutory text, the assessment-year instructions and your tax adviser’s interpretation against the actual completion or acquisition date.

Records to assemble while the project is incomplete

  • Loan sanction letter identifying the borrower, sanctioned date and purpose.
  • Disbursement statements showing each drawdown and the interest charged in each financial year.
  • Builder or seller agreement identifying whether the transaction is a purchase, construction-linked purchase or another arrangement.
  • Completion, occupancy or possession evidence issued by the appropriate authority or contracting party, as applicable.
  • Annual interest certificates for every year in which interest was charged.

These records let you map the statutory timing rule to your own dates. A bank’s interest certificate proves what was charged; it does not, by itself, prove that the amount is deductible in the year you select.

Ready-to-move-in homes: a simpler record trail, not an automatic benefit

A ready-to-move-in home generally involves an acquisition that can be documented with a sale agreement, registration or other purchase records and a possession or completion document. That often makes the dates easier to establish than in a project where construction and handover occur over several years. It does not remove the regime and occupancy tests.

For a self-occupied ready home under the old regime, the AY 2025-26 table’s ₹2,00,000 maximum remains the relevant stated ceiling for qualifying section 24(b) interest. Under the AY 2026-27 new regime, the CBDT validation rules do not permit the self-occupied interest claim. For a let-out ready home, the treatment follows the let-out rules for the selected regime, including the new-regime restriction on setting off or carrying forward a house-property loss.

Side-by-side comparison

Question Under-construction home Ready-to-move-in home
Does the label decide eligibility? No. The official tables use purchase or construction and property use, not a stand-alone “under-construction” category. No. A ready status does not override regime, occupancy or loan conditions.
Main timing issue Interest may be charged before completion; the reviewed official material does not establish the exact claim timing or instalment treatment. Acquisition and possession dates are usually easier to document, but the applicable claim year still needs to be checked.
Old-regime self-occupied treatment (AY 2025-26 guidance) Qualifying section 24(b) interest subject to the ₹2,00,000 maximum shown in the table, with timing still requiring verification. Qualifying section 24(b) interest subject to the same ₹2,00,000 maximum shown in the table.
Old-regime let-out treatment (AY 2025-26 guidance) Actual interest shown without a stated limit, subject to house-property computation rules. Actual interest shown without a stated limit, subject to house-property computation rules.
New-regime self-occupied treatment (AY 2026-27) CBDT validation rules bar the interest claim for self-occupied property. CBDT validation rules bar the interest claim for self-occupied property.
New-regime let-out treatment (AY 2026-27 guidance) Section 24(b) interest is listed, but a house-property loss cannot be set off against other income heads or carried forward. Section 24(b) interest is listed, with the same loss restrictions.

Purchase financing versus construction financing

Do not treat the loan’s marketing description as the tax answer. A ready home may be financed through a purchase loan. An under-construction transaction may use staged construction-linked disbursements, yet the contract may still be a purchase from a developer. The relevant evidence is the legal and financial record: what was acquired or constructed, who owns it, how the borrowing was sanctioned, when amounts were disbursed and when the property reached the legally relevant stage.

Ask the lender for a certificate that separates principal and interest by financial year. Keep the sanction letter and each revised sanction or conversion document. If the loan was transferred, refinanced or supplemented, preserve the old and new account statements so that the interest trail is continuous. These steps do not create eligibility; they prevent a valid amount from being rejected because the record is incomplete.

Section 80EEA: a historic, date-limited route

Section 80EEA is not a general additional deduction for a newly sanctioned home loan today. The Income Tax Department’s AY 2026-27 guidance describes a narrow category for qualifying first-time residential-home borrowers whose loans were sanctioned from 1 April 2019 through 31 March 2022. It is subject to its statutory conditions and to exhaustion of the section 24(b) benefit. A current borrower cannot assume eligibility merely because the home is affordable, under construction or occupied for the first time.

Check the sanction date, first-time-buyer status and every other condition in the applicable law and return guidance. If any condition is uncertain, treat 80EEA as unconfirmed rather than adding it to a tax estimate.

How to decide between the regimes for this loan

  1. Identify the assessment year. Use the guidance for the return year, not the year in which the loan was advertised or the booking form was signed.
  2. Classify occupancy for that year. Record whether the property is self-occupied or let out and retain supporting documents.
  3. Extract eligible interest. Use the lender’s annual certificate, separating interest from principal and noting any pre-completion period.
  4. Apply the regime rule. For AY 2025-26 old-regime self-occupation, compare qualifying interest with the ₹2,00,000 maximum. For AY 2026-27 new-regime self-occupation, do not claim the interest amount. For let-out property, apply the relevant table and the new-regime loss restrictions.
  5. Resolve construction-period timing. Match completion or possession evidence to the current statutory rule. Do not insert a presumed five-year or instalment schedule when your sources do not establish it.
  6. Check legacy provisions separately. Test the 80EEA sanction window and conditions independently; it is not an automatic add-on.
  7. Retain a calculation file. Save the return computation, certificates, agreements and explanations for any difference between bank interest and the amount claimed.

Illustrative outcomes (not personal tax calculations)

Illustration What the sourced guidance indicates
Self-occupied, old regime, qualifying interest of ₹1,40,000 for AY 2025-26 The stated maximum is ₹2,00,000, so the ceiling does not reduce this amount; other statutory conditions still apply.
Self-occupied, old regime, qualifying interest of ₹2,80,000 for AY 2025-26 The table’s maximum limits the section 24(b) deduction to ₹2,00,000.
Self-occupied, new regime, AY 2026-27 CBDT validation rules do not permit the borrowed-capital interest claim.
Let-out, new regime, interest creates a house-property loss Section 24(b) interest is listed, but the loss cannot be set off against other income heads or carried forward under the stated guidance.
Loan sanctioned in July 2021 to an eligible first-time buyer The date falls inside the 1 April 2019–31 March 2022 80EEA window, but all statutory conditions and the section 24(b) exhaustion requirement still have to be met.

Common errors and how to correct them

Using possession status as the only test

Error: assuming every under-construction loan is deferred or every ready home qualifies immediately. Correction: analyse regime, occupancy, loan purpose and documented dates together.

Applying the ₹2 lakh cap to a let-out property

Error: carrying the self-occupied ceiling into every property calculation. Correction: the AY 2025-26 table shows a separate let-out treatment with actual interest without a stated limit, subject to the house-property rules.

Claiming self-occupied interest in the new regime

Error: entering the old-regime deduction in an AY 2026-27 new-regime return. Correction: follow the CBDT validation rule that blocks the self-occupied borrowed-capital interest claim.

Offsetting a new-regime rental loss against salary

Error: treating a large interest amount as an automatic reduction of other income. Correction: the AY 2026-27 guidance says a house-property loss cannot be set off against other heads or carried forward.

Assuming a pre-possession instalment formula

Error: relying on an unverified start year or fixed instalment schedule for construction-period interest. Correction: verify the current statutory text and preserve completion or possession evidence before filing.

Adding 80EEA to a new loan

Error: treating 80EEA as a current universal benefit. Correction: first test the 1 April 2019–31 March 2022 sanction window and every other condition.

Filing checklist

  • Assessment year and selected regime.
  • Self-occupied or let-out status, with dates if use changed.
  • Loan sanction letter, account number and purpose.
  • Year-wise interest certificate and disbursement statement.
  • Sale, construction or builder agreement.
  • Registration, completion, occupancy and possession documents relevant to the property.
  • Ownership and co-borrower details, matching the legal documents and lender records.
  • Separate review of any historic section 80EEA claim.
  • Written explanation for any difference between interest charged and interest claimed.

Before filing, reconcile the return entries with the lender certificate and the assessment-year instructions. If the property was under construction during any part of the period, obtain a current interpretation of the construction-period rule rather than relying on a generic possession date.

The Bottom Line

For India, compare the tax regime and occupancy first: the AY 2025-26 old regime shows up to ₹2,00,000 of qualifying section 24(b) interest for a self-occupied home, while AY 2026-27 new-regime rules bar that self-occupied claim and restrict the use of let-out house-property losses. Under-construction status mainly creates a timing-and-documentation question that must be verified under current law; it does not automatically remove or create the benefit.
