Biswamohan Pani, a former Intel employee who had joined AMD, pleaded guilty in April 2012 to wire-fraud and theft charges involving Intel trade-secret documents, according to VentureBeat’s April 6, 2012 report. The report’s $1 billion figure was an initial estimate; it said Intel later valued the secrets at $200 million to $400 million. Neither figure, as reported there, establishes a court-determined loss.

What happened in the case?

VentureBeat reported that Pani had worked for Intel before joining AMD and pleaded guilty in April 2012 to wire-fraud and theft charges. The article said the information at issue concerned the design and manufacture of Intel’s Itanium microprocessor, and that agents found documents at Pani’s home. These are details reported by VentureBeat; the account reviewed here does not independently establish them from court records.

Why did the headline say $1 billion?

The headline reflected an initial estimate of the value of the trade secrets, which VentureBeat described as at least $1 billion. The same report said Intel later valued the secrets at $200 million to $400 million. Those figures refer to different estimates, not a finding that Pani caused losses of either amount.

The article does not present either figure as an amount proved stolen or an adjudicated financial loss. A valuation of information is also distinct from a court’s calculation of damages or restitution.

What did AMD say?

VentureBeat quoted AMD spokesperson Drew Prairie as saying the FBI had stated there was no evidence AMD was involved in or aware of Pani’s alleged actions. That is AMD’s reported account of what the FBI had said; it should not be recast as a broader judicial finding or as proof that AMD used the information.

What is known about the possible sentence?

The 2012 report said sentencing was expected in August of that year and described a potential penalty of up to 20 years per fraud count. That was a possible maximum reported at the time, not the sentence imposed. The report does not establish the eventual sentence or final disposition, so neither can be stated from this account.
