Former Seattle entrepreneur and husband to get most seized funds back in Amazon case

A 2022 settlement returned $525,000 seized from Amy and Carleton Nelson while requiring almost $109,000 in forfeiture. The agreement did not admit unlawful activity, and Amazon’s separate kickback allegations were denied by Carleton Nelson.

Amy Sterner Nelson and her husband, Carleton Nelson, agreed in a 2022 settlement with the U.S. government to forfeit almost $109,000 while receiving $525,000 of seized funds back, according to GeekWire’s February 11, 2022 report. The agreement did not admit that either spouse engaged in unlawful activity.

What the settlement provided

The Nelsons and the government filed a joint motion in federal court in Virginia, as reported by GeekWire. Under the stipulated agreement, the government would return $525,000 and the couple would forfeit almost $109,000.

The reported figures mean the couple would recover most of the money seized, but not all of it. GeekWire’s account did not independently establish the underlying docket or provide a later court-order update.

Why the FBI seized the money

The seizure occurred in 2020 and was connected to an FBI investigation into Carleton Nelson’s work arranging Amazon real-estate transactions. He had previously been an Amazon real-estate transaction manager.

GeekWire reported that the investigation had not produced criminal charges against him as of February 11, 2022. That date matters: the report describes the status at publication, not the later or current status of any investigation.

What Amazon’s lawsuit alleged

Amazon’s case was a separate civil lawsuit. The company alleged that Carleton Nelson and a colleague conspired to receive millions of dollars in kickbacks for steering Amazon Web Services data-center deals to a Colorado real-estate developer.

Those accusations were allegations, not findings established by the settlement described here. Carleton Nelson denied them. His lawyers argued that broad provisions in his Amazon employment contract allowed outside business involving Amazon clients and customers.

The government settlement did not resolve the merits of Amazon’s separate civil allegations in the account published by GeekWire. The report described that lawsuit as ongoing at the time.

Why Amy Nelson said they accepted the deal

Amy Nelson characterized the agreement as a pragmatic decision because the returned money was needed for her husband’s legal defense. In a statement quoted by GeekWire, she said, “The settlement allows us to get more money back, and we very much need the funds so that Carleton can defend himself against the lawsuit Amazon filed in Virginia.”

She also said, “My husband has never been charged with a crime, let alone convicted of one.” That was Nelson’s statement; the separate procedural fact reported by GeekWire was that the FBI investigation had not resulted in criminal charges as of the article’s publication.

The family’s account of the fallout

Nelson said the seizure and the events surrounding it led the family to leave Seattle, sell their home and move away from the community where she had built The Riveter, a company focused on workspace and support for women entrepreneurs.

She said she had created 100 jobs and worked with women starting businesses. Those figures and descriptions are attributed to her account rather than independently verified findings in the settlement report.
