GST Registration Threshold and Requirements for Businesses in Jammu and Kashmir

In Jammu and Kashmir, services and mixed supplies generally use a ₹20 lakh GST threshold. Eligible exclusive goods suppliers may qualify for an exemption up to ₹40 lakh, subject to notification conditions and other registration triggers.

For a business in Jammu and Kashmir (J&K), the general GST registration threshold is ₹20 lakh in aggregate turnover for services and mixed supplies. A business supplying only goods may qualify for an exemption up to ₹40 lakh, but only if it meets the applicable notification’s conditions and exclusions. These are not separate limits for each shop or state: aggregate turnover is calculated across India for the same PAN.

Turnover is only the starting point. Certain activities listed in section 24 of the Central Goods and Services Tax Act (CGST Act) can require registration below the ordinary limit, while notifications create exceptions for some cases. A business with interstate supplies, reverse-charge liability, mixed goods and services, or e-commerce activity should check the exact rule before deciding it can remain unregistered.

What is the GST registration threshold in Jammu and Kashmir?

The ordinary threshold depends on what the business supplies. The Central Board of Indirect Taxes and Customs (CBIC) described a ₹20 lakh threshold for service providers and a conditional ₹40 lakh level for persons exclusively supplying goods in its 2019 threshold update. Jammu and Kashmir’s taxation department lists the state notification concerning the ₹40 lakh exemption for exclusive goods suppliers. The ₹40 lakh figure is therefore not a general threshold for every business that sells goods; the exemption’s conditions and exclusions matter.

Business supply profile General threshold or treatment Important qualification
Services ₹20 lakh aggregate turnover The CBIC’s 2019 update describes ₹10 lakh for specified special-category states. J&K is not included in the section 22 special-category definition relevant to that lower threshold.
Goods only May qualify for exemption up to ₹40 lakh Applies only to eligible persons exclusively supplying goods and subject to the relevant notification’s conditions and exclusions.
Goods and services, or another mixed supply profile Generally ₹20 lakh Do not apply the exclusive-goods exemption just because goods make up most of the business.

The CBIC update dates from 2019; for a registration decision in 2026, check the current consolidated Act and the applicable notification, including later amendments, rather than relying on an old summary alone.

Why J&K does not use the ₹10 lakh special-category figure

The CGST Act’s section 22 explanation identifies the states treated as special-category states for the relevant threshold provision and excludes Jammu and Kashmir from that definition. As a result, the ₹10 lakh figure cited for specified special-category states should not be presented as the blanket services threshold in J&K. The threshold described for services there is ₹20 lakh, subject to any other registration rule that applies to the business.

This distinction is easy to miss because older summaries may group different states together or describe “special category” broadly. For a J&K business, the relevant question is not simply whether an article calls the state special-category; it is how the current section 22 and applicable notifications treat the business and supply in question.

How to calculate aggregate turnover

Aggregate turnover is calculated across India for all business activity under the same PAN. It is not a separate allowance for each outlet, district, branch, or GST registration. The CBIC sectoral FAQ explains that supplies across states are combined for the PAN-wide calculation. A business operating in J&K and another state cannot ordinarily assess each location against its own standalone threshold.

The statutory definition in section 2(6) sets out what is included in and excluded from aggregate turnover. It is not safe to equate the figure automatically with taxable sales, cash received, or revenue recorded for one location. When calculating whether the threshold has been crossed, consult the current statutory definition and assess the supplies it covers. The CGST Act is the reference for that definition; the CBIC sectoral FAQ explains the all-India, same-PAN principle.

A practical turnover check

  1. Identify the PAN. Group the relevant business activity under the same PAN, including activity carried on through more than one location or state registration.
  2. List the supplies. Distinguish goods, services, and mixed supply activity. Do not assume that a business qualifies as an exclusive goods supplier if it also makes supplies that take it outside the notification’s conditions.
  3. Apply the statutory definition. Use section 2(6) of the current CGST Act to determine what belongs in aggregate turnover and what is excluded; do not rely on a simplified sales-only estimate.
  4. Compare with the right threshold. For services or mixed supplies, use the general ₹20 lakh threshold described for J&K. Consider the ₹40 lakh exemption only if the business supplies goods exclusively and meets the notification’s terms.
  5. Check for a separate registration trigger. Assess section 24 and relevant notifications, even if the calculated amount is below the ordinary limit.

This process identifies the threshold question, not every possible consequence of GST registration. The nature of the supplies, where they are made, and the business’s role in a transaction can affect the result.

Can a business below the threshold still have to register?

Yes. Section 24 of the CGST Act identifies categories that may be required to register notwithstanding the ordinary section 22 threshold. The statute and government notifications also provide exceptions, so a category label alone does not settle every case. A business should check both the applicable statutory provision and any notification covering its specific activity.

  • Interstate taxable supplies: Certain persons making taxable supplies across state or union-territory borders are covered by section 24, but exceptions and notified cases can affect the outcome. The fact that a business sells online or ships outside J&K is not, by itself, enough to determine the answer without checking the exact supply and applicable rule.
  • Casual taxable persons: A person making taxable supplies in a state or union territory where they do not have a fixed place of business may fall into this category. The GST Portal describes a distinct advance application and deposit process; it should not be treated as an ordinary threshold-based application.
  • Persons liable under reverse charge: Section 24 includes persons liable to pay tax under reverse charge, subject to the Act and relevant notifications. The question depends on the transaction and whether a notified exception applies.
  • Non-resident taxable persons: A non-resident taxable person can face a separate registration rule, with its own requirements.
  • Specified agents and input service distributors: The Act identifies specified agents and input service distributors among registration categories that may not follow the ordinary turnover test.
  • Certain e-commerce-related persons: Section 24 addresses specified e-commerce roles. Rules and notifications differ depending on whether a business operates through an electronic commerce operator, what it supplies, and what role the operator plays.

These are screening questions, not a claim that every interstate seller, online seller, or small business must register. Notification-based exemptions and changes to the law can alter the result. Review the current text of section 24 of the CGST Act and any relevant notification before relying on a below-threshold exemption.

When the ₹40 lakh goods exemption needs closer review

The J&K notifications index lists Notification No. 10/2019-State Tax concerning an exemption for persons exclusively supplying goods with aggregate turnover not exceeding ₹40 lakh. The words “exclusively supplying goods” are material: the figure should not be carried over to a business with services or mixed supplies without checking eligibility. The notification also has conditions and exclusions, so meeting the turnover figure alone does not prove that the exemption applies.

The notifications index is a useful starting point, but a live decision should be based on the underlying notification and any later amendments. The J&K GST notifications index identifies the state measure; the CBIC threshold update provides the central background to the 2019 threshold change. Neither should be read as a substitute for checking the current legal text against the facts of an individual business.

When must a liable business apply?

Under section 25 of the CGST Act, a person liable under section 22 or section 24 generally must apply for registration in each state or union territory where it is liable within 30 days after liability arises. The deadline runs from the date the business becomes liable, not from the date it later discovers the rule.

The GST Portal guide says that, for a normal taxpayer, applying within 30 days makes registration effective from the date liability arose. If the application is filed late, liability still dates from when it arose, while registration becomes effective from the date it is granted. This can matter when deciding whether to delay an application while waiting for turnover records or clarification. Casual taxable persons follow a separate advance timing and deposit process, so the normal-taxpayer timeline should not be applied to them.

How to apply for GST registration through the GST Portal

The GST Portal’s normal-taxpayer guide directs applicants to begin at gst.gov.in. It describes an electronic application with business, identity, place-of-business, goods-and-services, authentication, and verification details. PAN is mandatory in the guide’s normal-taxpayer process. The portal’s form labels and screens can change, so follow the live guide rather than relying on old screenshots or an outdated field-by-field checklist.

  1. Open the new-registration route. On the official GST Portal, choose Services > Registration > New Registration.
  2. Choose the registration type and location. Select the taxpayer type, state or union territory, and district requested in the application.
  3. Enter PAN-linked identity and contact details. Supply the legal name as recorded against the PAN, the PAN, and the email address for the primary authorized signatory. The guide identifies PAN as mandatory for the normal-taxpayer process.
  4. Complete the application sections. Provide the requested details for the business, promoters or partners, authorized signatory, place of business, goods and services, and state-specific information.
  5. Complete authentication and verification. Follow the portal’s current electronic validation and authentication prompts, then verify and submit the application as directed.
  6. Track the application through the portal. Keep the details and records used in the submission available so that you can respond to any portal request or validation issue.

The application is electronic and is followed by portal validation and authentication steps. The linked GST Portal guide for a normal taxpayer is the authoritative practical route for current prompts and procedure; this article does not reproduce field names that may become outdated.

Information to have ready

  • The PAN and legal name associated with it.
  • The email address for the primary authorized signatory.
  • The taxpayer type, state or union territory, and district applicable to the application.
  • Business and promoter or partner details, plus the authorized signatory’s details.
  • Place-of-business information and the relevant goods and services details.
  • Any state-specific information and authentication material requested by the portal.

These are the categories described in the portal guide, not a promise that every application will have identical fields or requirements. Use the application’s current instructions for the documents and validations it actually requests.

How to decide which rule applies to your business

For a straightforward business, the threshold question may be simple. For a business that sells across state lines, combines goods and services, or falls within a section 24 category, it is a sequence of checks. Work through them in this order:

  1. Classify the supply profile. Is the business supplying services, goods only, or both? The potential ₹40 lakh exemption is limited to eligible exclusive goods suppliers.
  2. Calculate PAN-wide turnover. Aggregate relevant turnover across India under the same PAN using the current statutory definition, rather than measuring each shop or GST registration separately.
  3. Check section 24. Look for a compulsory-registration category that may apply independently of the ordinary threshold, including the relevant interstate, reverse-charge, non-resident, agency, input-service-distributor, or e-commerce circumstances.
  4. Find the applicable exception, if any. Check whether an Act provision or current notification changes the result for the exact supply and business role. Do not assume that an exception for one class of supplier covers another.
  5. Confirm where liability arises and act on time. If liable in J&K or another state or union territory, apply in each place where required and observe the applicable deadline. A casual taxable person has a separate process.

A J&K establishment does not make all of the business’s turnover local for threshold purposes, and a J&K location alone does not decide whether interstate or other compulsory-registration rules apply. The relevant facts include the same-PAN turnover across India, the type and place of supply, the taxpayer’s role, and the current notification conditions.

Common threshold mistakes to avoid

  • Using ₹10 lakh as J&K’s general threshold. The section 22 special-category definition excludes J&K for this threshold. The ₹20 lakh services figure is the general threshold described for the state, subject to other rules.
  • Assuming every goods seller gets ₹40 lakh. The exemption is for qualifying persons exclusively supplying goods and is conditional. Mixed supply activity can change the analysis.
  • Counting each branch separately. Aggregate turnover is PAN-wide and all-India, not a separate threshold for each shop, district, or state registration.
  • Assuming below-threshold means no registration duty. Section 24 and notifications must also be checked.
  • Treating an online sale or interstate transaction as automatically decisive. The precise supply, business role, and applicable exception or notification matter.
  • Waiting until the portal application is convenient. For a person liable under the ordinary rules, the general deadline is 30 days after liability arises. Filing late does not move the date liability began.

The official sources for the threshold and process are the CBIC threshold update, the CGST Act, the J&K notifications index, and the GST Portal registration guide. For an individual case with mixed supplies, interstate activity, reverse-charge exposure, or a disputed turnover calculation, confirm the current provisions and notification wording before relying on an exemption.
