Former Abercrombie & Fitch CEO Michael “Mike” Jeffries was arrested on October 22, 2024, along with Matthew Smith and James Jacobson. A federal indictment charged the three men with sex trafficking and interstate prostitution offenses. The charges are allegations, not findings of guilt; the defendants are presumed innocent unless and until proven guilty.
Who was arrested?
Jeffries led Abercrombie & Fitch as CEO from 1992 to 2014, according to the company’s 2025 Form 10-K and the Justice Department’s account of the indictment. Smith and Jacobson were also named as defendants. What are the charges?
The indictment charged the defendants with sex trafficking and engaging in interstate prostitution. Prosecutors allege the conduct took place from December 2008 through March 2015. In the Justice Department’s summary, the alleged scheme involved recruiting men and arranging their travel to locations in the United States and abroad for commercial sex acts. Prosecutors said some of the men aspired to work as models; some had previously worked at Abercrombie stores or modeled for the company. Those are allegations in the indictment, not established facts or findings by a court.
The Justice Department’s 2024 announcement said that, if convicted, defendants faced a potential maximum sentence of life imprisonment and a mandatory minimum of 15 years on the sex-trafficking charge, and a potential maximum of 20 years on interstate-prostitution charges. These were potential penalties described at the time of the charging announcement, not sentences imposed.

What is the case’s current status?
The latest procedural report available here is an Associated Press article published August 21, 2026. It reported that Judge Nusrat Choudhury found Jeffries competent to stand trial after reviewing expert evidence and calls Jeffries made while in custody. AP also reported that Jeffries, Smith, and Jacobson had pleaded not guilty and that trial was then slated for late October 2026.
That anticipated trial window has passed, and no later case outcome or revised schedule is established here. The August report therefore should not be treated as confirmation of the case’s status on October 8, 2026. AP report on the competency ruling

What has Abercrombie & Fitch said?
In its 2025 Form 10-K, the company disclosed that Jeffries had been charged and that multiple civil actions against him and the company related to the alleged behavior were pending. The filing says the company believes the claims against it are without merit and identifies possible reputational and business consequences. That disclosure concerns civil litigation and the company’s stated position; it is not a criminal charge against Abercrombie & Fitch.
Separately, AP reported on arrest day that prosecutors did not allege company resources or property were used in the alleged scheme.
