France’s right to disconnect is already part of its Labour Code, not simply a new proposal. It gives employers and employee representatives a framework for setting rules on after-hours digital contact, but it does not create a universal statutory switch-off hour. The right is welcome; whether it is enough depends on the workplace rules, their enforcement and whether employees can actually refuse after-hours work without pressure or disadvantage.
What French law already requires
Article L2242-17(7) of France’s Labour Code places the terms for employees to exercise their right to disconnect, along with measures regulating the use of digital tools, within annual workplace bargaining. The stated purposes are to protect rest and leave and employees’ personal and family lives. The current form of the provision entered into force on 31 March 2022. The French Ministry of Labour also identifies Article L.2242-17(7) as the basis for the framework.
The provision’s central wording refers to “the terms for the full exercise by the employee of their right to disconnect” and to the employer putting in place measures to regulate digital-tool use. It does not set one nationwide hour after which every employee must be unreachable. Instead, the law relies on workplace bargaining and rules tailored to how digital tools are used.
If bargaining does not produce an agreement
If no agreement is reached, the employer must prepare a charter after consulting the social and economic committee (CSE). The charter must define how the right is exercised and include training and awareness actions for employees and management. This fallback ensures that a written framework is required, but the law’s described process is not the same as a single, uniform set of after-hours protections applying in identical terms at every workplace.

Is there a new French proposal?
The available official material establishes an existing French statutory framework, not a new French bill matching the headline’s description. The distinction matters: a proposal would need to be identified before it could be assessed as a change to French law.
There is a separate European Union policy process. The European Commission’s 2025 communication discusses the right to disconnect and telework, records that EU social-partner negotiations in 2022–2023 did not reach agreement, and describes consultation in 2024–2025. That EU-level activity should not be presented as proof that France has introduced a new national proposal.

What the right means for after-hours messages
The statute requires bargaining or, if that fails, a charter defining how employees exercise the right. It does not itself spell out a universal ban on messages after a fixed time or a blanket rule that every message can go unanswered. Practical expectations therefore depend on the workplace’s rules and on how the employer applies them.
A useful distinction appears in a French government explanation published on 13 April 2026 of a Court of Cassation decision dated 25 March 2026. The employee had connected voluntarily while on sick leave, handled automatic notifications and performed work-related tasks. The courts found no evidence that the employer had required replies outside working time; the Court of Cassation upheld the finding that a violation had not been established. The decision illustrates the difference between choosing to connect and being required or pressured to respond. The government’s summary does not establish that voluntary connection is legally irrelevant in every other situation.

Why formal recognition may not be enough
A written right is only useful in practice if employees know what it covers and can use it safely. The French framework’s reliance on bargaining and a company charter makes the quality of implementation important: a policy can state a right while leaving unclear what counts as urgent, whether delayed delivery is expected, or how managers should behave.
Working time and rest also matter. Eurofound’s digitalisation overview identifies excessive hours and insufficient rest among risks associated with telework. That context supports checking how hours and rest are managed; it does not show that France’s law has caused or prevented those outcomes. No France-specific causal estimate of the law’s effectiveness is established in the cited material.

A 2026 cross-national study by Cherise Regier argues that the effects of right-to-disconnect legislation depend on enforcement and on how protections are distributed among workers, including workplace power relations and gendered divisions of paid and unpaid work. That is a useful lens for assessing implementation, not a France-specific finding. For employees with less bargaining power or substantial care responsibilities, the practical question is whether they can disconnect without facing an informal penalty.

- Clear coverage: Does the policy say which employees and communication channels it covers, and how on-call duties or genuinely urgent situations are handled?
- Defined expectations: Are quiet hours, response times and delayed delivery explained, so that receiving a message does not silently become an expectation to reply?
- Workload and time: Are working hours and rest monitored, and is the workload realistic within those hours?
- Manager conduct: Do managers follow the rules, and can employees decline after-hours contact without pressure or disadvantage?
- Meaningful fallback: If bargaining fails, does the employer’s charter give concrete instructions and training rather than merely restating the right?
- Usable process: Do employees know where to raise repeated after-hours demands and what happens when the policy is not followed?
The French rule makes the right part of workplace policy and provides a route to a charter when bargaining reaches no agreement. Its practical value depends on whether that process produces clear, workable protections and whether employees can rely on them in day-to-day work.
