For an appealable GST demand order, taxpayers should ordinarily consider a statutory first appeal under section 107 of the applicable GST Act. A writ petition under Article 226 of the Constitution is not a substitute merits appeal: a High Court may decline to hear an ordinary challenge when a statutory appeal is available, while retaining discretion in exceptional cases involving issues such as jurisdiction or denial of natural justice. If you are asking, “GST demand order appeal vs. writ petition: which remedy should taxpayers consider?”, the immediate priority is to identify the order’s communication date and protect the appeal deadline.

How the two remedies differ

The choice depends on what is being challenged and what relief is needed. Section 107 provides a statutory route to challenge an adjudicating authority’s decision or order. A writ petition asks a High Court to exercise its constitutional jurisdiction; it is not simply another forum for re-arguing the merits of an appealable demand.

Question Section 107 appeal Article 226 writ petition
What is it generally suited to? A challenge to the demand’s merits, including disputed tax facts, evidence, or the adjudicating authority’s reasoning. Assessment of an exceptional public-law issue, such as a genuine jurisdictional defect, constitutional challenge, or denial of natural justice.
Is there a prescribed first-stage time limit? Yes. Three months from communication of the decision or order, with a possible extension of up to one further month for sufficient cause under section 107. The cited sources establish no equivalent statutory appeal window for a writ. Filing a writ should not be assumed to stop or extend the section 107 clock.
What does the forum review? The Appellate Authority can make further inquiry and confirm, modify, or annul the order under section 107(11). A writ is not an assured second merits review; the existence of an effective statutory appeal weighs heavily against hearing an ordinary merits challenge.
What payment or recovery protection applies? Section 107(6) requires payment of admitted dues in full and 10% of the remaining disputed tax; section 107(7) deems recovery of the balance stayed after the prescribed payment. A writ filing does not automatically provide the same statutory stay or payment consequence.

When a statutory appeal is usually the right starting point

If the complaint is that the authority assessed the facts incorrectly, misunderstood the evidence, applied the tax law incorrectly, or reached an unsound conclusion on the demand, section 107 is ordinarily the first route to consider. It is a merits remedy, not merely a formality before approaching a court: the Appellate Authority may conduct further inquiry and decide whether to confirm, modify, or annul the order. It may not send the case back to the original adjudicating authority under section 107(11).

The Delhi High Court’s 29 July 2025 judgment illustrates the alternative-remedy principle. It declined to entertain a writ challenging an appealable order while a section 107 appeal remained available, and noted the Appellate Authority’s ability to consider the matter on its merits. The court allowed that particular petitioner to file an appeal by 31 August 2025 with the required pre-deposit. That case-specific direction is not a general extension of the statutory deadline or a guarantee that a late appeal will be accepted in another case.

When a writ petition may merit legal assessment

A taxpayer may want counsel to assess writ jurisdiction where the record raises a genuine issue beyond an ordinary disagreement about the demand—for example, a substantial jurisdictional defect, a constitutional challenge, or a denial of natural justice. Whether an exception applies depends on the order, the procedural record, the applicable law, and binding precedent in the relevant High Court. The possibility of such an argument does not make a writ an assured alternative to filing the statutory appeal.

Procedural posture also matters. A challenge to the original demand is different from a challenge to an appellate order, an interim recovery measure, or detention of goods. In a Supreme Court judgment dated 31 October 2023 concerning detained goods, the record described both a section 107 appeal against a demand and separate writ proceedings involving release of the consignment and interim relief. That history shows that distinct issues can arise in parallel proceedings; it does not make a writ the normal replacement for an appeal against the demand.

What is the GST appeal time limit?

Under section 107 of the CGST Act, a person aggrieved by an adjudicating authority’s decision or order generally has three months from the date the decision or order is communicated to file a first appeal. The Appellate Authority may admit it for a further period of up to one month if satisfied that sufficient cause prevented filing within the original period. This is a limited extension, not an open-ended power to revive a missed deadline.

Use the communication date—not just the date printed on the order—as the starting point for the statutory calculation, and verify the applicable enactment and service record. Do not assume that filing a writ pauses the appeal period or restores the right to appeal after it expires.

How much pre-deposit is required for a first GST appeal?

Section 107(6) requires the appellant to pay the amount admitted as due in full, including admitted tax, interest, fine, fee, and penalty, plus 10% of the remaining amount of tax in dispute. The 10% is not automatically calculated on the entire demand: first distinguish admitted sums from the disputed tax amount, then confirm the calculation under the applicable GST law.

Once the payment prescribed by section 107(6) is made, section 107(7) deems recovery proceedings for the balance amount to be stayed. That is a statutory consequence of satisfying the appeal pre-deposit requirement; a writ petition does not automatically provide an equivalent stay.

How to protect the appeal while deciding what else to do

  1. Secure the complete record. Obtain the full demand order and record both its date and the date and manner in which it was communicated. Keep the show-cause notice, reply, hearing records, portal notices, and service evidence.
  2. Identify the legal basis and amounts. Note the provision relied on, tax period, demand components, and whether the matter falls under the CGST, SGST, or IGST law. Separate amounts admitted as due from the disputed tax.
  3. Calculate the section 107 deadline promptly. Count from communication of the decision or order. If the ordinary period may have passed, do not presume a writ will cure that problem; assess the limited statutory extension and the facts with qualified GST counsel.
  4. Assess the grounds and relief sought. Match a merits challenge to the statutory appeal route. If asserting jurisdiction, constitutional, or natural-justice grounds, have counsel assess the record and the relevant High Court’s precedent rather than assuming the exception applies.
  5. Check the live filing process. The GST portal’s stated online route is Services > User Services > My Applications > Application Type: Appeal to Appellate Authority > New Application, then select “Demand Order.” The portal identifies Form GST APL-01 for the appeal. Interface labels can change, so verify the current portal screens before filing.

What happens after the first appeal?

A further appeal from an order under section 107 or 108 may lie to the GST Appellate Tribunal under section 112. The statute provides a three-month filing period, allows a further period of up to three months for sufficient cause, and requires a further pre-deposit of 20% of the remaining disputed tax in addition to the amount paid under section 107(6). After the prescribed payment, recovery of the balance is deemed stayed under the section’s terms. Confirm current notification dates and filing arrangements for the relevant case before relying on this next stage.

What to take to a GST adviser

  • The complete demand order and proof of when and how it was communicated.
  • The show-cause notice, submissions, hearing records, and relevant portal or service records.
  • A breakdown of admitted dues, disputed tax, interest, fines, fees, and penalties.
  • The tax period, statutory provisions, and applicable CGST, SGST, or IGST enactment.
  • A clear account of the alleged error and the relief sought, including any claimed jurisdictional or natural-justice issue.

The correct route for an individual case cannot be selected from the label “GST demand order” alone. It can depend on the order, communication and service evidence, applicable State enactment, underlying record, current Tribunal arrangements, and local High Court precedent. No reliable comparative success-rate, cost, or duration statistic for section 107 appeals versus Article 226 writs is established by the cited official materials.
