The GENIUS Act did not pass a key Senate procedural vote on May 8, 2025: senators voted 48–49 against invoking cloture on a motion to proceed to the bill. That was a setback, not a final vote to reject the legislation. Congress later passed the measure, and it became law on July 18, 2025.
What happened in the Senate on May 8, 2025?
The Senate considered whether to end debate on a motion to proceed to S.1582, the GENIUS Act. Cloture was not invoked, with the vote recorded as 48–49, Record Vote No. 240. The official Congress.gov action history for S.1582 identifies the vote as cloture on the motion to proceed.
That distinction matters: senators were voting on whether to advance the bill for consideration, not on final passage. The May 8 result therefore did not itself enact or permanently defeat the GENIUS Act.
Why did some Democratic senators oppose advancing it?
AJ Dellinger’s May 8, 2025 Gizmodo report described Democratic senators who had been expected to support advancing the bill voting against cloture. The report connected their opposition to disputes over Republican changes to the legislation and concerns about President Donald Trump’s crypto interests. Those are reported explanations; the official vote record establishes the result and its procedural subject, not senators’ individual motives.

Senator Ruben Gallego, explaining his vote against advancing the bill, said: “The Republicans killed it, because my colleagues don’t have enough time to read the changes that we have been proposing.”

The May 8 procedural setback was followed by later legislative action. The GENIUS Act was enacted on July 18, 2025, as Public Law 119–27. The enacted law concerns regulation of payment stablecoins.

In other words, the headline describes a failed step in the bill’s path through the Senate, not the law’s ultimate fate. The later enactment is the relevant status for readers asking whether the GENIUS Act became law.
