Has India Withdrawn the IGST Exemption on Gold and Silver Imports by Banks?

Official records describe an IGST exemption framework for specified eligible bank and entity imports, but do not establish a general withdrawal. Consignment gold may still attract IGST at Customs clearance.

Official material reviewed for this question does not establish that India generally withdrew the IGST exemption for gold or silver imports by banks. It describes an exemption framework for specified eligible banks and entities, alongside separate rules under which IGST may be payable when a nominated bank clears consignment gold through Customs. Whether an exemption applies depends on the operative notification, the importer’s eligibility and the transaction.

What the official records establish

GST Council records describe an IGST exemption for imports of gold, silver or platinum by specified banks and entities identified under the relevant customs notification and Foreign Trade Policy appendix. This is not a blanket exemption for every bank. The Council’s records explain the framework and list updates; they are not a consolidated statement of the full list currently in force.

The Council’s record of its 54th meeting says DGFT updated the authorized-bank list in 2024 and that Customs Notification 25/2024 amended Notification 50/2017-Customs to implement the update. The official material does not identify an operative notification generally rescinding the bank-import exemption or establish its issue date or effective date. A definitive withdrawal claim therefore cannot be made on the basis of these records alone. The relevant legal instrument is the applicable version of Notification 50/2017-Customs, including amendments, commencement provisions and any conditions for the importer and goods.

When a bank may still pay IGST on imported gold

Exemption eligibility and tax due on a particular import are separate questions. CBIC’s GST Sectoral FAQs address gold imported by a nominated bank on consignment from an overseas supplier. They say IGST is payable when the gold is cleared through Customs: “Accordingly, IGST will be payable on such import of gold by the Nominated Bank at the time of clearance of gold by the Customs.”

The same CBIC answer says the bank is not charged GST a second time merely because it later draws or appropriates that gold from the consignment stock: “There will, therefore, not be another levy of GST.” The answer concerns the same consignment supply already treated as having taken place; it does not establish that every bank or every import qualifies for an exemption. Do all banks qualify?

No. The framework described in the Council records applies to specified eligible banks or entities, not all banks by virtue of being banks. A bank or importer must check its status against the currently operative authorized list and satisfy the notification’s conditions. The cited Council records do not provide a verified, current bank-by-bank list, so they cannot establish whether a particular importer is eligible today.

Do passenger concessions or other customs changes prove withdrawal?

No. A 2026 government explanatory memorandum discusses gold and silver concessions for eligible passengers under Customs Notification 45/2025. Those passenger-baggage provisions are distinct from the bank-import exemption framework under Notification 50/2017-Customs. Changes to passenger concessions, customs tariff values or an authorized-bank list do not, by themselves, demonstrate that the bank-import exemption was withdrawn. How to verify a claim that the exemption ended

Before relying on a report that the exemption has been withdrawn, identify the legal instrument it cites and check the change against the transaction at issue. A GST Council meeting record, explanatory memorandum or FAQ can help explain the framework, but it is not a substitute for the operative Gazette notification.   • Notification and amendment: Find the exact notification number and amendment text, and confirm whether it changes Notification 50/2017-Customs.
  • Effective date: Check the commencement clause and any transition or savings provisions.
  • Importer: Confirm the bank or entity’s current authorization and whether it falls within the notified category.
  • Goods: Check the metal, form and tariff classification covered by the relevant entry.
  • Transaction: Establish whether the import is an outright purchase or a consignment arrangement, and identify when Customs clearance occurs.
  • Levy: Make sure the claim concerns IGST rather than customs duty or another charge.

The statutory power to grant exemptions provides background, but it does not answer whether a particular import is exempt; that turns on the applicable notification and facts. CBIC tax-information portal, tax information.
