On February 12, 2026, FTC Chairman Andrew Ferguson sent Apple CEO Tim Cook a warning letter asking the company to review whether its news curation matches its terms and consumer-facing representations. The alleged imbalance cited in the letter comes from outside reporting and a Media Research Center analysis, not an FTC audit.
What the FTC asked Apple to do
In a February 12, 2026 letter titled “Potential FTC Act Violations Related to Suppressing or Promoting Featured News Articles for Political Reasons,” FTC Chairman Andrew N. Ferguson asked Apple to conduct a comprehensive review of its terms of service and ensure article curation aligns with those terms and its representations to consumers. He called for swift corrective action if the review found a mismatch. The letter is a warning about potential legal exposure, not a formal finding, lawsuit, or binding order to change the feed. The FTC describes Apple News as an app that aggregates and curates articles from newspapers, magazines, and digital publications. It says the app comes pre-installed on many iPhones and iPads, and the letter characterizes it as purporting to be the most-used news app in the United States. That usage claim is the FTC letter’s description; the sources reviewed here do not independently verify a user count. The agency also lists the letter in its legal-library record.
What the alleged imbalance is based on
The FTC letter cites media reports and a Media Research Center (MRC) report as the basis for its concern. It says reports described no recent Apple News features from American conservative-leaning sources alongside hundreds from liberal publications. Those are reported claims, not results from an FTC sampling study.

The Associated Press reported that MRC said none of 620 top stories featured in Apple News during January 2026 came from a conservative media source. AP also reported that Apple had not immediately replied to its request for comment on February 12. Read the AP report.
In a February 19 letter to Tim Cook, Senator Marsha Blackburn attributed a related set of figures to MRC: 440 of over 600 stories in January morning time slots were published by outlets classified as left-leaning, while zero came from outlets classified as right-leaning. Blackburn said the ratings came from AllSides, which she described as using panels across the political spectrum; she also said AllSides did not participate in MRC’s study. Read Blackburn’s letter.

AP’s description of 620 “top stories” and Blackburn’s account of over 600 morning-slot stories do not establish identical samples or methods. The figures should therefore be understood as MRC-attributed findings relayed by other sources—not as independently verified, platform-wide measurements or an FTC conclusion.
What the FTC says the law could require
The letter points to Section 5 of the FTC Act, which prohibits unfair or deceptive acts or practices. It describes three conditional ways political favoritism in a news feed could raise concerns:

- Conflict with terms: Curation could be an issue if it is inconsistent with Apple News’s terms of service.
- Undisclosed favoritism: Favoring or suppressing sources without disclosure could matter if it contradicts reasonable consumer expectations and amounts to a material omission.
- Substantial consumer injury: A practice could raise a concern if it causes substantial injury consumers cannot reasonably avoid and that is not outweighed by benefits to consumers or competition.
The FTC letter does not say any of these conditions has been proven in Apple’s case. Ferguson also drew a boundary around the agency’s role: “The FTC is not the speech police; we do not have authority to require Apple or any other firm to take affirmative positions on any political issue, nor to curate news offerings consistent with one ideology or another.”

The cited accounts raise questions about Apple News’s editorial and ranking practices, but the reviewed sources do not conclusively answer them. They do not establish whether Apple excluded or deprioritized outlets because of their political orientation, how editorial judgment interacts with algorithmic ranking, or whether the reported sample represents the broader feed.

Blackburn asked Apple whether it had excluded or deprioritized right-leaning outlets based on bias; how human editorial judgment and algorithmic ranking work; whether it could provide internal political-distribution data; whether it had audited for political bias; and what appeal process publishers have. She requested a response by March 4, 2026. The materials reviewed here do not establish whether Apple later responded or completed an audit.
To assess the allegation, readers need to distinguish the time window and feed placement sampled, the method used to classify outlets, human selection from algorithmic ranking, and what Apple’s terms and consumer representations actually promise. The cited sources do not supply an independent audit that resolves those questions.
