Herbicide Drift and Insurance: What U.S. Farmers’ Policies May Cover

Federal crop insurance generally excludes herbicide drift, but separate liability coverage depends on policy wording. Know what to document and whom to contact.

Federal crop insurance generally does not cover herbicide drift as an insured cause of crop loss. A separate farm or commercial liability policy is a different question: pollution or chemical exclusions, endorsements, policy limits, and the facts of the incident determine whether it may respond. If drift is suspected, document what happened and promptly contact your crop insurer or agent; also check the pesticide-complaint process for your state.

Does federal crop insurance cover herbicide drift?

Generally, no. USDA’s Risk Management Agency (RMA) says dicamba drift, like other chemical damage caused by improper application by the insured or inadvertently by a third party, is not an insurable cause of loss. The common crop insurance policy regulation also excludes an act by any person that affects crop yield, quality, or price, and explicitly names chemical drift as an example. See the RMA dicamba drift FAQ and 7 CFR § 457.8.

This answer concerns federal crop insurance, not every insurance contract. It also does not determine whether someone else may be legally responsible or whether a separate liability policy may cover a claim.

Does a neighbor’s drift count as third-party damage?

RMA’s 2024 Crop Insurance Handbook gives a neighbor’s negligent chemical application that causes drift as an example of third-party damage outside the insured’s direct control. That classification matters for specified documentation and production-history procedures; it does not make drift an insured cause or guarantee an indemnity.

The insured must document the third party’s actions and the resulting production loss. The handbook distinguishes a neighbor’s actions from the insured’s own mistaken instruction and an employee’s action. It places the burden on the insured to prove the damage was due to a third party or another specified category. Consult the current crop-year handbook and your policy for the rules that apply to your crop.

Could farm or applicator liability insurance cover drift?

Possibly, but the policy wording and circumstances control. Liability insurance is separate from crop insurance: crop insurance concerns the insured producer’s crop loss, while liability coverage may address claims alleging that an insured caused damage to someone else.

A Penn State Center for Agricultural and Shale Law fact sheet from May 2022 says a pollution exclusion makes herbicide drift most likely not covered under the liability portion of a farm policy. It advises asking an agent about an endorsement or separate coverage for chemical drift. That Pennsylvania educational guidance is not a rule for every policy or state, and an endorsement’s availability or effect must be confirmed with the insurer.

When reviewing a farm or commercial applicator policy, ask the agent to explain the relevant exclusions and any applicable endorsement in writing. Check who qualifies as an insured, what substances and activities are covered, limits and deductibles, and notice requirements. Do not assume that an exclusion applies—or that an endorsement guarantees payment—without reading the actual contract.

What should you do if you suspect herbicide drift?

  1. Notify your crop insurer or agent promptly. The common federal policy regulation generally requires notice of a planted-crop loss within 72 hours of initial discovery, subject to the regulation’s outer limit and written-confirmation provisions. Your actual policy and crop provisions control, so follow their instructions and keep a record of when and how you reported the loss.
  2. Record observations and preserve available evidence. Note when symptoms were first observed, which acreage is affected and unaffected, and relevant crop, field, yield, application, weather, and communication records already available. Take dated photographs of symptoms and field boundaries. Preserve product labels or application records if accessible. These steps help retain information; none by itself proves the cause.
  3. Ask the insurer what documentation it needs. RMA procedures require documentation for third-party damage. The RMA FAQ says Approved Insurance Providers compare yields from a drift-impacted field with other unaffected fields in the area when assessing possible yield effects from uninsured causes. That appraisal method does not make drift an insured cause or promise an indemnity.
  4. Check your state pesticide regulator’s complaint process. State authorities may receive and investigate drift complaints, but procedures and outcomes vary. Oregon Department of Agriculture guidance, for example, distinguishes spray drift from post-application volatilization and says it investigates complaints when warranted; it may take enforcement action if it identifies a violation of state law. That process is specific to Oregon, not a nationwide procedure.

Spray drift and vapor drift are different pathways

EPA defines pesticide spray drift as pesticide dust or droplets moving through the air during application or soon afterward to a site other than the intended area. Volatilization is a separate pathway: pesticide vapor moves after application. Oregon’s pesticide guidance discusses both. Identifying the possible pathway can help explain what you observed, but an insurance decision still depends on the policy and evidence about the incident.

Which policy and rules apply?

The federal crop-insurance sources cited here apply to the U.S. program. The liability discussion is based on a Pennsylvania university fact sheet, while the complaint example is Oregon state guidance. Policy language, state reporting processes, investigations, and legal rules vary by jurisdiction. Use your own policy, insurer or agent, and state pesticide regulator for case-specific instructions.
