If you receive a GST summons in India, treat it as a formal notice and act promptly: a person who fails to appear before a central tax officer when summoned to give evidence or produce a document in an inquiry may face a penalty of up to ₹25,000. The official materials cited here do not establish a general right to refuse particular questions or a general entitlement to have an advocate present during questioning. Before declining to answer, signing a statement, or missing an appearance, get advice on the specific summons and your circumstances.
When do you have to appear for a GST summons?
A summons requiring you to appear before a central tax officer to give evidence or produce a document in an inquiry should not be ignored. CBIC’s consolidated GST Acts database states that a person who “fails to appear before the officer of central tax, when issued with a summon for appearance to give evidence or produce a document in an inquiry” may face a penalty extending to ₹25,000. That is a possible maximum, not an automatic penalty in every case.

The available statutory result does not reproduce the full current text of section 70, all applicable procedures, or a complete summons form. Read the actual document carefully and seek legal advice if you cannot comply as written. Do not assume that an informal phone call, a text message, or an unverified payment demand is itself a valid summons.
Check what the summons requires
Before responding, review the issuing authority, identifier, stated purpose and statutory basis, appearance date and time, place or permitted mode, and the documents or evidence requested. Your position may also depend on your role in the matter—for example, whether you are the taxpayer, an employee, a director, or a third party—and on whether the requested answer or record could expose you to criminal liability.

Verify a communication that seems suspicious
DGGI’s official public-services information describes verification using a DIN, an eOffice Issue Number, or a GSTN RFN, depending on the communication and the platform through which it was issued. Use the applicable official verification facility and identifier. The fact that these identifiers are available does not mean every GST summons will carry all of them. Do not rely only on an unsolicited call, payment demand, or link in a message you have not verified.
What should you do if you cannot attend or provide a document?
Contact a qualified Indian GST or tax lawyer promptly. Explain the deadline and why you cannot comply, and ask about an appropriate documented response, a request to reschedule, or an objection to the request. A request for more time is not guaranteed to be accepted, and this practical step does not itself suspend the summons.

If the demand is unclear, ask for clarification through an appropriate documented channel and obtain advice about what records to preserve or produce. Do not ignore the summons while waiting for a response. Keep the summons, verification details, correspondence and any response together so you can establish what you received and how you acted on it.
Can you decline to answer questions?
The official materials cited here do not settle a general right to refuse particular questions in a GST inquiry. They do not establish a reliable list of questions that a person may decline, or resolve how questioning under section 70 interacts with the constitutional protection against compelled self-incrimination in different circumstances. Your legal status, the inquiry and the specific question matter.
Do not refuse a question solely because it feels uncomfortable, irrelevant, or potentially incriminating without first getting legal advice. If you do not understand a question, ask for it to be clarified. If you are unsure of a fact or need to inspect records, say so rather than guessing or speculating. Seek advice before refusing to answer, signing a statement, or making an admission—especially where an answer may expose you to criminal liability.
Can an advocate sit in during questioning?
The official materials cited here do not establish a general entitlement to have an advocate present during GST questioning, and they do not support a categorical answer that an advocate is always permitted or always excluded. Ask a lawyer about current applicable authority and directions before the appearance; do not treat counsel’s attendance as assured.

Does a defect make the summons invalid?
Not necessarily. Section 160, as rendered in CBIC’s consolidated Act database, says a proceeding, including a summons, is not invalid merely because of a mistake, defect, or omission if it is in substance and effect in conformity with the Act’s purposes and requirements. The section also limits challenges to service where the communication has already been acted upon or the issue was not raised in earlier proceedings.

1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThat is not a blanket rule that every summons is valid or that every objection will fail. The issuing authority, service, wording, statutory purpose and procedural context can matter. If you believe there is a defect, get prompt advice on the specific document rather than disregarding it.
