GST Investigation Checklist for Small Businesses in India: Records and Steps

Learn how small businesses in India can assess a GST communication, organise supporting records, reconcile return figures and preserve a clear response trail.

If your Indian business receives a GST notice or investigation request, first identify the action and its exact deadline. Then preserve the relevant records, reconcile them to the GST returns, and send an indexed response that you can prove was submitted. The steps and time limits depend on the type of proceeding; an audit, return scrutiny, summons, search and other investigation actions are not interchangeable.

First identify what kind of GST communication you received

This checklist concerns GST under India’s CGST framework. It is not a guide to GST or GST/HST procedures in other countries, where notice processes and record-retention rules may differ.

Save the communication and its attachments in their original form. Note when and how it was served, then extract the details below before gathering records. Do not assume that every officer’s communication is an audit notice or that one response deadline applies to every action.

  • Issuing authority and officer, plus any reference, form or case number.
  • Your GST registration and the tax period or transaction covered.
  • The issue being examined and the records or explanation requested.
  • The response deadline, submission method and any stated appointment or other required action.
  • The date and method of service, along with all attachments.

Verify the communication through appropriate official channels. If its scope, authenticity or deadline is unclear, seek qualified advice promptly and ask the issuing office for clarification through a documented channel.

How scrutiny, audit and other investigation actions differ

The limited distinctions below are supported by the cited CGST Act and rules. They are not a complete procedural guide to every enforcement power or taxpayer remedy.

Action What to look for Specific time rule supported by the cited material
Return scrutiny A discrepancy may be communicated in FORM GST ASMT-10, asking for an explanation. The explanation period specified by the officer cannot exceed 15 days from service under the cited scrutiny rules. This is not a general deadline for all GST notices.
Audit by tax authorities The audit may take place at the business premises or at the officer’s office. An authorised officer may require access to books and documents and information needed to complete the audit. The cited CGST Act provision requires at least 15 working days’ notice. Audit findings, the taxpayer’s rights and obligations, and the reasons for findings must be communicated within 30 days after the audit concludes.
Other investigation actions, including summons, search or seizure Read the specific communication carefully and get advice appropriate to the action. Do not assume audit procedures apply. The cited materials do not establish a single deadline or a complete procedure for these distinct actions.

The 2023 Model All-India GST Audit Manual describes audit planning, notices, questionnaires, document requests, findings and follow-up. It is a model manual, not a substitute for current law, later instructions or advice on a live matter.

What records should a small business gather?

Use the period and issues in the actual communication to scope your file. Gather records that substantiate the figures or transactions at issue; do not assume every business must create or submit every document that could be relevant in an audit.

  • Returns and workings: GST returns, filing acknowledgements and the calculations or workpapers used to prepare them.
  • Sales and purchases: sales and purchase invoices, credit and debit notes, and relevant supplier records.
  • Books and financial records: general ledger, sales and purchase registers and, where maintained, trial balance, profit-and-loss account, balance sheet and relevant notes.
  • Tax and claim support: records supporting tax collected or paid, exemptions or deductions, input tax credit (ITC), refunds and relevant adjustments.
  • Transaction evidence: relevant contracts, delivery or service evidence, payment records and correspondence that support the transaction under review.
  • Reconciliations: workings that connect the books to the GST returns and explain variances.

The Model All-India GST Audit Manual 2023 includes items such as annual reports, financial statements, notes to accounts, and tax or cost audit reports where maintained. Its annexure describes the list as illustrative and says the documents needed depend on the audit; it does not make every item mandatory for every small business or every investigation.

Reconcile the figures before preparing your reply

For each issue raised, prepare a short schedule that shows where the number came from and how it ties to the return. Depending on the issue, an audit may examine turnover, exemptions or deductions, tax rates, ITC availed and used, and refunds.

  1. Write down the amount or transaction identified in the notice.
  2. Match it to the relevant return entry, ledger account and underlying invoice or other evidence.
  3. Show the calculation used to reach the reported amount and identify any difference.
  4. Explain the difference with dated workings and supporting documents. If a correction has been made or is proposed, describe the action accurately and retain evidence of it.

Do not make an unsupported admission or submit figures you have not checked. If the records do not explain a discrepancy, or the issue may create a disputed tax demand, get professional advice before responding.

Submit a traceable, focused response

  1. Answer the request actually made and follow the deadline and response method stated in the applicable communication.
  2. Number the attachments and prepare an index that maps each requested item to the document or explanation supplied.
  3. Keep a complete copy of the notice, attachments, response and every document sent.
  4. Retain proof of submission or delivery, and record any follow-up commitment or appointment.

This recordkeeping approach makes it easier to show what you provided and when. It is practical guidance, not a separate statutory formality. The ASMT-10 explanation window described above must not be applied to a different notice without checking its own governing rule and terms.

When to involve a GST professional or lawyer

A qualified GST practitioner or chartered accountant may help reconcile accounts and prepare a technical response. Consider a tax lawyer when the matter involves a disputed demand, compulsory questioning, search or seizure, or possible prosecution. Seek advice promptly if the deadline is unclear or close; do not ignore a summons.

The available sources do not set out a universal deadline for every investigation response or a complete account of remedies. For a live matter, the exact notice and the current law applicable to it should guide the next step.

How long should you keep GST investigation records?

Keep the records relevant to a live communication, along with the response and proof of submission, for as long as needed to manage the matter and any related proceedings. The sources cited here do not establish an Indian GST record-retention period, so this checklist does not assign one. Do not apply Canada’s separate GST/HST retention guidance to an Indian business.
