The Google–Epic Games app-store appeal is no longer upcoming: on July 31, 2025, a unanimous Ninth Circuit panel upheld the jury’s antitrust verdict against Google and affirmed the district court’s permanent injunction. The current dispute is about whether Google’s U.S. changes make rival Android stores genuinely easy to find and use—not just technically available.
What happened, and what is still in dispute?
- Epic sued Google in 2020, challenging Google Play’s control over Android app distribution and in-app payments.
- A jury found Google liable for federal and state antitrust violations in December 2023; the district court later ordered changes to billing and app-store distribution.
- The Ninth Circuit affirmed the verdict and injunction in 2025. The Supreme Court denied Google’s request to pause the injunction, but did not decide the merits of the case.
- Google says U.S. catalog-access and third-party-store programs took effect in July 2026. In August, Epic challenged whether rival stores were sufficiently easy to find and install.
The case remains consequential because a court-ordered opening is meaningful only if developers and users can use it in practice. The remedy described here is U.S.-focused; it is not a worldwide change to Android.

Why did Epic sue Google?
Epic’s Google case began after Google removed Fortnite from Google Play in 2020. Epic had introduced a payment method intended to bypass Google’s billing system. Epic alleged that Google used Play and Google Play Billing to control how Android users obtained apps and made in-app purchases, restricted developers from directing users to other payment options, and used agreements with device makers, carriers and developers to discourage competing stores. Epic also argued that Google made sideloading and rival stores seem risky or inconvenient.

Those were allegations to be tested in court, not a finding that every warning or distribution restriction was unlawful. The district-court case record is available from the U.S. District Court for the Northern District of California.

What did the jury decide—and what did the injunction add?
The jury’s liability verdict
After a 15-day trial involving 45 witnesses, the jury found Google liable for federal and state antitrust violations in markets involving Android app distribution and Android in-app billing. That verdict decided liability; it did not by itself specify all the practical changes Google had to make.
Judge Donato’s remedy
In October 2024, U.S. District Judge James Donato issued a permanent injunction. In plain terms, its central requirements were to stop Google from blocking developers from using alternative billing or communicating with users about external purchasing; allow links to external transactions; enable rival app stores to be distributed through Google Play; and provide competing stores access to the Play app catalog, subject to developer opt-outs. The injunction also restricted certain payments, incentives and agreements that could prevent rivals from competing. The original remedies were designed to operate in the United States for three years.
The Ninth Circuit described the principal store-related measures as catalog-access and app-store-distribution provisions. Catalog access does not mean every app must appear in every rival store: developer opt-outs and program conditions affect what is available.

What did the Ninth Circuit decide?
On July 31, 2025, a unanimous panel of the U.S. Court of Appeals for the Ninth Circuit affirmed the jury’s antitrust finding and upheld the district court’s injunction. Google argued, among other things, that the trial court used an improper market definition, treated its case differently from Epic’s separate Apple litigation, made legal and factual errors, and imposed an injunction that was too broad and risked security and privacy problems. Google also objected to having to distribute stores that compete with Play through Play itself.
The panel rejected Google’s central arguments. It emphasized that this case followed a completed jury trial, final judgment and permanent injunction—not a preliminary-injunction proceeding. The court’s July ruling and later order are available in the Ninth Circuit’s merits opinion and its September 12, 2025 order.
Why the compliance schedule changed
The Ninth Circuit initially paused the injunction while it handled the appeal. In September 2025 it denied Google’s request to keep the injunction stayed pending further review, while adjusting timing: the main catalog-access and rival-store provisions were given ten months after issuance of the mandate, while some shorter compliance deadlines remained 30 days after the mandate. That timing adjustment was not a reversal of the injunction.

What did the Supreme Court do?
Google asked the U.S. Supreme Court for a partial stay—an order temporarily pausing parts of the injunction—not for the Court to decide the appeal’s merits at that stage. On October 6, 2025, the Supreme Court denied the stay application. That allowed the injunction to proceed; it was not a Supreme Court ruling affirming or reversing the Ninth Circuit’s antitrust decision. The application and docket entries are available on the Supreme Court docket.
This is separate from Epic’s litigation against Apple. The two cases involved different defendants, records, legal issues and remedies; the outcome in one should not be treated as the outcome in the other.
What has Google changed for U.S. developers and stores?
Google’s U.S. developer policy describes changes to alternative billing and external-purchasing links, as well as programs for rival stores and catalog access. Google says Play Catalog Access and Third-party App Store on Play began operating in the United States on July 22, 2026, after eligible third-party stores could begin onboarding on July 15. Under the catalog program, Play listings are made available to eligible rival stores unless developers opt out. Google’s policy page also says certain reporting and service-fee obligations for covered programs begin October 1, 2026.

These are Google’s stated program terms, not a guarantee that every store or developer qualifies or that every app will be carried. The policy page sets out current geographic scope, participation conditions and program details: Google Play’s U.S. policy update for developers.
For developers, alternative billing and external links create additional ways to direct users to purchases, but permission to use another payment route does not guarantee lower prices or higher revenue. Payment processing, fraud prevention, taxes, refunds, customer support and program-specific obligations still affect the economics. Google Play remains a major distribution channel, so developers must weigh potential flexibility against reach and compliance requirements.
Why is Epic challenging Google’s implementation?
The latest reported dispute concerns the difference between availability and discoverability. Epic argued that rival stores remained unnecessarily difficult to locate and install through Google Play. Reports of an August 14, 2026 court appearance said Epic showed searches that failed to surface obvious rival-store results and objected to an “Are you looking for?” intermediary screen. Judge Donato reportedly directed Google to reduce search and installation friction, with changes expected within about a week. These details are based on reporting on the hearing; they should not be mistaken for the text of a published court order.

The enforcement question is whether Google is complying in a way that gives rivals a practical opportunity to compete. A store can be listed yet hard to discover; it can be discoverable yet fail to attract users or developers. Search results, presentation, warnings and installation steps all matter to that assessment.
What does this mean for Android users?
More choice, but not guaranteed savings
If rival stores become easier to find and install, users may have additional places to get apps and games, and stores may compete through selection, promotions, pricing or payment options. But the ruling does not establish that prices will fall: developers and stores face their own costs and decide whether to pass any savings on to customers.
Security remains a separate decision
Easier installation does not mean every store or app is equally safe. Users still need to consider a store’s reputation, app review and update practices, and the risks of impersonation, fraud or malware. Google’s security arguments were part of its challenge to the injunction, but neither the arguments nor the ruling alone establishes comparative malware rates or user outcomes.

The implementation described by Google concerns U.S. users and developers in covered programs. Android distribution rules can differ by country and jurisdiction, so the U.S. changes should not be read as a global opening of Google Play.
What happens next?
The appellate phase described here is over, but district-court enforcement remains important. The next practical tests are whether Google adjusts the search and installation experience, whether developers opt out of catalog access, and whether rival stores attract enough apps and users to provide real competition. Google’s March 2026 announcement that it and Epic had proposed a settlement and modified injunction does not, by itself, establish that the proposal replaced the existing remedy; Google’s policy page describes a request for district-court approval, while later reporting describes an ongoing compliance dispute.
For consumers and developers, the key measures are therefore not simply whether a rival store appears in a program, but whether it is usable, its catalog is meaningful, and its terms support a viable alternative. Further court orders or an approved modification could affect those details.
