GST “Faceless Assessment”: How to Identify a Notice and Respond

“GST faceless assessment” can refer to different portal-based and statutory proceedings. Identify the notice, applicable section, tax period and deadline before replying.

“GST faceless assessment” is not the name of one universal GST procedure. The response depends on the actual notice: its form, legal provision, tax period, service date and issuing authority. First identify whether you have a return-scrutiny notice, a non-filer assessment, a tax-demand notice, a refund notice or an order that may require an appeal. Then follow the form and deadline that apply to that specific process.

What “GST faceless assessment” means—and what it does not

The phrase can suggest that every GST assessment follows one standard online process. That is not established by the official material covered here. The CBIC item titled “Faceless Assessment” concerns Customs: standard examination orders through the Risk Management System. GST materials instead describe distinct statutory procedures and portal-based forms. A notice may be handled electronically, but that does not make its legal route interchangeable with another GST notice.

For a recipient, the practical question is not whether a document is called “faceless.” It is what action the officer has started, what provision governs it, and what response that process requires. A return discrepancy, a failure to file a return, an alleged short payment of tax and a proposed refund rejection each call for different analysis. Do not use a generic reply or assume one deadline applies to all of them.

Identify the notice before drafting a reply

Open the communication in the GST Portal, if it is available there, and record the details that determine the next step. A PDF saved or forwarded outside the portal may omit context such as the linked proceeding, reply facility or subsequent order.

  • Form number: for example, ASMT-10, an assessment order under section 62, or RFD-08.
  • Legal provision: note the section or rule cited. The form number alone may not tell you the full legal basis.
  • Tax period: record the financial year or return period. This is especially important for demand proceedings because the applicable law can differ by period.
  • Procedural stage: determine whether this is an initial notice seeking an explanation, an assessment or demand order, or another final decision.
  • Authority and reference: save the issuing authority, reference number and related portal details.
  • Dates and deadline: note the issue date, service or receipt date, and the response date stated in the notice or governing rule. Where the applicable rule measures time from receipt or service, use that date—not an assumed date based on when someone forwarded the PDF.

These details are not administrative trivia. They tell you what to answer, which filing route to use, and whether you are still at the reply stage or need to consider a separate remedy against an order.

Common GST notice paths are different

Notice or proceeding What it concerns Relevant response route
Section 61 scrutiny; ASMT-10 Discrepancies identified in a return after scrutiny Respond to the discrepancy notice in ASMT-11; ASMT-12 is the order accepting the reply.
Section 62 non-filer assessment A registered person has not filed a section 39 or section 45 return even after a section 46 notice Check the assessment order and the section 62 filing provisions; a valid return within the specified statutory window can have a particular consequence.
Sections 73, 74 or 74A demand framework Alleged unpaid or short-paid tax, erroneous refund, or wrongly availed or utilised input tax credit Use the provision applicable to the tax period and alleged grounds. Check the notice for its prescribed response method and deadline.
Refund proposal; RFD-08 The officer considers all or part of a refund inadmissible or not payable Reply using RFD-09 within 15 days of receipt under the refund procedure.

The table is a way to orient yourself, not a substitute for reading the notice. In particular, the 15-day period belongs to the specified RFD-08 refund procedure. It is not a general deadline for GST notices.

If you received ASMT-10 for return scrutiny

Section 61 scrutiny is a discrepancy-focused exchange. The GST forms catalogue describes ASMT-10 as the notice intimating discrepancies in a return after scrutiny, ASMT-11 as the taxpayer’s reply, and ASMT-12 as the order accepting that reply. The notice should identify the issues the officer wants addressed. Structure your response around those issues rather than sending a broad narrative about the business.

  • Large Size for Everyday Documents: cover measures about 13 x 9.65 inches, with inside pages about 9.65 x 6.5 inches; The spacious pocket design provides room for receipts, statements, records, and tax-related papers without taking up too much desk or shelf space

  • Spiral Bound for Convenient Access: the secure spiral binding lets pages turn smoothly, so you can quickly add, remove, or review documents whenever needed; A practical design that helps simplify filing and reduce last-minute stress during tax season
  • Widely Applied: this annual tax organizer is suitable for managing annual taxes, tracking receipts and preparing for audits all year round, making your tax preparation more systematic and manageable, and it is very suitable for annual tax returns, document storage and filing, professional tax services and tax agencies
  1. Make a list of every discrepancy. Preserve the notice’s numbering or labels so each answer can be matched to the point raised.
  2. Reconcile the figures. Compare the relevant return entries with the underlying books, invoices, ledgers, payment records and other transaction documents. Explain differences in the periods or figures being compared.
  3. State your position on each point. Say whether you agree, disagree or agree in part. If you disagree, explain the facts and show how the records support your position.
  4. Attach relevant evidence. Give files clear names and identify which notice point each one supports. An attachment is more useful when the reply explains what it shows and how it ties to the amount in question.
  5. Submit through the prescribed route. Use the portal workflow and reply form indicated for the proceeding, and save the acknowledgement and a copy of what you filed.

This organization is practical drafting guidance; the notice, form instructions and governing law control what must be filed. A reply that discusses the issue without reconciling the actual figures can leave the central discrepancy unanswered.

If you received a section 62 non-filer assessment

Section 62 addresses a registered person who has not furnished a return under section 39 or section 45 even after service of a section 46 notice. The proper officer may assess tax liability to the best of the officer’s judgment, taking account of relevant material available or gathered. The section’s wording is:

“the proper officer may proceed to assess the tax liability of the said person to the best of his judgement taking into account all the relevant material which is available or which he has gathered”

That power makes it important to establish which return was missing and what material the assessment used. Check the assessment period, the returns filed or outstanding, the underlying records, and whether the notice and order relate to the same tax period.

The section text reviewed for this guide provides a route under which a valid return filed within 60 days after service of the assessment order deems the order withdrawn. Interest under section 50 and late fee under section 47 continue. It also sets out a further 60-day filing window subject to an additional late fee of ₹100 per day beyond the first 60 days. These are statutory consequences described in the retrieved text, not a reason to assume that every case has the same dates or that filing alone resolves all amounts due.

Before relying on either window, check the current version of section 62 applicable to the case, the date the assessment order was served, the return that must be filed, and the amounts due. Keep proof of filing and payment. If the return is not validly filed, or the relevant dates are disputed, do not assume the order has been withdrawn.

If the notice alleges unpaid tax, an erroneous refund or an ITC issue

A demand proceeding requires attention to both the allegation and the tax period. Sections 73 and 74 address different grounds in the retrieved official text: section 73 covers cases other than fraud, wilful misstatement or suppression to evade tax; section 74 covers fraud-related grounds. The official material notes that sections 73 and 74 apply to determinations for tax periods through financial year 2023–24 and refers to section 74A in the amended statutory landscape.

Do not treat a section 73 or 74 explanation as automatically governing a later period. The tax period and alleged conduct affect the applicable provision, limitation, available payment options, potential penalty consequences and reply procedure. A demand notice may also concern more than one category of issue, such as tax alleged to be unpaid or short-paid, an erroneous refund, or input tax credit alleged to have been wrongly availed or utilised. Read the grounds in the notice, not just its heading.

For context, the section 73 text retrieved for this guide describes payment of tax plus interest within 30 days of issue of a show-cause notice as a route under which no penalty is payable and proceedings in respect of that notice are deemed concluded. It also gives a three-year order period for relevant determinations. The retrieved section 74 text describes a distinct fraud-related route and a five-year order period, with a different post-order payment consequence. These details are period-sensitive and should not be used as current case-specific instructions until you confirm that the provision applies to the period and facts in the notice.

For a substantive demand, reconcile the allegation against the relevant returns, invoices, ledgers, prior replies and payment records. Identify what is admitted, what is disputed and why. If fraud or suppression is alleged, the period is contested, the amount is material, or the records do not reconcile, consult a qualified GST practitioner or tax lawyer before choosing a payment or response route.

If you received RFD-08 about a refund

RFD-08 is an example of why deadline assumptions are risky. Under the refund procedure described in the official rule, if the officer considers all or part of a refund inadmissible or not payable, the officer issues FORM GST RFD-08 and requires a reply in FORM GST RFD-09 within 15 days of receipt. Check the receipt date and the notice’s instructions, prepare a point-by-point response to the proposed rejection, and submit through the specified route in time.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That 15-day period is tied to this refund process. It should not be carried over to ASMT-10, a section 62 order or a demand proceeding unless the rule governing that particular matter says so.

Verify the electronic communication

Use the GST Portal’s “Verify RFN” service where applicable to check the Reference Number of the communication. GSTN’s advisory explains that portal-issued communications can be verified through this route and addresses cases where a downloaded document does not display a visible digital signature. A missing visible signature, by itself, is not a sound basis to disregard a communication; authenticate it using the portal and follow the instructions for the proceeding.

Save the portal result, communication and related reference details with your records. If you cannot locate or verify the document, use the official portal’s available help or contact route and preserve evidence of the steps you took. Do not let an unresolved authentication question cause you to miss a deadline that the notice or applicable rule imposes.

How to prepare and file a useful reply

Once you have identified the proceeding, build one response around its specific allegations. The following sequence works across notice types, while the prescribed form and filing instructions still control:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Locate the notice and record its particulars. Capture the form, section, period, issuing authority, reference number, service date and deadline.
  2. Authenticate the communication. Verify the RFN through the GST Portal where that service applies, and retain a copy of the verified notice.
  3. Extract each allegation or discrepancy. Make a numbered list and note the figures, return periods and records cited by the officer.
  4. Gather the matching records. Compare the relevant returns with invoices, ledgers, payment records, earlier replies and transaction documents. Keep the comparison specific to each point.
  5. Draft a point-by-point answer. State the facts, reconcile amounts, identify admitted and disputed issues, and explain what each attachment establishes. Avoid unsupported general denials.
  6. Use the prescribed form and portal workflow. File before the deadline stated by the applicable notice or rule. If the official instruction specifies another filing route, follow it and preserve proof.
  7. Save the complete submission. Retain the reply, attachments, acknowledgement and any payment confirmation together with the notice.
  8. Track what happens next. Monitor the portal for an order or further communication and record its service date. If an order has issued, determine the applicable appeal or rectification route and time limit from the order and current law; an initial notice reply is not a substitute for a statutory appeal.

Common mistakes that can make a reply less effective

  • Treating “faceless” as the legal category. The label does not identify the applicable GST form, section or remedy.
  • Using the wrong form. ASMT-11, a section 62 return route, a demand response and RFD-09 belong to different procedures.
  • Assuming a universal deadline. Deadline rules vary; the RFD-08 example has a specific 15-day reply period, not a GST-wide one.
  • Ignoring the tax period. The applicability of sections 73, 74 and the later section 74A framework can turn on the period and grounds.
  • Sending documents without a map. Label each attachment and explain which allegation it supports.
  • Stopping after an order. A reply stage and a challenge to an issued order are different procedural steps. Check the order for the available route and time limit.
  • Assuming a portal issue extends time. Preserve evidence of a technical problem and follow official instructions, but do not assume the deadline is paused unless the applicable authority or rule provides for it.

When to get professional help

Consider speaking with a qualified GST practitioner or tax lawyer when the amount at stake is material, fraud or suppression is alleged, limitation is disputed, records do not reconcile, or an order has already been issued. These matters can involve consequential choices about admitting liability, making a payment, contesting a demand or pursuing an appeal. Bring the notice and order, relevant returns, supporting records, prior correspondence, portal acknowledgements and a timeline of service dates to the consultation.

The decisive first step is classification: identify the actual GST proceeding and its stage. From there, the form, legal provision, period, deadline and available next step can be checked against the notice and current law rather than inferred from the phrase “faceless assessment.”
