Yes, Google was sued over AI Overviews—but the Penske Media case was dismissed. On September 30, 2026, a federal judge dismissed Penske’s amended complaint against Google and Alphabet. The ruling came at the pleading stage: it did not determine whether Google’s AI features reduced Penske’s traffic or prove the revenue figures in the complaint.
What was the Google AI Overviews lawsuit about?
Penske Media Corporation and affiliated publishers sued Google LLC and Alphabet Inc. in the U.S. District Court for the District of Columbia on September 12, 2025. The complaint alleged that Google used publisher material in AI Overviews and other generative AI products while changing search results in ways that reduced visits to publisher websites. Penske argued that fewer visits could hurt revenue from advertising, subscriptions and affiliate links. Those were the plaintiffs’ allegations, not findings established by a trial.

The dispute raised a practical business question for publishers: if a search result answers a query without sending a reader to a publisher’s site, what happens to the visit—and to the advertising impression, subscription opportunity or affiliate purchase that might have followed? The complaint framed that concern as an antitrust and unjust-enrichment case against Google.

- About 20% overlap: Penske alleged that from late 2024 through early 2025, approximately 20% of searches that returned Penske sites in organic results also generated AI Overviews. That is the complaint’s reported overlap, not a court-verified measure of lost clicks.
- More than one-third decline: Penske alleged its portfolio-wide organic affiliate revenue had fallen by more than a third from its peak by the end of 2024, attributing the decline to reduced referrals from Google Search. The complaint’s attribution is an allegation; the court did not establish that Google caused the decline.
The complaint also cited an April 2025 Ahrefs analysis as finding up to a 34.5% reduction in click-through for the top organic result when AI Overviews appeared, and cited a Bain & Company estimate that 60% of searches ended without an external click. These are secondary figures quoted in Penske’s complaint, not figures independently assessed here, and they do not establish the effect on Penske’s own business.
Why did the court dismiss the complaint?
In a September 30, 2026 memorandum opinion, Judge Amit P. Mehta granted Google’s motions to dismiss Penske’s amended complaint and a related federal action brought by Chegg. The court also declined supplemental jurisdiction over the state unjust-enrichment claims. Its decision addressed whether the complaints stated legally adequate claims on the pleadings—not whether a trial would confirm or disprove the publishers’ traffic and revenue allegations.

The alleged reciprocal exchange
The publishers described an exchange in which they supplied content for Google’s search index and Google sent readers back to their sites. The court found that the complaints did not plausibly allege an agreement with the essential terms needed for that reciprocal-dealing theory. On the pleadings before it, the court considered voluntary, cost-free crawling a more plausible account than the alleged agreement.
The alleged tie between Search and AI Overviews
The court also found that Penske had not plausibly alleged Google Search and AI Overviews were separate products for its tying theory. It treated AI Overviews as one kind of result within the broader search experience; the complaint’s own account suggested users sought information generally, rather than separately demanding search links and AI-generated answers.
Judge Mehta wrote, “The court will grant the motions.” That sentence referred to the motions to dismiss the complaints before the court. The ruling does not amount to a finding that AI Overviews have no traffic effect, that Google’s conduct is lawful in every respect, or that a trial disproved Penske’s figures.
What does the evidence say about publisher traffic and click value?
Traffic volume and the value of the visits that remain are separate questions. Fewer referrals can mean fewer opportunities to show ads, attract subscribers or generate affiliate sales. But a smaller number of referrals could, in principle, be more likely to result in a valuable action. A traffic count alone does not answer whether the remaining visits are more commercially valuable.

UK regulator’s account of the measurement problem
The UK Competition and Markets Authority (CMA), in its publisher conduct material, records publishers’ reports of significant declines in organic traffic and explains how lower traffic can reduce advertising and subscription opportunities. It also records Google’s position that referrals from search generative AI features may be higher quality—more likely to lead to valuable outcomes such as subscriptions. The CMA says publishers could not accurately assess whether such referrals were more valuable than conventional search referrals, and discusses access to clearer click-quality information. This UK regulatory material provides context; it does not decide the facts of Penske’s U.S. case.

A preregistered 2026 field experiment by Stephanie T. Wang, Jeffrey Gleason, Yakov Bart, Christo Wilson and Danaé Metaxa assigned 1,100 participants to Google Search conditions. The authors report that hiding AI Overviews and AI Mode increased click-through to publishers. An AI Mode-only condition reduced publisher clicks and eroded participants’ user experience and trust in information found on Google. The findings describe the participants and conditions studied; they are not a universal estimate of traffic losses for all publishers or queries.

What the dismissal means for publishers and readers
The case’s dismissal resolves the legal sufficiency of these complaints at the district-court stage, not the broader commercial question of how AI-generated search results affect publishers. For a publisher, the relevant measures extend beyond rankings or impressions: referrals, engagement, ad revenue, subscriptions and affiliate conversions can move differently. Establishing what caused a change also requires separating AI-result exposure from other changes in search demand, content performance and monetization.
For readers, the headline’s phrase “crush publisher web traffic” should be read as forceful framing, not as a court finding. Penske alleged that its search referrals and affiliate revenue were harmed; the judge dismissed the complaint without holding a trial on those claims. The court’s ruling was about whether the pleaded legal theories were plausible on the record before it.
Is the case over, and did Penske appeal?
The district court dismissed the amended complaint on September 30, 2026. The docket information available for this update did not establish whether Penske filed an appeal after that date, so post-dismissal appeal status remains unconfirmed. A dismissal at the district court is not, by itself, proof that no further proceedings will occur.
