Former TikTok Employees Allege China Ties and U.S. User Data Sharing

Former employees’ 2024 accounts raised questions about ByteDance access to U.S. TikTok data. Here’s what they alleged, TikTok’s response and what the public record does not establish.

Former TikTok employees told Fortune in 2024 that the company’s U.S. operation remained connected to ByteDance teams and systems in China, including in workflows involving U.S. user data. The allegations raise questions about whether Project Texas’s U.S.-based storage and access controls were enough to separate the service from its Chinese parent. They do not establish that the Chinese government accessed all, or any particular category, of U.S. users’ data.

The claims, TikTok’s response and the Justice Department’s later court arguments are distinct pieces of evidence—not a single finding that the allegations were proven. The reporting and government filings cited here date to 2024; they do not establish TikTok’s operational or ownership status in 2026.

What former TikTok employees alleged

Fortune reported on April 15, 2024, that it had interviewed 11 former TikTok employees about the company’s relationship with ByteDance and its handling of U.S. user data. Their accounts were not uniform: some challenged TikTok’s description of separation from ByteDance, while others said the technical separation had become more substantial by the time they left. The most specific allegations concerned two former employees’ accounts of data workflows and internal systems.

Evan Turner’s account of data exports

Turner, a senior data scientist from April through September 2022, told Fortune that his formal reporting line shifted to a Seattle-based manager but that he continued working with a ByteDance executive in Beijing. He said he emailed spreadsheets about every 14 days to ByteDance employees in Beijing. According to his account, the spreadsheets covered hundreds of thousands of U.S. users and included names, email addresses, IP addresses, and geographic and demographic information. Turner said the work was intended to analyze viewing behavior and determine where people watched particular categories of video. Patrick Spaulding Ryan’s account of internal systems

Ryan, who formerly led TikTok security compliance work, told Fortune that ByteDance retained control over some systems TikTok employees used, including messaging and product or technical-management software. He alleged that workers routinely shared user data, including U.S. data, through internal systems for testing, product development, and troubleshooting. His account points to a distinction between a protected production database and copies or extracts placed in other tools and workflows. TikTok disputed reporting based on former employees’ accounts. What Project Texas was designed to do

Project Texas was a broader data-security and governance program, not simply a move to a U.S. data center. TikTok described it as an approximately $1.5 billion effort launched in early 2022 that included U.S.-based storage for protected U.S. user data on Oracle cloud infrastructure, a separate U.S. data-security team, and controls intended to govern access to data as well as recommendation and content-moderation systems. The framework followed discussions with the Committee on Foreign Investment in the United States (CFIUS). These are descriptions of the program and its intended safeguards, not proof that every control operated effectively across every system. (TikTok’s written Senate responses; Fortune)

Why U.S. storage does not settle who can access data

Data security involves more than the physical location of a primary database. The Congressional Research Service noted that personnel in China could potentially access data remotely depending on permissions, systems architecture, and internal controls, even if the servers themselves were in the United States. A data copy, report or support attachment can also follow a different path from the main database.

  1. Storage: Where the primary database and backups are hosted.
  2. Access: Which employees, teams, contractors or parent-company personnel can query, retrieve or otherwise view the information.
  3. Processing and transfer: Whether information is copied into spreadsheets, logs, testing environments, analytics tools, support systems or collaboration platforms.

Project Texas focused on protected data, U.S. infrastructure and access controls. The former employees’ accounts focused on people, tools and workflows that they said connected TikTok to ByteDance. What the Justice Department argued—and what it did not establish

In July 2024 court filings, the Justice Department argued that TikTok and ByteDance employees used Lark, ByteDance’s internal collaboration system, to communicate about U.S. user data. The government also asserted that some information was stored on Chinese servers and was accessible to ByteDance employees in China. These were government claims made in litigation, not a blanket final finding that every U.S. user’s data was transferred or that Chinese government agencies obtained it. Three claims should not be collapsed into one: that TikTok remained connected to ByteDance; that ByteDance personnel in China could access or receive some U.S. user information; and that the Chinese government actually obtained or used that information. The employee accounts and DOJ arguments bear on the first two. The cited record does not establish the third.

What TikTok said in response

TikTok said it had taken significant steps to protect U.S. user data and that Project Texas was designed to address national-security concerns. The company disputed reporting based on anonymous former employees and argued that some government claims described potential risks rather than evidence that the Chinese government had obtained specific data. Its written Senate responses described ByteDance Ltd. as the ultimate parent: a Cayman Islands holding company with worldwide investors, founders and employees, with operating companies remaining ByteDance subsidiaries. That corporate structure is relevant context, but it does not by itself prove or disprove access by a government. Which kinds of data were at issue?

“U.S. user data” is not one uniform category. Viewer activity, account details, creator payments, advertising information, diagnostics and support records can have different systems, access rules and retention practices. A claim about one category should not be generalized to every user or every data type.

The Congressional Research Service reported that TikTok told Congress at least seven years of data relating to U.S. paid content creators was stored in data centers in China. That material reportedly included financial records such as tax forms and Social Security numbers. Separate reporting also described creator and advertiser financial information stored in China. This is a specific concern about sensitive creator and advertiser records, not evidence that every ordinary U.S. viewer’s complete profile was stored there. (Congressional Research Service; Forbes)

What is documented, alleged and unresolved

Other concerns form context but do not prove the specific former-employee claims. In June 2024, the FTC said it had referred a complaint to the Justice Department concerning alleged violations of children’s privacy law and a 2019 consent order; a referral is not itself a finding of liability. How to assess the competing claims

Specific, attributable evidence deserves more weight than a generalized assertion, but specificity alone does not make an allegation proven. Court records, sworn testimony, regulatory findings and authenticated company records can establish facts within their scope. Named former employees describing work they personally performed can illuminate internal practice; multiple corroborated accounts may strengthen a pattern. Anonymous accounts reported by a reputable outlet can warrant scrutiny, while political statements and speculation about what a country’s laws might permit are not proof of a particular transfer or disclosure.

The central trade-off is straightforward. TikTok’s position is that U.S. cloud infrastructure and controlled access can mitigate risk. Critics argue that data localization is insufficient if parent-company personnel, internal tools or reporting lines preserve access pathways. The unresolved question is whether safeguards were fully implemented, independently verified and effective beyond the primary database. What U.S. TikTok users can do

  • Review the app’s device permissions and disable access—such as contacts or location—when it is not needed for a feature you use.
  • Avoid sharing sensitive financial, employment or location details in posts, messages or profile fields. Deleting a post does not establish that all copies, logs or records are immediately removed.
  • If your employer restricts TikTok on work devices or networks, follow that policy rather than trying to work around it.
  • Decide whether the uncertainty fits your personal risk tolerance. Removing the app reduces your direct use of TikTok, but switching to another large, ad-supported social platform does not eliminate behavioral tracking or centralized data collection.

A VPN may reduce the exposure of your IP address and network traffic to a local network operator, but it does not prevent TikTok from collecting account, device, viewing or engagement information. A password manager can help protect your login from credential reuse, but it does not change the company’s data-access architecture. Neither tool resolves the governance questions at issue here.
