India’s GST Council is the constitutional Centre–State forum that makes recommendations on GST matters. The GST Secretariat organizes and supports the Council’s work, while the Fitment Committee examines rate, exemption and classification issues and puts its recommendations before the Council. The committee and Secretariat support the process; neither replaces the Council as the recommending body.
What is the GST Council?
The 101st Constitution Amendment Act, 2016 created the framework for the GST Council. Article 279A establishes it as a joint forum of the Union and the States. Its membership comprises the Union Finance Minister, the Union Minister of State in charge of Revenue or Finance, and the minister responsible for finance or taxation—or another minister nominated by the state—from each State. The Council makes recommendations to the Union and States on GST matters. These include which goods and services may be taxed or exempted, model GST laws, place-of-supply principles, thresholds and rates. A recommendation is not itself the enactment of every tax provision: implementation takes place through the relevant governmental and legislative mechanisms.
How does the Council make decisions?
The Council’s official description says it generally works by consensus. If a vote is held, the Centre has one-third of the total weighted votes and the States together have two-thirds. A proposal passes only if it receives at least three-fourths of the weighted votes of members present and voting. The rule and voting weights are set out on the Council’s institutional page.

Established in New Delhi in September 2016, the Secretariat is the Council’s administrative and coordinating arm. Its published functions include arranging Council meetings, preparing agenda notes and minutes, following up on implementation of Council decisions, examining representations about GST laws, rules and rates, and organizing coordination meetings for senior Central and State tax officials. Its role is to prepare, record, coordinate and follow up—not to make Council recommendations independently. Details are on the Secretariat’s “Who we are” page.
Support for related committees
The Council has delegated the GST Implementation Committee authority over urgent and procedural issues between Council meetings; that committee’s decisions are brought to the next Council meeting for information. The Secretariat also provides administrative support to the IT Grievance Redressal Committee, which addresses taxpayer grievances caused by technical glitches on the GST portal and recommends steps to GSTN.

What is the Fitment Committee in GST?
The Fitment Committee is a technical committee that examines GST rates, exemptions, and clarifications needed to resolve classification or rate issues. It submits recommendations for consideration by the GST Council; the Council then considers the matter and makes its recommendation to the Union and States. Joint Secretaries of the Secretariat are among its members. The Secretariat describes this hand-off on its institutional page.
How many members are on the Fitment Committee?
A GST Council Secretariat memorandum dated 23 July 2025 reconstituted the committee with nine Centre members, eleven State members and two Secretariat members. It names the Joint Secretary, TRU-I, Department of Revenue, as Centre co-convener and Karnataka’s Commissioner, Commercial Taxes, as State co-convener. The memorandum also names State tax officials from Gujarat, Rajasthan, Tamil Nadu, Maharashtra, Bihar, Uttar Pradesh, Haryana, West Bengal, Madhya Pradesh and Delhi. This is the composition stated in that dated order, not a permanent headcount: 23 July 2025 memorandum.

Does the Fitment Committee decide GST rates?
No. The committee examines rate, exemption and classification questions and recommends how they should be handled. Its recommendations go to the GST Council for consideration; the Council makes recommendations to the Union and States. This distinction matters because the Council’s recommendation is not the same thing as the subsequent governmental or legislative action that gives a tax provision legal effect.
Nor does every issue examined by the committee necessarily lead to a proposed rate change. The agenda for the 53rd GST Council meeting grouped Fitment Committee deliberations into proposals for changes or clarifications, matters for which no change was proposed, and items placed before the Council for information. - Issues enter official processes. Proposals and representations may be considered through the relevant processes; not every GST issue is shown to follow one mandatory route.
- The Fitment Committee examines technical matters. For rate, exemption and classification or rate-clarification issues, it deliberates and may make recommendations.
- The Council considers committee recommendations. Fitment Committee recommendations are placed before the GST Council, which considers them and makes its recommendation to the Union and States.
- The Secretariat supports the work. It helps organize meetings and agendas, records proceedings, handles representations and follows up on Council decisions.
- Governmental and legislative mechanisms implement provisions. The Council’s recommendation does not, by itself, enact every tax change.
The minutes of the 48th Council meeting provide one example: the Secretary introduced a Fitment Committee agenda that included proposed changes, no-change matters and deferred matters for goods and services.
